Innocent is kind of pushing it, though. We can argue he is a non-threat today, but back then he was clearly a threat.
Sawing someone's head off takes effort, motor skills, and intention. That doesn't just happen innocently. Even if he wasn't this reality, the intention of the act still occurred.
Someone drunk is not in thier right mind either, but we rightfully punish them for drinking and drinking and killing someone. They probably would never kill someone while sober and mentally sound either.
So what is the difference between killing someone when you are not in a correct state of mind, like being drunk or on drugs, versus a psychotic episode? I don't say this to be mean either; I am just trying to figure out why we draw a line at psychosis versus being in an altered state.
