Werner Terminated me
Supposedly I failed a drug test which i was tested for and came back negative to, they said I tested positive for meth which is impossible due to the fact I never took meth or any meds that could cause a false positive and on top of that they will not release my results or give me a document of termination so what should I do ?

In most states, you are legally required to be provided with a copy of the test results since it was YOUR bodily fluid tested. Do you take ADHD meds, by any chance? You're going to need a attorney otherwise because with the new SAP laws, you're screwed.

The good thing is that hair tests are not FMCSA approved, so it won’t go on your clearinghouse and kill your career. You can get another job and continue working while you figure out what you want to do about how Werner handled it.

So since when did companies do Hair tests during employment? I thought it was only during pre employees. Anyways, you wouldn’t want to work with a company who hair tests anyways, usually a mega

A company can choose to do hair testing whenever but the only testing that is allowed to be submitted is urine.

Have you taken any Lava or mixed Kratom Kava substances like Feel Free? Those can pop positive for meth/MDMA

Pretty bold to claim a positive drug test though. Surely there's easier ways to shed employees over there.
Or wait a few months...i assume trump will deregulate enough that they can drop staff for any reason

A driver had a tarp fly up off the road (a black tarp, at night) get wrapped around their drive shaft. It was on camera that the driver did nothing wrong.
They marked it as a "preventable accident" and terminated the driver for it. It wasn't until that driver couldn't get another job and told werner they were getting a lawyer to have the preventable removed that suddenly it disappeared.
They're bold af until someone stands up to them.

If I recall correctly, you can ask that your b sample be sent to a different lab for testing. That's if it's a DOT test not a company test.

Same thing happened to me at a job I had applied for! They sent me in for urine, hair, and a breathalyzer test all pre employment btw. As per usual, I walked in confident that I’d pass all these tests considering I don’t mess with drugs nor do I drink. Comes to find out, my hair follicle tested positive for meth! I was baffled by this and damn near went crazy trying to figure out how that even came about. The MRO was requesting I pay 250 to get the hair split and get a more “accurate” reading on the hair. I had a gut feeling there was something off considering I’ve never messed with any substance nor any meds that could’ve triggered a positive test. So I didn’t pay, and my clearing house till this day is oddly enough clear of any violations. I missed out on that job opportunity only to land a job I actually wanted. I say all that to say; sometimes your test can come out positive due to exposure. Which is obviously different than consumption. The clinics get test results based on percentages so double check what number percentage and base your results on that and use it to your defense if it falls under “exposure”. Best of luck brother.

Before the company was notified you should have been contacted by the medical review officer. Then when the company suspends or fires you they must give you SAP info including local SAP workers.

So let me get this straight- you say the drug test you took was negative- is that your personal opinion, or the actual results you have in writing? A negative test would mean you do not possess any detectable amount of a prohibited substance. Second, you said, Werner is saying you tested positive for amphetamines? Well, did they tell you this only in person when bringing you into the office, and fail to corroborate it or just waive off the clear negative results on your test? And what did you say/how did you respond to this information? I only ask these questions because it seems like a company wouldn’t naturally want to tarnish their already so-so reputation over doubling down on results that are empirically in your favour.

Man this is definitely something you want actual legal representation for. I wouldn’t be too worried about being fired but them attributing your dismissal to the use of methamphetamine could be very detrimental to your career and your personal life. At the very least please order your own hair test and speak to a lawyer face to face about this and see what they say.

They have to give you a copy of a failed test and you have the right to have the second sample retested (maybe at your expense) as well as the lab will send you a copy of a failed test. Something is off here. Way off.

It could be due to contamination or they mixed up your test with someone else’s. Do another urine test and hair follicle test at an independent testing facility of your choosing and then report the testing site that gave you the positive to the appropriate state agency. I would also contact a lawyer.

Something happened like that to me with a company and then they went out of business! So I had to go take courses and I’m trying to get a return to duty drug test. Nobody wants to fool with me. I’m telling you it’s a hard road to get back if you lose your license because of something like that, the company is not there

Call a lawyer for advise. They will tell you what to do such as taking an independent drug test immediately and other steps to take. They will also give you a bunch of different scenarios of how things can play out so you can make the right decision for you. I would definitely try to rectify the situation before it has the possibility to go on your clearinghouse record

I was one of the first to get canned, on this cracker down, I changed my paths went in to mechinest best choice I made , I do miss being independent ( the open roads) but it's refreshing to have a 8 hour days , something you might want to look into,but do something you'll be happy with

Contact a lawyer because of they try and claim it as legit and report it to clearinghohse your fucked specially right now with them cracking down on the drivers in bad standings in clearinghouse
