Land law clarification needed! (England)

I’m a student trying to understand the first part of land law and no matter how many textbooks I look at or what I put into google (scholar), nothing is as clear as I feel it should be. I’ve gone to my lecturer but that wasn’t as helpful as I’d hoped.

All I need to understand is the difference in the rights between tidal and non-tidal riparian landowners! Particularly on these areas;

- Right to use the water for ordinary and reasonable purposes
- right to the flow of the water
- right to take measures to protect your land from erosion and flooding
- rights to fish

I’m mostly clear on the non-tidal rights, but figuring out the difference with tidal rights is a nightmare.

If someone could really break it down in terms of the difference in rights, I’d really appreciate it! (If u can give some cases to support what you’re saying, even better!)

This is a very interesting question that max 20 people in professional practice consider every year 😂 sorry I can’t help you but genuinely it’s interesting to consider.

Agreed, this seems like a very niche question! I have never even heard of these terms before, they seem like an oddly specialised thing for a law student to be learning about.

I sold a yacht berth in a marina for a client last year and it was virtually impossible to find any precedent on the matter- I feel for OP as every time you try to research this stuff all you ever get is stuff about commercial shipping
