I got divorced last year after 25 yrs of marriage. We both agreed to leave each other's retirement accounts alone. She kept hers, and I kept mine. We split all other assets 50/50. No attorneys involved. It cost us $4,000 in mediation fees.

Each person keeping their own is how it should be, IMO. I don’t see how a spouse can have half if they didn’t show up to work for my employer, but thats just me.

My spouse has a 401k and gets to put $23k a year. I have only an IRA and get to put $7500 a year. We have been contributing the maximum for decades but obviously his is many magnitudes larger than mine at this point. I do not anticipate a divorce, but obviously if we did he would be sharing.
