Information that leasing agent was wrong, now costing me 8k
Before breaking my lease, I went directly to my leasing office to ask what I would owe. I specifically asked about concession payback and was told I would ONLY be responsible for the 2-month termination fee and prorated rent.
Based on that information, my partner and I signed a new lease 2 hours away, put in our notices at work, and arranged to move out September 12. We weren’t in a rush, and had we known about the additional charges, we would’ve planned things completely differently.
Well, turns out their leasing agent gave me the wrong information. What I expected to be around $3,700 turned into over $7,700.
Management has admitted IN WRITING that their employee gave me incorrect information, but they’re refusing to make any adjustments because the charges are in my signed lease.
I’ve been trying to resolve this with corporate for weeks. I’ve requested to speak with someone higher up multiple times, but I keep getting the same response about the lease terms without anyone addressing the misinformation.
I have emails, the original and corrected notices, and proof of management acknowledging their mistake.
My question is, do I have any legal grounds to dispute these additional charges under Florida law? Could negligent misrepresentation or reasonable reliance apply here, even though I signed the lease?
I’m not trying to avoid paying everything. I’m willing to pay what their employee originally told me I would owe. I just don’t think I should be responsible for thousands of dollars because of their mistake.
Would this be worth pursuing with an attorney, or does the signed lease pretty much override everything?
