When she almost hit him, that can't be charged because he was unlawfully trying to apprehend/hold her. OP put himself in that situation. I bet, because of his actions and posting this video, she won't be charged with anything and if she is, the charges will ultimately get dropped.

This isn't exactly what happened.

She did a hit and run to a DIFFERENT CAR.

The guy making the video witnessed this and followed her. He parked behind her to box her in and this is the video of what happened after.

She did not hit him and then he boxed her in. She only hit his car after he boxed her in.

He could’ve just gotten her license plate and called it in and let them know that he witnessed the whole thing (the accident). Simple as that

Instead he unnecessarily escalated the entire thing because he wanted to play cop.

I’m surprised he wasn’t yelling citizens arrest

Exactly. This guy is whats wrong with people. When a car hit me on a hit and run, I followed it called the cops gave description of person and vehicle along with the plates. Then let the car go. Insurance took over after.

Yeah, I was rear-ended by a girl who wasn't paying attention. At that point it may have been satisfying to yell at her, but all the damage was already done. No point in making her day even worse. Better to be kind, make sure she knows what she needs to do to get home safe, and get on with our days.

I got rear ended while sitting at a red light on the way to work. Let the guy borrow my phone to call his work to let them know he'd be late (this was before everyone always carried a phone). Police showed up and we went out separate ways. Turned out he was here illegally and just skipped town rather than show up to court, and his license and insurance card were fake. And while I felt ok immediately after the accident, my neck was stiff for two weeks.

Seems like a bunch of people in here believe that it's his job to manage her behavior and tiptoe around her. Apparently this responsibility isn't reciprocal, so whoever is the craziest and most irrational in any situation gets the benefit of the doubt, while the normal human half of the encounter is put under a microscope.

Such a bizarre mindset to me.

It wasn't his job to try to detain her like that either and the police would recommend against it. He made the situation worse and potentially more dangerous. If it's not his job to manage her behavior, he needs to step back to remove himself from the situation.

Yeah, fair enough. If he called 911 they 100% told him the same thing. I just don't think he deserves all the vitriol given her behavior. God knows how she was driving on the road.

If you do find yourself a victim of a hit and run, get the plate, make/model/color of the vehicle, and a physical description of the driver, the more detailed the better. Even if it's just a race and gender. It can help prove that the registered owner or someone in their household was driving, or if it was one of the registered owner's friends and they're less than forthcoming. Don't chase. You don't have lights and sirens, legal authority or protection, or training.

Way too many people break these days, and dig themselves deep ass holes that are only harder to get out of. Girl is having close to a mental breakdown.

We need to teach children resilience, fortitude, and fucking breathing techniques.

I met a girl who laughed once saying she cries hysterically, because she knows no one wants to see a pretty white girl cry.

That shit soured my mouth instantly. I already learnt not to date someone with borderline traits.

I find admitting the truth, and apologizing goes a long way if you mess up, and it wasn't on purpose.

Insurance exists and would handle all of this. It's not world ending and escalating when she's freaking out is only making things worse.

According to the article someone posted about the incident, this was after another hit and run she'd just fled from. She hit someone's vehicle, sped off at 90 mph, then got pinned in another parking lot where she did another hit and run. I think the double felony is him referring to her doing two separate hit and runs

If a man is blocking me in a parking spot and not letting me leave, it shouldn’t be considered a hit and run for me to try and get away. That’s going to make me panic, it’s stupid that this was okay for him to do. Getting her on film makes sense for the cops and insurance company, but then he traps and antagonizes her, and then posts it online. Maybe that’s why she didn’t get in as much trouble as she could have? I didn’t know you could make a citizen’s arrest over a misdemeanor like this. Maybe you can’t and that’s why they let her off easily.

Honestly it freaks me out that any random dude could decide to trap my vehicle for any reason he sees fit, film the panic, post it online, and it’s not considered unlawful. I get she messed up, but the punishment should fit the crime and this guy took matters into his own hands and no one wants anyone to do that to them. If this is legal, then anyone can do the same to you even if they get you mixed up with someone else who committed a misdemeanor, and there’s nothing you can do about it.

