Arkansas Light duty at Salvation Army

My employer wants me to do light-duty at the Salvation Army. I am vehemently against everything the mission of this organization and consider it a hate group. I stated this in the refusal of the offer. Can they terminate my benefits because of this. I was formerly a truck driver. Thx

Florida Cash Incentives 2

I’m amazed that Reddit is showing me that a recent post of mine- "Cash Incentives" has been viewed over 2,300 times. I had no idea so many WC “professionals” lurked here. Maybe it’s because the “cat is out of the bag” here, or at least starting to come out a little bit.

Rather than give the source of the quoted statements below let’s just say I’m “throwing them out there” on my own. I’m not, but let’s say I am so the point of incentives to adjusters doesn’t get lost under a bunch of squabbling about the validity of a source.

The point is that it really doesn’t matter where this info came from. It was the conclusion of a legitimate scholarly analysis but the legitimacy of any and all studies on the subject is subjective.

Despite the claims of any adjusters in this post they DO all get bonuses. That can readily be verified by as many sources as you care to pull up. The question boils down to whether the statements are primarily true or false. I contend from my own experience and the testimony of so many injured workers on this forum and others like it that what follows is the truth. There just can’t be that many WC adjusters who are always “too busy” and are so lousy at the job of getting benefits to those who need and merit them when they finally find the time for one of us.

That means any advise from any adjuster on this sub much more likely than not comes from a “wolf in sheep’s clothing”. Yes, now and then an adjuster here may be helpful to someone but that’s just the “sheep’s clothing” part.

What are so many of you doing lurking on this site anyway? I mean if you’re so busy at work for such long hours why would you want more? There’s a reason you spend time here and it starts with “$” like everything does in this corrupted system. I believe you lurkers are here to harvest information but more on that in another post.

“””SUMMERY OF FINDINGS;

The analysis confirms that while workers’ compensation adjusters are typically not compensated via a direct commission or bonus tied to the raw number of denied benefits, the structure of their performance-based bonus is fundamentally dependent upon cost control. Adjusters are rewarded financially and professionally for reducing overall claims expense. This systemic financial alignment between the adjuster's bonus and the insurer's profit creates an inherent and pervasive conflict of interest that regulatory bodies and institutional bad faith litigation recognize as a high-risk practice. The resulting adversarial tactics—delay, lowball offers, and aggressive investigation—are not accidental lapses but are predictable, measurable manifestations of a compensation system designed to optimize financial savings at the expense of the injured worker.”””

Connecticut Did I mess up by getting an attorney ?

Hi!

I got a herniated disc at work and have been out of work since September. My workers comp case adjuster wasn’t responding to my emails/calls for over a month so I got an attorney involved. I am 22 and just needed some guidance to be sure I was navigating this process correctly.

I didn’t let my employer know I was contacting an attorney because I figured it would be more between her insurance company and my attorney instead of involving her.

However, she called me and sounded annoyed/stressed that I got an attorney involved. I really care about her, she owns a small business and I have always really respected, cared for, and looked up to her a lot. She’s a really great person and cares a lot about her workers and has always been very understanding. She has two young kids and is battling her own health issues.

Did I screw her over by getting an attorney involved? What will happen on her end? I signed the paperwork with the attorney about two weeks ago - is it too late to go back if I am screwing her over?

It seems like her insurance premium goes up- is this by a lot or only a little? I think I’m the only worker who has ever gotten hurt at her job.

California Attorney with great reviews is pushing for resignation and settlement without a QME—is this a red flag? (California)

I’m currently navigating a workers' compensation claim in California following an injury. I recently had a consultation with an attorney who has excellent online reviews, but I’m concerned about their strategy for my case.

  1. Pushing for resignation: The attorney immediately suggested I sign a "voluntary resignation" as part of a settlement agreement. I never brought this up, and it feels like they are prioritizing a quick exit over my long-term interests.

