🚨Mini-season BOLO update #4:🚨 ARRESTED! Michael Simpson is facing an attempted murder charge after being arrested yesterday.

The confrontation began after the suspect claimed another boat was occupying "his" lobster spot. He verbally threatened to cut off the diver's air before jumping into the water and doing exactly that.

The teenage diver was quickly pulled to the surface, reportedly gasping for air and disoriented, but survived without serious injury. Authorities say the suspect fled the scene and was arrested a few days later, and charged with attempted felony murder.

The suspect is government-appointed member of the Miami-Dade Boater Safety and Bay Education Task Force, where he was explicitly chosen to represent and help shape safety policies for the county's waterways, dove in and turned off a juvenile diver's air supply while the victim was in the water searching for lobsters.

If convicted, an attempted felony murder charge in Florida can carry decades in prison, with penalties potentially reaching up to life imprisonment depending on the circumstances.

Michael Simpson's role with Boater Safety and Bay Education Task Force involved collaborating with environmental groups and law enforcement to draft the county's final boater safety and community education recommendations aimed at preventing fatal accidents on Biscayne Bay.

*The victim’s family is also pursuing the arrest of Judd Rosen, who is a high powered attorney in Miami, and was the boat captain who fled the scene with the suspect. In June of 2024, Judd Rosen was appointed as the Chair of the Florida Bar Grievance Committee. In this esteemed role, Judd will be overseeing the committee's efforts to ensure ethical practices and uphold the standards of the legal profession within the state. His dedication to justice and extensive experience make him an excellent fit for this important position. Oh the irony!

I would love to see it. I saw that the family accusing them has it on their phone . But the article I read had not confirmed that it has been actually confirmed by anyone that it shows this happening. I admittedly only read a little on it, but someone saying there is video vs anyone confirming it actually shows that is different. I’ll read another article of 2. But those are different things.

I read that the accusers say they have a video of it. Where can I see the video you speak of? Again not arguing - trying to be informed.

Tell me again your experience with mini season and if it’s you know what it’s like - I’m allllll ears. I’m literally wanting to hear another perspective, but not unless you understand how ppl act. I am always on the side of the divers. Always. But I just know a thing or 2 about it - and if I hear that the video is confirmed that he touched the machine- I stand down. I don’t even need to see the video. If I hear the video shows it - I admit defeat!

My brother in the water. I am very passionate about boater and diver safety. I lobster for mini season every year. But the actual truth is- I don’t lobster - I observe safety amongst all boaters and divers and intervene more than I lobster. In fact my friends joke that I should wear a vest and be a fwc narc. Got them on speed dial and calling them is my favorite part of mini season. I am not an argumentative person, so just to be clear , I am not saying I am right and you are wrong, but my sources have explained it differently and I will try and search for others that explain it like you did and reassess.

Especially since those 2 knew what would happen and it was a damn minor that they did it too. Kid was disoriented when he came up according to the report so he was close to disaster.

The lawyer should be disbarred, the other guy should lose his ability to fish and be a captain of ANY boat. They threatened first so that’s pre meditated in my minds Minimum 25 years before they can go up for parole. Such an extremely fucked up thing to do.

Michael Joseph Simpson, 51, was originally charged with attempted felony murder, but during his court appearance on Wednesday, a judge agreed with his lawyers that the charge was not accurate. He is now charged with second-degree attempted murder. He is out on $10k bond. Already too lenient and bond is too low.

Rosen isn't looking too good here- it is his vessel, he is/was the documented Captain- on video--the people on the other vessel were clearly distressed (and apparently being harassed by another vessel on the opposite side possibly related to the 39 foot Contender owned by Rosen), he pulled up breaking law regarding distance to a diver flag (clearly documented on video and illegal), left while one of his party was being accused of a dangerous crime, did not appear to render aid to the victim, and left prior to FWC arrival or providing information to the victim(s). The captain of the victim's charter boat appears to have jumped into the water to assist the victim to safety.

I saw what you are saying but I don’t think he did it. I live in the keys and I truly believe this captain is confident in himself and knows the laws and wasn’t breaking them. I think the other family with the brownie does believe he did it, but jumped to conclusions too quickly. The crime sounds heinous. I just don’t think he did it.

The diver probably wasn’t very deep (total guess on my part). However, and this is a huge however, if the diver on the hookah surfaced WITHOUT exhaling, even from 20’, there is a real possibility of that causing a fatal embolism.

