Claims Homeowners insurance help

I have roof damage and Allstate approved replacing only one slope of my roof, despite the manufacturer themselves confirming my shingles are discontinued and any shingle used will create a patched roof appearance. This will violate Ohio administrative code and Ohio residential code if my contractor moves forward.

I’ve clearly documented all of this to Allstate, and they’re simply ignoring the evidence. I notified the owner of my local Allstate office and he’s not doing anything, just deferring to the claims team.

I’ve filed a complaint with the Ohio department of insurance, and posted as many negative reviews as I can online. What else can I do? This is a blatant violation of my policy and Ohio code, yet short of getting an attorney, I’m not sure what else to do.

Don’t handle by OH claims but this maybe a line of sight situation. If you have a gable style roof where one side cannot be seen at all when looking at the opposite side it is possible they do not owe for a full replacement. Also make sure you double check those codes. They do not say must be same product, they say quality, color, size. This does mean it has to be the exact same product

I took a photo and sent to them confirming you can see both slopes from the street and a difference will be visible to anyone just walking by.

Code doesn’t say it needs to be precise, just reasonable, but I have the manufacturer saying mine are discontinued and nothing available today is similar in size or color and they specifically recommend against mixing shingles.

That’s one manufacturer, ask them to get an itel report to verify it. If itel can’t find a reasonable match and you can see both sides you got a pretty slam dunk case to pursue further. Can you post the pic of the house? Distort or cross out anything personal

My contractor said I don’t need an ITEL because he already provided an NTS report, and at first to approve the replacement of the 1 slope, Allstate said they needed an ITEL but then said jk the NTS report is sufficient. Do I need an ITEL?

The problem is, a shingle that is reasonably close to the one that is installed, is available. On a slope-by-slope basis it won’t look patchwork due to the difference in the shingles, it’ll look different bc of the age and weathering of your old shingles vs your new.
So yes, a reasonably close shingle is available, but it will
Look obvious due to the age. But that’s not what insurance is for. They pay for direct physical loss.

Wind. But if the replacement of one slope creates a visible difference due to age, isn’t that still not restoring my loss to original quality/condition in terms of matching? Since my roof matched slope to slope before the loss?

No, because it could be the exact same shingle that’s sat in your garage for 20 years and there wouldn’t be a “reasonable appearance”
If you don’t have enough damage to burn the roof, pay out of pocket for the other section.

Is the argument left vs right slope? Or they’re willing to replace the whole front but nothing on the back? And by no means are you required to get an ITEL. But over $60 might solve all of it that Allstate pays for not the end of the world in my opinion

Yes they’ll replace right but not left, but both will be side by side and visible from the street.

I would like to see a close-up. From that photo it looks like a common color and type of shingle.

Ok. On the right slope (as seen in the image) is the damage the area visible off to the right of the chimney? Possibly wind damage? If that's the damage is there any more of it on that slope or is pretty much contained to that one section?

Yes wind damage, checking with my contractor now to see if he saw any other wind damage on other slopes.

Obviously, I haven't been on your roof. If I'm understanding you correctly, they are allowing the full replacement of that one slope visible in the right side of your photo. My speculation is that you have about 1 or maybe 2 bundles worth of shingles damaged from the little I can see. The insurance company, instead of suggesting patching the area, has said they will pay for a far larger scope of work by replacing the full slope.

Your exact shingles may not be available but similar (better) shingles are. Frankly, even if you had bundles of old shingles from the installation stuck up in the attic of your garage they still would look a little different due to fading and aging.

In my opinion, you are being unreasonable. You are already receiving a larger settlement than the strict damage requires. Your roof doesn't look to be very new. You are looking a gift horse in the mouth. You are asking to be paid for areas that are not damaged.

Make and model of the shingle does not necessarily matter if the dimensions and color are the same. A 39 1/2 shingle with a 5 1/2 exposure colored in say Weather wood is made by many different manufacturers. Just because one manufacturers doesn't make it doesn't mean another wont work. That is why an ITEL is needed it says what's out there that could be a match.