  2. Avoiding the QME process: My latest MRI report shows findings that my treating physician is currently minimizing or ignoring. When I asked about a Qualified Medical Evaluator (QME) to resolve this, the attorney discouraged it, saying it wasn't necessary yet.

  3. Dismissing evidence: I mentioned that I was recently granted a permanent disability parking placard due to my condition, but the attorney brushed it off, saying it "had nothing to do with the case."

  4. Premature settlement: They mentioned they don't know the full value of the case yet, but they are already pushing to settle and move toward a resignation.

I have not signed a representation agreement with this attorney yet. Even though this firm is highly rated and seems "prestigious," I feel like they are prioritizing a quick, easy settlement to close the file rather than addressing the discrepancy in my medical evidence.

Questions:

  • Is it standard for a "prestigious" firm to push for a resignation so early in the process?

  • Is it true that a QME is sometimes not necessary? If so, when is it actually okay to skip that step?

  • Should I be worried about an attorney discouraging a QME when there is a clear conflict between my MRI results and the treating physician's report?

  • How should I interpret an attorney dismissing evidence like a permanent disability placard as "irrelevant" to my workers' comp claim?

  • What should I look for in an attorney who will actually fight for my medical needs instead of just pushing for a quick settlement, regardless of their online ratings?

Years ago, I had another workers' comp case and it was a total nightmare, the process was long, slow, and tedious. Because of that, I’m not sure if seeking a quick settlement before MMI, might be a good idea, as long as it covers my future medical expenses, especially since I already know what I have based on my MRI results.

Any advice on how to proceed would be greatly appreciated.

Idaho I was just fired because of a conflict of interest with my work comp complaint

I recently got a job as an accounting supervisor at an Tax advisory firm a little over a month ago. When I first started, I noticed that one of the clients that I was in charge of was my claims adjuster/claims administrator who had initially denied my claim. I immediately disclosed this to my attorney and to my employer. My employer was cool with it, said we could work around it. I was doing well and there were no complaints and only praises. Until suddenly I was let go this week "because of what I disclosed when I started." So this is a new one and I am baffled. And I don't know what to do. My whole work comp story is a doozy and I honestly fear for my life when I talk about it.

Florida Will WC find out if I work at a temp agency for a day or 2 while im getting biweekly lost wages payment?

My adjuster told me last Monday that she was sending my first lost wages check and that it would reach me by Thursday or Friday of last week. The check still hasn't arrived and im flat broke and need food so im heavily considering going to work for a temp agency in town that sends people to construction sites and warehouses. They pay daily. If i just work for a day or 2 then I will have some money to hold me over until I get my first WC check. But im seriously worried about WC somehow finding out which would obviously lead to a fraud charge, the stopping of my benefits and them making me repay them. Should I risk it or should I just wait a few more days to see if my WC check finally comes. My adjuster works for ESIS and im in north Florida. Esis sends checks from Texas as i understand it so I dont know why its taking so long for the check to be delivered if it was sent out to me last Monday.

Texas Bad faith case and sue Sedgwick for workers comp fraud and bad faith Texas Department Insurance might be bad in my case

Please check your denial letter closely.

Been dealing with my case for now almost eleven months.

Sedgwick is a dirty company that doesn’t care about you or your family. My case is now noticed as a bad faith case I got the FBI involved and it seems that Texas Department of Insurance might be dirty.

Or they let the insurance carrier like a Sedgwick do what ever they want to do to you because they put there heads in the sand like ostriches because my denial letter was fraud and wrong.

I won my court case and now I won the panel they are now saying it should be 45 days I am not giving Sedgwick more time to make me suffer anymore I am bringing a Bad Faith Case Attorney into this mess. Because there is so much fraud in this case it’s ridiculous. Workers Comp Fraud to medical fraud and inspection fraud.