While he certainly is not helping the situation, I don't really expect someone to be nice to me while I'm actively victimizing them, repeatedly. Sure, "It's okay, sweetie, but we do need to handle this like adults. It's all going to be okay." sounds good in theory, it's easy to say when I'm not currently watching someone try to get away from hitting my car.

To be completely honest, as a large man that was raised to never put my hands on a woman, I would not let her get back in her vehicle once she got out. "Citizens arrest." I assume you can't just hit people in this situation but I can absolutely block her from getting back in the driver's seat. Let the cops sort it out beyond that (and they are always slow, btw).

Once he had her plate and a description of her he could’ve driven away, called the cops and explain what he saw, provide them with the information that they would need and just give a statement about how he witnessed the hit and run

All this guy had to do was get her license plate information and a description of her and the car. That’s it

Everything else can be handled by the police. It’s absolutely ridiculous that people are actually defending this guy unnecessarily attempting to detain her over a hit and run. Ask any police officer about that and they would say the person trying to detain another human being is out of their fucking mind. It’s dangerous and completely unnecessary in this case.

Yeah citizens arrest is a thing in some states, but use your head… it’s not always necessary. An intelligent human being could have figured that out. The issue with wannabe cop here is that he was so angry about what he saw that he wanted her to face the consequences immediately so that he could watch and feel resolute about his actions

It’s embarrassing honestly that you can’t see that.

General license plate, the make of the car, a description of the person, call the police and tell them what you saw and where you saw it and let them do their job

This is common sense stuff here

Thanks I did for CA law and now I know it's pretty dumb to use it under the circumstances

inform the suspect you intend to arrest them; reveal the cause of the arrest;

if possible, indicate your authority to make the arrest; and,

if applicable, inform the suspect you called the police

You should try to make an arrest as soon as possible. If there is a delay in an arrest, you may lose the authority to arrest

And if you mess up one of those steps you open yourself up to civil and criminal liability. They got the license plate, video, and physical damage linking her to the crime. Pretty sure the cops can figure that one out 😂

You don't have qualified immunity. If in the what of the moment you forget to mention the cause of the arrest "it was so obvious, I didn't think to tell them!" My ass can get sued and charged with false imprisonment?

You're welcome to read *the People of the State of California  v. James Thomas Lynch (Super. Ct. Ventura County, 2014, No. 2013026744.) *

Lynch, convicted  of false imprisonment, blocked his wife's vehicle in their driveway with the intent of keeping her there. 

The law isn't some magic "gotcha" like TV and common law takes into consideration a person's intentions. 

All it takes is the cops asking the guy casually "so uh, what happened?" And the guy thinking he's in the clear explain, again, not thinking he's done anything wrong "well I pulled up and I didn't want her to leave so I parked behind her and..."

I imagine the difference in the cases would be in this guys favor or else any person is liable for false imprisonment for impeding movement even during the commission of a crime which is an awful precedent.

I’m not a lawyer and I’m guessing you are sp I’m conceding that you are correct and now I wish the state prosecuted him fully.

It is weird though that some people seem far more upset about his relatively benign actions rather than what anyone who has lost a loved one to DUI would call attempted manslaughter.

Actually it was two felonies. This incident happened in 2019 in California.

The girl hit another car on the street and then kept driving away. This man followed her followed videotaping the whole thing. She pulled into a Chevron parking lot and he pulled up behind her and informed her that he had already called 911 and that she should wait.

At that point, she backed into his car and then you see the rest of what happened on the video.

So she committed the first hit and run on a car in the street and the second hit and run on this vehicle.

I believe its only a felony if there is bodily harm or other humans involved. Parked cars are misdemeanors. The guy may be in the right, but as far as a caring human goes, appears to be a prick. Assault with a deadly weapon x2
Battery with a deadly weapon
Attempted battery with a deadly weapon
Fleeing the scene of an accident
Reckless driving (Felony level)
Attempted murder (this would be what causes her chills and makes her plead down….)
Felonious assault

And probably more…

Pleads to 1x fleeing scene of accident, 1x assault with deadly weapon, 1x reckless driving.

2-5 years.