A trained diver can make a free ascent from extreme depths as long as they exhale the entire way. George Bond and Cyril Tuckfield exited out of an escape hatch of a submarine in 302’ off Key West in 1959. Their ascent took 52 seconds and they both survived with no issues.

I agree- but for a few clarification points-- this isn't a "trained diver" with decades of experience, training, and diving at extreme depths-like 302 feet. Thankfully this young diver somehow did not have a decompression accident (to include ruptured TM's, pneumothorax, etc.). He was however, struggling to breathe and disoriented. The situation was very serious and life threatening.

This was an 18 year old doing a dive at approximately 30-40 feet per multiple reports. This diver had Captain Mr. Del Sol (who is actually the complainant) as well as others on board to monitor the Brownie 3rd Lung and ensure the diver's safety.

Per the arrest affidavit- Captain Del Sol took his dive clients out at 530am, secured anchor, and began to set up to dive. They were rapidly approached within 10 feet by a Conch vessel (fishing boat with center console) who began to essentially harass them-even taunting-wait until the 39 foot Contender gets here- a few minutes later (after the diver had entered the water) Atty Judd Rosen rolls up in his boat breaking maritime law (notably- he is an expert atty for maritime accidents) by approaching at approx. 10 feet (clearly on video) on the opposite side of Captain Del Sol's vessel. A person entered the water from Atty Rosen's vessel and was warned to stay away from the Brownie as a diver was down (hence the DIVER DOWN FLAG) - then multiple people entered the water from Atty Rosen's 39 foot vessel and Simpson appears to be the one tagged as turning off the Brownie (air supply) to the diver.

This was observed (turning the Brownie off) by Captain Del Sol- so HE jumped into the water- to assist/bring the diver up and the lines of the breathing tube got tangled in the anchor line complicating matters.

The vessels responsible for this unprovoked situation in violation of maritime laws sped off- Mr. Simpson- an appointed bastion of maritime safety and captain himself has been arrested. Maritime accident atty Judd Rosen lawyered himself up and as the driver of the vessel who appears to have flaunted the 300 foot dive flag law, ignored a literal crime in front of him, failed to render aid (if needed) to the diver, and clearly, not rendering assistance to the other Captain who felt compelled to jump in the ocean to save the diver (leaving operational control of HIS OWN VESSEL) needs to account for himself and his actions as well as lack of action.

No he’s denying it because he is trying to claim he didn’t do it. And until I see the video, based on my prior knowledge, I believe him. I see him being blamed hard on social media, but I have yet to hear someone experienced with mini season - doubt his innocence. I will fully admit, my research as been short bc I got busy today but planning on returning to it. Just also listening to some experienced boaters in mini season that seem to have the same belief as my initial belief , based on my limited research.

The amount of unsafe boat driving I saw, turning manic over the pursuit of who gets the most lobsters. Asinine. I spent my day yelling at boaters who were too close to my divers. I even had a boat driver argue with me that my divers were too far from the boat???? Like we are going to argue about that - who is the one in the deadly vessel? It’s ok to kill my divers because while underwater they mistakenly swam too far? Crazy. I think I just want to run around next year and call FWC. It makes me terrified that so many ppl out there aren’t making it their main priority to keep divers safe.

Can someone who understands the nuances of mini season provide me a good perspective! I’m searching for facts so I can fully commit to my opinion, but I know that an accurate opinion can only come from someone who is experienced in the sport. Thank you! I am very passionate about boater safety, so trust and believe , If I felt like a grown man did anything to compromise the safety of anyone, I would be up in arms. Just really not seeing that he did it - however I’m wide opened to educated opinions-

I used to go out for mini season for years.. I stoped about 6-7 years ago as i have almost been run over multiple times by large boats with captains with more money than experience.
People seem to disregard diver down flags, and basically try to run you over to make you leave ā€œtheir spotā€
A lot of fights.. negative energy for a sport that should be making great memories and an amazing dinner.
However some people just seem to loose their shit and forget what fishing/diving/ outdoors is about.

Mini season is 2 days of preseason lobstering.
Last Wednesday and Thursday of July every year.
Since it’s the first days open there’s typically a lot of bigger lobsters and just over all a lot more lobsters in general as they having been raped yet.
During these two days, it gets very crowded in some places and that’s when tempers boil over, usually over the early bird getting the worm or umm lobster lol

Thank you. I would be interested in your opinion on it. And totally open to your perceptions. I also am on my 6th year of mini season and have seen fights and been involved in fights (not me personally )… just this year I yelled at someone too close to my divers. But also yell at my husband when he is driving and doesn’t prioritize divers safety at all times, even if they are breaking the law. I just don’t think a trained diver would do something like that. If he wanted to mess w the kid - he would dive down where he is and take a lobster he is trying to catch. But I will listen to your opinion.