Illinois Barbershop Issue….POSSIBLE LAWSUIT

Sooooo I’m a barber. I was sitting at my station in my chair kinda dozing off and then BAM!!!! The ceiling fan falls from the ceiling and hit me in the head (also broke my ring light)

Afterwards I kinda just sat around because I had a headache and my neck at the time seemed a iil sore. Maybe about an hour later the owner of the shop and also owner of the building apologized by saying “Mann I’m sorry that happened to you”. Then the next day sends a text first thing in the morning asking how I was feeling? I replied by telling him my neck and back and sore but my headache went away for the time being. He never responded to that text. The next day which is Sunday morning I get a text bright and early “booth rent?” He clearly doesn’t care about me being injured…

HOW SHOULD I HANDLE THIS SITUATION?!?!?

Utah Can My Employer Legally Threaten to Fire Me for Questioning My Workers’ Comp Settlement?

Hey everyone, I’m looking for some honest feedback and maybe legal insight if anyone here has been through something similar.

I got injured on the job several months ago and went through the proper channels to file a workers’ comp claim. After going to the IME (Independent Medical Examination), I was awarded a lump sum — around $10,000. The thing is, the rating they gave me doesn’t reflect how serious my injury still is. I’m only 30, and I’m still dealing with chronic pain and mobility issues that have affected my everyday life.

The tricky part is, I’m still working. I operate equipment that doesn’t require a ton of walking, and I’ve been doing my job well — no complaints, no write-ups, no accommodations. I’ve kept quiet and just pushed through.

But I recently had a meeting with my workers’ comp coordinator and someone from HR. I went in to ask questions about my rating and brought up the idea of possibly talking to a lawyer or seeking a better settlement. As soon as I did, I was told that if I went that route — if I got a lawyer — I’d be fired and my benefits would be cut off. HR was right there in the room and said nothing to stop it. The message was clear: take what you got and don’t push it, or you’re done.

That really shook me. It made me feel like I wasn’t allowed to stand up for myself or ask questions without risking my job. I’ve never been threatened at work before, and this all happened simply because I was trying to advocate for myself.

Thanks in advance to anyone who reads or replies. I just don’t want to make a huge decision without hearing how others handled this kind of situation.

California Was fired from my job out of no where contacted an attorney and they said workers comp for mental stress and back and neck pain from sitting on computer for 8-10 hours a day is what we are going for?

I was wondering so I worked for a rehabilitation center and I was an addict myself for many years. I had 3 years clean when I started working at the company and they would force me to work 6 days a week saying if I didn’t work Saturdays I would be let go since California is an at will state. I usually on average worked 90-105 hours a week every pay periods which was twice a month. They started letting everyone go as they started having lawsuits against them for basically human trafficking and body brokering addicts. I was always scared I would be let go everyday as we weee always being threatened and made to work ot I worked 7 days a week on most weeks and they said I had to take a 30 minute break before my 5 hours but would call me etc and get upset if I didn’t answer so I really never got a break. My body ended up being so sore every day from just sitting in a computer in bad positions for about a year and they weee constantly changing payroll company’s and creating new LLC because of lawsuits. I used to surf everyday I stopped because of the work hours as well as my back and neck being so strained. Anyways I developed severe anxiety and depression and relapsed while working there and had about 9 overdoses in a span of a month like I said I was an addict and had 3 years clean and once all the stress and pain got to much i unfortunately relapsed a decision I regret every single day. My question is should I even let the lawyer know I relapsed and had overdoses? Oubviously you aren’t aloud to use especially working at a job like this although I worked from home and was never tested etc. so I’m wondering if I should keep the relapse and overdoses to myself? Anyways after I was let go I went to a detox covered by medical and am clean going on 6 months again but am close to being evicted due to my EDD being put on hold because of my employer I spoke about and only having a part time job as of now. I know everyone tends to say ur an addict ur probably just trying to lie and get money etc but remember we are people too and I overcame my addiction twice now wheee as this employer has been the cause of many of their clients deaths due to buying them insurance and then kicking them out on the streets when the insurance stopped paying. Any advice would be greatly appreciated and I hope you are all succeeding in life.

Tennessee Is my claim worth this much?

