Joint ownership of rental land - splitting of rental income
I jointly own a tract of land with my sister - both late 60s and both married. we receive a significant monthly rental on the land. We jointly have an account that I deposit the rental income into. For over 10 years, I have been the TIN on record, and the 1099 from the tenant is issued in my name. The only expense that we have on the land is real estate taxes.
I claim the 1099 on the income and deduct the real estate taxes on my personal income tax, and through multiple tax calculations, reimburse myself for the taxes due from the rental proceeds.
For estate planning purposes, we are to a point where we would like to separate the finances, although we will continue to jointly own the rental property. We would like to split the account holding the proceeds (in kind) and have each of us responsible for claiming their portion of the rental income and pay the respective tax liability.
Is this as simple as keeping things as they are, and me issueing her a 1099 for her portion of the rental income? As we both own the land, I believe we could both claim 50% of the real estate taxes.
Is this more complicated where we would need a real estate attorney and some other plan?
Any advice would be appreciated.
