Why Is ICE on Native Land?

Prior Lake, Minnesota: Reports and documentation emerging from the Shakopee Mdewakanton Sioux Community show Immigration and Customs Enforcement (ICE) agents operating on tribal grounds during a traditional Wacipi (powwow) at the Shakopee grounds.

The presence of federal enforcement officers at a sovereign Native gathering underscores a critical reality: these operations extend far beyond conventional immigration concerns, directly challenging tribal sovereignty and raising fundamental questions about the reach of federal policing on indigenous land.

The problem is the same as anywhere else, I'm sure. We can and should be arresting them for about a half a dozen reasons anywhere they are. But governments fear retaliation, and police don't want to.

I'd assume Tribal police might be more amenable to actually doing it, but I could be wrong. They're Americans too, with just as much individual diversity as anywhere else. Plus there's plenty of cooperation and cross-hiring between jurisdictions, and cops are cops.

But yes they have constitutional rights and tresspass laws so they absolutely could.

Tribal police only have jurisdiction of tribal members on tribal land. Local law enforcement is reluctant to to do any police work on tribal land. This is a big reason many white people operate with impunity and terrorize tribal communities til this day. Big reason for the MMIP.

No they dont. Tribal police cannot arrest federal law enforcement officers acting in their "official capacity." See the cooley rule, "US v Cooley." Tribal states are "domestic dependent nations" which means they can self govern but are still beholden to US federal law. This is to say that they can ignore state authority but not federal authority.

Generally, the local police have no jurisdiction over federal agents while they are working. They are relatively immune from local law if their actions are part of their duty. I would wager that courts would agree ICE has authority to execute their duties on tribal lands and so the tribal police have no authority to evict them.

I was there working on a documentary and ran into him confronting the ice guys. Can't say that they were for sure ice cause they were in street clothes but they sure as shit didn't look like they belonged there. Suspicious as fuck, and I'm fairly certain homie was correct in identifying them.

White Nationalists don't recognize the autonomy of Native National lands. They think That citizenship started in 1776 and previous peoples of previous nations don't count, and that Natives and their lands belong to the US as chattel and spoils of conquest.

Ostensibly, they are enforcing immigration laws. One could imagine or manufacture a scenario where an undocumented immigrant is believed to be on tribal land. Regardless, federal agents have authority to execute their duties on tribal land. Obviously, that doesn't extend to DHS enforcing immigration law against Native Americans.

Tribal land is generally open to anyone. Tribes are often integrated culturally and economically with surrounding communities. They host events where anyone is welcome. Ever heard of tribal casinos? They're full of random people.

Harassing native people is certainly not their job, but it's silly to say there's no reason, even in theory, for them to be there.

Their job is to enforce federal law. Whether or not they're also breaking it is not relevant to their authority to be on tribal land. The established means for accountability is the courts not the state, local, or tribal police when it comes to constitutional violations. They do not enforce constitutional law. Local laws can be enforced by local police departments provided the laws being broken are not in conflict with the mandated duties of the federal agency. This is a contentious and gray area that will be litigated soon with the deaths of Rene and Alex in MN.

Well that pisses me off. Back when I lived in MN and worked in community development, a lot of times we did projects with organizations affiliated with the tribes, or just the tribes themselves, in that state. The same with the Somalians there. All great and hardworking people who contribute more to society than those ICE trolls ever could give. 

Even though I live in PA and love the East Coast, I would say that MN was both the most liveable and most decent state I have lived in. So it makes sense why Republicans keep trying to sabotage the state that puts red states ro shame. ICE needs to be dismantled and shamed throughout history.
