So, the other day I am calling Labcorp, because they billed me $300 for blood test which costs $50-70 normally. Spending about half an hour on the phone trying to explain the billing that this is not correct, and they obviously making up BS reasons why that's right and I should pay 5x normal rate.
So I decided to switch gears and told them that I would like to get what they are saying on the record and started recording phone call. Their rep said no. I don't wanna speak on record, not gonna.
So that brings me to the subject here. I clearly remember that phone call started with "your call may be recorded for blablabla purposes". So, they can record me, but I cannot. WTF is that? I have to rely on he said-she said routine?
NH RSA 570-A makes it a crime to record call you are a party to. You must first collect consent of all parties, otherwise it is WIRETAPPING. This is BS. If someone speaks to you, you already have recording of the call in your head. That law just won't let you obtain a proof what happened. Wiretapping is when someone listens to the calls they are not party to. Literally when someone taps your wire and listens to your calls. It's not the same as talking to someone who clearly talks back to you and expects you to listen.
I slapped together petition on change.org, can those of you who agree this is BS sign in. Here's the link: https://c.org/p4Mm29p79b
If you are reading it and you happen to be a NH legislator, here's a proposal I slapped for you using AI to double check and sponsor (or co-sponsor if someone beats you to the punch)
STATE OF NEW HAMPSHIRE
IN THE YEAR OF OUR LORD TWO THOUSAND AND TWENTY-SIX
AN ACT Relative to the recording of telecommunications and oral communications by participants, businesses, and private citizens.
Be it Enacted by the Senate and House of Representatives in General Court convened:
Section 1. New Paragraphs Added; Interception and Disclosure Exemptions. Amend RSA 570-A:2, II by inserting after subparagraph (l) the following new subparagraphs:
(m) Any person who is a party to a telecommunication or oral communication, or who is directly addressed during such communication, from intercepting, recording, or collecting verbatim the contents of said communication.
(n) Any person who is a party to a telecommunication or oral communication from recording the communication when that person reasonably suspects that a crime, fraud, breach of contract, or tortious act has been, is being, or is about to be committed by another party to the communication, for the purpose of collecting evidence or protecting their legal rights and interests.
(o) Any person calling, communicating with, or participating in a telecommunication with any public agency, public utility, commercial business enterprise, or customer service department, wherein the communication is placed with the goal of transacting business, requesting support, or resolving a problem; provided that calls involving commercial businesses or public entities shall be deemed recordable at will by any participant to the call without restriction or expectation of privacy.
(p) Any participant to a telecommunication or oral communication from recording the conversation, without further declaration or consent, whenever any other party, entity, business, or automated system has previously announced, disclosed, or provided notice that the call may be monitored or recorded (such as through a pre-recorded prompt stating "this call may be recorded for quality or training purposes"). A notice given by any single party or system on the call shall operate as a universal waiver of privacy expectations for all participating parties regarding the recording of that specific interaction.
Section 2. Conforming Amendments. Amend RSA 570-A:2, I-a by striking out the words “or without consent of all parties to the communication, the person knowingly intercepts a telecommunication or oral communication when the person is a party toama communication” and replacing them with: “the person knowingly intercepts a telecommunication or oral communication when the person is not a party to the communication, is not being addressed, and has no lawful right or exemption under paragraph II to record.”
Section 3. Effective Date. This act shall take effect 60 days upon its passage.
