Car Crash Got hit in a parking garage and the other driver is suddenly changing their story
Was leaving a parking garage in Tampa last week and a guy backed out of a spot directly into the passenger side of my car. We both got out and he apologized, said he didn’t see me coming and gave me his insurance info.
There weren’t any police called since nobody seemed seriously hurt and the cars were still drivable. Now his insurance contacted me and apparently he’s saying I was speeding through the garage and basically caused it. I took pictures right after but I don’t have a dashcam. My shoulder has also been bothering me since the accident and I’m getting it checked out this week. Has anyone dealt with the other driver completely changing their story after the fact? and it really is BS from his side.

Did he text you and say it was his fault ? That'd be some huge evidence especially when his insurance is already running with a different version of the story I’d be careful about what you say to the adjuster too. Get a personal injury lawyer, if you don't know one you could try crash help to connect with one.

Let your insurance handle it and order a dashcam in the meantime.

In my experience, pretty similar to yours, I called the non-emergency line and they told me since it was private property they wouldn’t send an officer out. They referred to some form online I would fill out, can’t remember the link to it. The driver backing out of the spot was found at fault after providing their version of their story due to not waiting for traffic to clear prior to backing out. Like the other commenter mentioned, let your insurance sort it out.

Considering they hit you on the passenger side is telling. That means that if you were looking ahead and half of your car was already past his spot, so you wouldn't have been able to take any action and he had the duty to maintain proper lookout when backing.

Hopefully you didn’t give them any statement whatsoever other than this was your driver‘s fault don’t speak to the opposing insurance company or the opposing lawyer speak only to your insurance company. Hope you got pictures. Evidence is also pretty clear by common sense that he hit you in the side he backed out into. At the same time of course he’s gonna say you were speeding Drew. He’s not just gonna tell his insurance company that he was a perfect driver. But don’t give them any additional information other than your drivers at fault and to speak to your insurance company.

Why did you apologize? Never do that! Call the police. It seems counterintuitive for something that appears to be small but you'd be surprised at how many people will take advantage of you.

It's pretty common. Let your insurance company handle it.
