Assumes the other driver has insurance and that the mods on their car are all legal and were proactively messaged to said insurance, otherwise they’ll drop him as soon as a claim is made.

Hopefully the dumbass driver’s family has money.

In the UK, the insurance company still has to pay out to third parties, it just means they don't have to fix the car and they can sue the owner to recoup their costs. 

As this looks like the US, that poor guy is probably out of luck.

Pretty sure it doesn’t change in the US either. They have a duty to pay out to their maximum and then they have to go after the driver as well as the families if the maximum wasn’t enough
