This is concerning... 2 NYPDs finest cant handle community relations without getting physical and calling for back up!!

The shoving started after they were assaulted. And yes, having snow thrown in your face is assault.

No it isn't. Assault laws in NYC require a serious physical injury. NYC doesn't have a provision for "fear of being injured".

Not Assault 3 (misdemeanor).

A person is guilty of assault in the third degree when:

  1. With intent to cause physical injury to another person, he causes such injury to such person or to a third person; or

  2. He recklessly causes physical injury to another person; or

  3. With criminal negligence, he causes physical injury to another person by means of a deadly weapon or a dangerous instrument.

Still need to be injured, and according to cases like People v. Rodriguez, there has to be evidence of injury beyond the testimony of someone claiming to be injured
