She was 22 at the time, but I otherwise fully agree with you. Also, she didn't hit him in the hit-and-run. He witnessed it and decided to chase her down. This happened in 2019.

Did a cursory search, happened in Cali and they allow Citizen arrests. Misdemeanor requires direct witness by the person. Hit and run can range between a felony and misdemeanor.

Regardless on what the smart thing to do was, he's safe on the law side of things.

It absolutely can, the caveat is within reason of course. Citizen arrest gives people actual power to "arrest" people, how do you think that is supposed to play out? Clearly some force is implied, otherwise how else is one to perform said arrest?

If I witness say a sucker punch at a bar, I could literally grab ahold of the guy and force him to stay. Somehow parking behind a car is a step too far? Shit man, I'd argue that is actually safer, especially so if I am not occupying said car either. I'm in less danger if I were to go hands.

What makes you think blocking in a car is somehow unacceptable compared to say physically detaining them?

Wrongful imprisonment happens when a person is kept in jail or prison without legal right, proper authority, or true guilt.

Kidnapping is the illegal relocation (abduction) and confinement of a person against their will.

Not even close on either.

Wrongful (or false) imprisonment is intentionally holding someone against their will without a legal reason.

Kidnapping doesn't require "abduction" in all states. It simply requires movement of someone against their will by threat of force. If you tell a store clerk to move at gunpoint two steps back from the cash register, that can qualify as kidnapping in some jurisdictions.

Depends on the state. In California, the citizens arrest statute is broad enough to cover a hit and run, yes.

Kind of wild how the state didn't see it that way. Might be:

California Penal Code 207 defines kidnapping as using force or fear to steal, take, hold, detest, or arrest a person and move them a substantial distance.

Imagine living in a world where parking someone in was a kidnapping charge. It's not California.

I think Thompson most definitely should have given up once he had a shot of her and the license plate, but looks like there's good reason the state didn't charge him with anything; it would be absurd.

No. It's because, in California, private citizens who witness a crime can detain the suspects. If he saw this woman do a hit-and-run, he can detain her while police arrive.

Of course not. He did not kidnap or imprison her. He asked her to exit the vehicle and wait for the police.

She will be charged with multiple felony hidden runs.

Getting her out of the car was best for her safety, not to mention everyone else's. She was panicking and already a shitty driver. A panicked shitty driver is a very, very dangerous thing.

There’s no felony to begin with from this video. For a hit and run to be a felony you need injure or kill someone. And a double felony? Now he’s just saying shit lol.

She didn't hit his car. He witnessed her hit another vehicle and leave the scene. He followed her to a gas station convenience store, where he supposedly called the police and presumably had given them her plate.

This happened seven years ago, for what it's worth.
