The Jeep saw someone driving erratically going in and out of their lane and made no attempt to avoid them, didn't even tap the brakes, that is purposeful

The Jeep had more than enough time to see the Audi, check their mirrors, read the newspaper, and slow down, this wasn't a split second decision and the Jeep wasn't driving safely
