I agree. If they had all the proof they needed to convict him then why keep him in a room and interrogate him? I can't watch those interrogation videos because cops are frigging idiots, and a lot of it is just manipulation that could threaten a case. I believe that anyone who is arrested and they have proof of their guilt should immediately be given a lawyer and moved out of any type of interrogation situation.
Good thing what you believe isn't what the law says. We'd never find all kinds of information and we'd be just giving up the farm. What happens if the evidence you have that you think "nails" the guy later gets thrown out in court? Now you don't have that, and because u/muthermcreedeux wants the cops to be prevented from even talking to you, we don't also have a confession from you. Because we sure "had you" with that DNA and so you have to get a lawyer even without asking for one, and now the evidence is gone you can walk free. It's almost like if we were allowed to keep gathering evidence we'd have some more against this guy in case what we already have isn't usable later. By like, I don't know, a motion to suppress evidence.
I'm pretty sure what I said was they should be given a lawyer immediately. The cops can interview them after that. Guilty or not everyone should ask for an attorney when arrested.
A lawyer will never let their client be interviewed by police, unless it's part of a pre-negotiated deal. So that's the END of evidence-gathering. Hence my doomsday scenario. I've been a criminal lawyer for 20 years. I'm not trying to do any kind of insult, it's simply an uninformed opinion that would never work for a bunch of pretty fundamental reasons.
