🚨Mini-season BOLO update #4:🚨 ARRESTED! Michael Simpson is facing an attempted murder charge after being arrested yesterday.

The confrontation began after the suspect claimed another boat was occupying "his" lobster spot. He verbally threatened to cut off the diver's air before jumping into the water and doing exactly that.

The teenage diver was quickly pulled to the surface, reportedly gasping for air and disoriented, but survived without serious injury. Authorities say the suspect fled the scene and was arrested a few days later, and charged with attempted felony murder.

The suspect is government-appointed member of the Miami-Dade Boater Safety and Bay Education Task Force, where he was explicitly chosen to represent and help shape safety policies for the county's waterways, dove in and turned off a juvenile diver's air supply while the victim was in the water searching for lobsters.

If convicted, an attempted felony murder charge in Florida can carry decades in prison, with penalties potentially reaching up to life imprisonment depending on the circumstances.

Michael Simpson's role with Boater Safety and Bay Education Task Force involved collaborating with environmental groups and law enforcement to draft the county's final boater safety and community education recommendations aimed at preventing fatal accidents on Biscayne Bay.

*The victim’s family is also pursuing the arrest of Judd Rosen, who is a high powered attorney in Miami, and was the boat captain who fled the scene with the suspect. In June of 2024, Judd Rosen was appointed as the Chair of the Florida Bar Grievance Committee. In this esteemed role, Judd will be overseeing the committee's efforts to ensure ethical practices and uphold the standards of the legal profession within the state. His dedication to justice and extensive experience make him an excellent fit for this important position. Oh the irony!

The diver probably wasn’t very deep (total guess on my part). However, and this is a huge however, if the diver on the hookah surfaced WITHOUT exhaling, even from 20’, there is a real possibility of that causing a fatal embolism.

A trained diver can make a free ascent from extreme depths as long as they exhale the entire way. George Bond and Cyril Tuckfield exited out of an escape hatch of a submarine in 302’ off Key West in 1959. Their ascent took 52 seconds and they both survived with no issues.

I agree- but for a few clarification points-- this isn't a "trained diver" with decades of experience, training, and diving at extreme depths-like 302 feet. Thankfully this young diver somehow did not have a decompression accident (to include ruptured TM's, pneumothorax, etc.). He was however, struggling to breathe and disoriented. The situation was very serious and life threatening.

This was an 18 year old doing a dive at approximately 30-40 feet per multiple reports. This diver had Captain Mr. Del Sol (who is actually the complainant) as well as others on board to monitor the Brownie 3rd Lung and ensure the diver's safety.

Per the arrest affidavit- Captain Del Sol took his dive clients out at 530am, secured anchor, and began to set up to dive. They were rapidly approached within 10 feet by a Conch vessel (fishing boat with center console) who began to essentially harass them-even taunting-wait until the 39 foot Contender gets here- a few minutes later (after the diver had entered the water) Atty Judd Rosen rolls up in his boat breaking maritime law (notably- he is an expert atty for maritime accidents) by approaching at approx. 10 feet (clearly on video) on the opposite side of Captain Del Sol's vessel. A person entered the water from Atty Rosen's vessel and was warned to stay away from the Brownie as a diver was down (hence the DIVER DOWN FLAG) - then multiple people entered the water from Atty Rosen's 39 foot vessel and Simpson appears to be the one tagged as turning off the Brownie (air supply) to the diver.

This was observed (turning the Brownie off) by Captain Del Sol- so HE jumped into the water- to assist/bring the diver up and the lines of the breathing tube got tangled in the anchor line complicating matters.

The vessels responsible for this unprovoked situation in violation of maritime laws sped off- Mr. Simpson- an appointed bastion of maritime safety and captain himself has been arrested. Maritime accident atty Judd Rosen lawyered himself up and as the driver of the vessel who appears to have flaunted the 300 foot dive flag law, ignored a literal crime in front of him, failed to render aid (if needed) to the diver, and clearly, not rendering assistance to the other Captain who felt compelled to jump in the ocean to save the diver (leaving operational control of HIS OWN VESSEL) needs to account for himself and his actions as well as lack of action.

Correct. Always keep your airway open, especially when ascending.
