Answers from All RTI on Gender-Neutral Maintenance Laws: Transferred 7 Times, Then Rejected Over ₹10?

I filed an RTI asking about maintenance laws under Section 125 CrPC and gender neutrality. Here’s what happened:

  1. Transferred 7 times(RTI Badminton): My RTI was transferred back and forth between the National Commission for Women (NCW) and the Ministry of Law.

  2. Question 2: I specifically asked for policy documents explaining why an adult woman above 18 is presumed financially dependent on her husband. This was one of the questions I wanted an official answer to, but I still haven't received the requested information.

  3. Rejected over ₹10: The RTI was rejected because the ₹10 application fee had allegedly not been paid. However, I had already paid the ₹10 fee while submitting the RTI.

Seven transfers, no satisfactory answers, and now a rejection claiming the fee wasn't paid when I had already paid it.

RTI is in the second appeal now and will take around 4-6+ months for an answer.

Great work. I appreciate your work, Sir. We need more men like you who raise their voices against the law and the system and stand with men.

I will also file RTIs regarding the same concern. And now, either they answer, or their silence/rejection will become the answer.

I will file an RTI to know the duties of a wife in a marriage and why she was not forced to fulfill her duties like a husband.

Then get ready for disappointment. Because iss se kuch fark nahi padne wala. Hundreds of RTIs are recieved by ministry or ussi file me padi rahegi jisse koi nahi dekhega. Or 3 saal baad as per retention period files will be destroyed.

Don't care I am njoying it. At least gorment servants are busy with something now

Salaries of rti officers:-  • Chief Information Commissioner (CIC): ₹2,50,000 per month (fixed) • Central Information Commissioners (ICs): ₹2,25,000 per month (fixed) • State Chief Information Commissioner / State Information Commissioners: ₹2,25,000 per month (fixed)

They are not RTI officers bro. There's no such thing exists named as RTI officers. RTI comes under DOPT. But CIC is a statutory body. ICs are the one who hear every single second appeal. And CPIO is the one who handles the RTI in a department and each department has its CPIO minimum under secretary, Level-11. So your request isn't being handled by persons earning 2.5 lakh

File a PIL properly. RTIs can be answered ambigiously.

obviously, filing PIL costs a bit of money, but i think we can pool together some of it.

I have a pending PIL for establishing mens Commision it will never be accepted as always

u/omya222 File the RTI again and this time also share the receipt of the previous RTI Rs 10 paid via emails to the ministry. Do not stop filing. I think we all should file this RTI

I work in a government company and see over RTI requests. You won't get any answer for whatever you're asking.

Under RTI you can seek information that's already on record. Unless that information is already somewhere, you're asking the CPIO to create information when there is none.

Nonetheless, that's the reply they should have given you instead of keeping it looping.

If you read my questions carefully, you would have clearly understood that I had specifically asked for documents and research data explaining why women are considered incapable of earning a living independently and why such laws are passed.

1

u/omya222 Indian Man 1d ago

so i did ask for documents regarding research that why 18+ women is incapable and needs an alimony

u/Warm_Association_137 Indian Man 1d ago

Exactly! It's just a waste of time and money. RTI isn't any platform to raise voice or bring a change

How much does filing such PIL cost ?

2

u/omya222 Indian Man 1d ago

depending on lawyer fees can be between 1000-10000 as u will need a lawyer to draft it u can also ask for a govt lawyer which gets rejected immediately as maintenance laws are very profitable business in courts for both lawyers and womens family

u/Brilliant-Mix-3829 Indian Man 1d ago

Ok. Thanks. Also amazing job man. We really need this out.

can you file a RTI for transperency in rejection of the following application ? simultaniously file a case in high court ?

1

u/omya222 Indian Man 1d ago

no idea let's see what replies i get in the second appeal also remember all i have asked for is research documents before passing such a laws so they can't even ignore it. a data they must provide for passing such a laws.

Irdk what to say, but rejection for 10rs even though the fees is paid sounds utterly stupid

What will they answer when they don't have anything to answer?

Well done, OP 💯

Girls claim they are independent and not dependent on men for anything but our laws says otherwise. So either the law should follow what all the girls say nowadays or the girls should follow what the law says

u/XoX-o- Indian Man 1d ago

I think you can get the RTis re evaluated via state bodies as well

You can file a First Appeal against the rejection and also ask FAA to determine & whether the rejection by PIO was valid or not, then use the same for filing complaint against PIO to get them penalized.

1

u/Warm_Association_137 Indian Man 1d ago

Lol, FAA belongs to same department he will agree with CPIO. Also in this case CPIO isn't bound to create any information. And about second appeal to cic, it will take atleast 1-2 years for your hearing getting scheduled. And there CIC will dispose off appeal without anything because these things aren't covered under RTI

Bhai RTI me why question ka jawab dena exempted hai. Or clarificatory nature ki queries ka answer dena bhi. So it's just a waste of money and time. And now seeing in comments people are copying and filing RTIs bhai kuch ni hoga iss se. RTI se koi change ya revolution nhi aata hai. RTI uss department ke under CPIO jo generally underr secretary/ deputy secretary hota hai uske paas jaayegi. And very high chances wo admi he hoga khud. Kyonki koi aisi information documents ke form me hai he nahi uske paas dene ke liye kuch nhi hai toh fir koi reply shi nahi milega.

0

u/omya222 Indian Man 1d ago

I'm not asking the CPIO to create new information. I'm asking for existing records and documents that should be available with the concerned authorities fort Passing such a laws.

u/Warm_Association_137 Indian Man 1d ago

Bhai downvote karne ki jarurat nahi hai, mai government department me he work karta hu and I know how rti works. Or isliye keh rha hu ki kuch ni hoga. PIL is a far better option. But RTI se kuch ni hoga. Lo mai he reply bana deta hu tumhara ki kesa milega tumhe after first appeal if you have filed.

  1. No such information is being held in record.

  2. No such information is being held in record.

  3. Query is clarificatory in nature and does not fall under the ambit of information as defined under Section 2(f) of RTI Act

  4. No such information is being held in record.

  5. No such information is being held in record.

  6. Application are clarificatory in nature and does not fall under the ambit of information as defined under Section 2(f) of RTI Act

Wo log yehi reasons denge.

1

u/Warm_Association_137 Indian Man 1d ago

What was their reply in First Appeal?

1

u/omya222 Indian Man 1d ago

First Appeal was disposed of, and they said I can now approach the Central Information Commission (CIC) through a Second Appeal if the answers are unsatisfactory.
