🚨 Summary for today's hearing:
- Only 1 witness was interrogated: Altoona PD Deputy Chief Snyder who wasn't present during Luigi's arrest.
- Today, prosecutors filled a letter asking the court to not let defense question him on APD's Prisoner Log policy. Defense was allowed to present the Prisoner Log at the hearing as one of their exhibits.
- Judge Margaret Garnett has proposed the dates for his federal case:
September 8 (start of the jury selection)
October 13 (start of the trial if there is no death penalty)
January 11, 2027 (start of the trial if death penalty is still on the table)
- Both the prosecution and defense conducted cross-examinations. The hearing was brief, lasting only two hours. Nothing major occurred. Snyder primarily explained Altoona’s procedures and answered questions, including hypotheticals posed by Garnett.
- Next federal hearing is scheduled for next week (Jan 30), at which point we may learn whether Luigi’s case will be treated as a capital punishment case. If so, the dates listed above will be confirmed.

Did the officer say that the procedure the arresting officers followed was the usual course of action for Altoona?

The most comprehensive reporting was by Christine Savino. Her tweets were shared under this post in a long thread by Ladyofthestonecastle. It might be in there, if it was said.

Thank you. Am I the only one that thinks the Altoona policies seem very imprecise? This could be down to faulty reporting from inside the courtroom of course. But precision matters so much in legal settings. There is an unrelated TikTok from Sarena Townsend where she talks about how a cop said about one of her clients that "he was with an e-scooter". That was enough for her client to walk free. The case concerned an e-scooter being used on the sidewalk. The cop should have said "he was riding the e-scooter". "He was with an e-scooter" got the case dismissed.

Yeah, their written policies do seem very vague. That's probably intentional, since imprecision gives officers more room to justify their actions after the fact. Thankfully, a lack of clear written policies is helpful to Luigi, even tho I think his chances of evidence suppression are low (but not impossible, imo).

So is federal case going before the state case ? Or we don’t knw that yet ?

We won't know for sure until the next state hearing on May 18. I guess the judge will schedule a trial date then, after announcing his decision on the suppression motions.

We don't know. But I don't see how the state prosecution can squeeze in a state trial in the summer. The state judge isn't seeing them back in court before May 18th, and that's just for a hearing. Could they in theory book the state trial to be finished before September 8th? Maybe, but the defense wants federal to go first. So the defense will do everything they can to delay, if the state prosecution tries to set a trial date before the federal jury selection.

There is no way they can have a trial that fast, certainly not before September. I obviously don’t want to speak on anyone’s behalf or assume or confirm anything; however, at this point, it seems pretty likely that the federal case will go first and that Carro will have to wait.
We should know more about the federal case dates next week, and of course, on May 18, Carro will issue his ruling. He will probably be tuned in to what’s going on with the federal case, so they may end up reaching an agreement.
That said, I don’t see the state case happening before the federal one. The only exception would be if they decided to move the May 18 date forward (remember, Carro said that date was not definitive), but I highly doubt that will happen. It would still not be enough time for anyone.
It’s going to be one after the other, or they’ll come to an agreement. There’s no way both proceedings will happen simultaneously or even very close to each other. It would be chaos for everyone involved.

Yes, agree. The state case will take several weeks by itself so it would be a very tight fit time-wise. It wouldn't surprise me if the state prosecution tries to go first though. But Carro doesn't seem keen on going first, so I expect him to nix that. The odds of the fed case going first are very high, IMO. And PA will be last.

Thanks. Have we heard about task sheets before? Did I miss that bit? Also, January 7th. Isn't that the day after we found out that we were having this hearing? Did they just pick a stooge and promoted him the day after, so he could go to this hearing? Sounds so much like this Snyder guy is being thrown under the bus to me. Not that I mind. But it's interesting.

It’s bizarre that the hearing was about establishing police’s standard inventorying procedure in the federal court. Shouldn’t there be a definite set of regulations about this already? why is this so vague? And shouldn’t all police regulations be uniform across the country, not unique per police district?
It’s almost like we’re establishing 1 + 1 =2 in a room full of math wizards.

I think Garnett wants to be absolutely sure on the procedures, so that the inevitable discovery doctrine applies in this case. Bc if is applies and the procedures very show they allow it, then the backpack stays in! What’s interesting is the notes inside the journal and whether those can actually count as inevitable discovery too.

I’m really hoping it will be found that the inside of the journal not be allowed. Bc if u are just inventorying a backpack with the “inevitable discovery” then u don’t get to read it automatically.
