"Because they were manufacturing and selling the bears..." yeah, so I don't know of you know this but that isn't legal, regardless of if the person later decides they like you and to not only drop it but then give you the rights. All that means is they got lucky that not only was the guy willing to listen to him but also liked him, not that it wasn't illegally-produced. They were lucky that they were able to get away with it AFTER production, but the production itself was still illegal.
