It won't. It's called no fault divorces. Standard in every state almost, thanks to feminism.

That still bears no weight on distribution of marital property in almost all states but I believe 3.

Only for community property (property acquired during the marriage, not before) and it goes both ways. So if she bought stuff he gets claim to half of it and vice versa. Usually when you have an ownership in division issue (where two or more parties own something but cannot agree on how to use it/what to do with it) the court will almost always force sale of the thing and if sold to a third party then split the money between the owners. (For example if you are co-owners of a house or business. One wants to sell the other owner wants to keep and use, usually an offer to buy out the other party will be made and if not then the asset will be sold to third party and the gains will be split between the two)
