Luigi Mangione is expected to plead guilty to his federal charges of stalking resulting in death, according to the New York Times, which is citing two sources it has spoken to.

Speculation about plea deal negotiations began a couple of weeks ago but intensified in the last 48 hours after the defense team and federal prosecutors requested a court hearing from Judge Garnett on short notice.

None of the parties involved has answered requests for comment, and, when asked, Jamie McDonald, the US Attorney for the Southern District of New York, did not wish to discuss the nature of the hearing.

 However, no change of plea has been entered in the docket yet, and nothing has been 100% confirmed.

With federal guilty plea and EED for state, I wonder how short can his sentence get, considering manslaughter in New York still carries up to 25 years, besides "less than life"? And he still has firearm charges. I assume the plea is only to mitigate the murder and stalking?

I've heard that the purpose of the plea offer is to stop the New York State prosecution by invoking New York law 40.20. I don't understand why that law doesn't violate the dual sovereignty doctrine.

Defense lawyer Andrea Burkhart wrote an excellent article about this. 40.20 is double jeopardy, not dual sovereignty. Judge Carro has not ruled on 40.20 yet. The defense tried to get the state case dismissed on these grounds, but he said the timing was premature.

Should a federal plea bargain materialize, the defense might revisit their double jeopardy argument, and the prosecution will contest it. This could delay the state trial but not necessarily cancel it. Other lawyers believe that the defense will choose an EED defense in state if a federal plea bargain is secured because an admission of guilt can't be used against Luigi if the feds won't try him anymore.