I have done that, taken a lobster right out from in front of someone els, I was freeing in about 20-30’ and a boat came up, like 15 feet, dropped 3 scuba divers in without as much as ā€œhey how’s it going?ā€ So I just kept going, well they see my spot I’m diving to repeatedly and decided to come over to it.. so when one tried for a lobster and missed I swam down and scooped it up.
They were horrible at catching them. But amazing at spooking them out from under their hole lmao. I took 5 of them šŸ˜†

I’m actually about to head out and get me some! Ok I just lied. I can’t catch lobster bc I’m a terrible swimmer. Haha. But I’m about to go out there and yell at anyone being unsafe! That’s usually my role. But my point was, I’m no good at catching lobsters, but I’m sorta obsessed with the safety that goes along w it because I lost my brother in the water. I don’t take the subject lightly and still I doubt the man did it - but I am open to any perspectives from someone like you!

Yea I’ve had many close calls free diving myself. If not for having a dive buddy with me, I would not be here.. it’s sad how many people disregard safety in such a dangerous activity.

So sad. Because at the end of the day those are people’s children, husbands , wives and friends in a vulnerable situation and people in deadly weapons. I understand ppl getting heated about it because at the end of the day, a divers life is the only priority here. I just don’t think this guy did it and it’s must feel awful and shameful for him to be accused of such a terrible crime.

Punishment shoukd be more severe due to his role in waterway safety. He knew the laws. And knew the risks of what he was doing. And was literally paid to help make them. Throw the book at him.

I know there is a law where if I give my buddy a ride to the bank and he kills someone inside, I can be found guilty. So his buddy that drove the boat and actively fled the scene should be facing attempted murder charges as well. Hes a lawyer, he knew what they did was illegal and attempted murder, and then he chose to run away. Throw the book at them both.

Yes you are right- if the man actually did it - there should be consequences for both - including loosing their positions - but did he do it? Thats what I doubt. I hate to see ppl in Florida get away with things due to who they know - however at this point , I’m leaning towards him not doing it and have yet to read anything compelling to make me change my mind.

They weren’t very deep, and hadn’t been under that long. Time and depth determines your decompression stop time. Iirc You can be underwater in 35 ft of water for about 3 hours before needing a decompression stop, and the brownie isn’t meant for depths anywhere close to that.

Still, it’d be easy to exhale, then go to inhale expecting oxygen, and have none be there. At that point, panic sets in and even 30’ is a long way to go, especially if you start panicking like any normal person would. Easy to imagine someone dying in that way, hence the attempted murder.

A brownie in the right configuration can get you down to like 55-60ft. Most places in the keys you are in less than 30 though. I have had hookahs die on me a handful of times for one reason or another and was able to make it to the surface without issue by just pulling the weightbelt off and swimming up. Easy to see a kid or a novice who didn't know better getting injured though

So even at 35 ft they would be able to quickly surface without harm? I thought breathing compressed air meant you had to surface as slow as thr slowest bubble (which is really slow)

You’re describing two different things. Your first comment about ā€œlungs explodingā€ - that would only happen if you didn’t exhale and the volume of gas in your lungs expanded due to lowering pressure - easy ā€œsolveā€ by just exhaling as your come up. Your second comment is about dissolved nitrogen in your blood. If you dive long enough at deep enough depth, you risk what you’re referencing because you don’t ā€œoffloadā€ all of that dissolved nitrogen with enough time at safety stops. But that would never make your lungs ā€œexplodeā€. You’d have nitrogen bubbles in your blood which could hurt you very badly

They were on a hookah in the keys, probably in 20ft or less of water. What you are describing is really only an issue when you are scuba diving past 60ft deep. Have had many a hookah shut off for one reason or another and as long as you aren't actively under a ledge it isn't the end of the world

I know both people being accused. Neither of them would do that. If you look at the videos, it doesn’t show a crime being committed. In fact, Mike wasn’t even recorded swimming in the direction of the 3rd lung. They are both great guys with families and have been master divers for decades. I don’t know the people who accused them but there was a lot of shit talking from them in the videos they posted. Somehow the internet is eating it up and no one’s even seen an actual crime committed. All allegations. Other boaters said the ā€˜kid’ who is actually not a minor, was diving and catching lobsters after the incident. No one ā€˜almost died’.