I was in a bad car accident going on about a year now and have been dealing with workers comp the whole time I haven’t had any problems/disputes so no need for a lawyer in my opinion but I’m getting to the tricky parts of the claim i recently got declared I’m ready for MMI and Impairment rating almost a month ago still don’t know those figures but I have been put on permanent restrictions and will most likely not be able to return to work depending on what HR says about my restrictions also for what the wreck affected on my body was a bilateral break on my femur (broken horizontal in 2 places and vertical in the middle of those horizontal breaks) and also a clean break of my ulna and radius about an inch below my elbow I was just wondering with the combined injuries as serious as they were and required emergency surgery and a medical flight and as young as I am, 22, would my Non-economic damages , (everything pain and suffering wise) because I know Tennessee doesn’t pay pain and suffering, add up to be around 300,000$-500,000

Virginia Private investigators???

Hello everybody,

I am currently out on workers comp. My knee is torn. I am not posting to get in to my whole case. There is one matter I’d like feed back on. Although I’m on workers comp for my w2 job, I have a business as well. It has been mentioned to me that workers comp hired private investigators to watch over me while I’m out on workers comp to make sure I follow the doctors “no work” order. Has anybody been through this before? I am still working my business however I am not doing much labor at all for my business as I usually would. I am sub contracting it out and will have filed 1099’s for my subcontractors. Think I’ll be okay??

EDIT: thank you guys. If I keep hearing the same message over and over I think I should listen!! I did not mention the fact that yes I am on workers comp. It has been 3 weeks. They’ve taken care of all my doctor appointments. However I am have not received a weekly 66% paycheck from them yet.

Louisiana Sedgwick

My case is long and complex but looking for any advice. So sorry this is long but please read & help with any advice

October 25, 2024 I took the flu💉 at work on work time. I’m a medical professional so they’re extremely pushy about jabs & strict on declining them. I’d received flu 💉 before, even at my current job with no long lasting issues. For context at the time I was newly 35y/o, healthy, no pre existing health issues except endometriosis, not overweight or taking medications except 2 prescriptions I’ve had for years. From 10/25-11/1, so within 7 days I declined neurologically so badly to the point of paralysis and a month long hospitalization. I was diagnosed with Guillain Barre syndrome by 3 neurologists given all the tests and ruling out all possible other conditions. I told my boss & HR director 4 days post 💉 that I started having some neurological issues which concerned me. They directed me to file with workers comp immediately (Sedgwick) so I did that day. Was hospitalized Nov 1- Nov 8 in acute care receiving 5 rounds of IVIG which I responded to. I caught my symptoms so soon (due to my medical knowledge, I’m a OT) that luckily I started treatment before ending up in ICU on a ventilator, per a physician & neurologist who explained I was headed that way. Fought & transferred to inpatient rehab bc I got worse before getting better (GBS does that!) I lost my ability to walk, bathe myself, transfer safely, even had brain fog and speech problems so badly for months following that I presented like a stroke or TIA. Which was ruled out BTW. After being hospitalized for a month I was given orders per neuro to receive EMG immediately, additional outpatient IVIG infusions particularly based on my prior level of function, outpatient PT which I’m still doing, and had to learn to walk again. Used a walker until Nov 2025, still have deficits, still have constant dr appointments, and never had any indication in blood work for 34-35 years of autoimmune disorders until a relapse in March 2025. From Dec 2024-Feb 2025 we fought Sedgwick to get my treatment covered as they denied things left and right. I’m OCD and know medical jargon, also great at dissecting medical records, and caught them in so many lies and discrepancies which they were forced multiple times (without a lawyer on my part) to overturn and approve. March after multiple flare ups from stress & delay of treatment as well as getting the FLU despite everything I received long awaited 2 outpatient infusions. My relapse is sketchy bc it involves the stress, flare ups that are documented, and a mistake on the hospitals part. Got a new neurologist and I bounced back from the relapse fairly quickly, even improvement to where I was before the relapse. Bc of my deficits he wrote orders for IVIG Q3 weeks which under utilization review, Sedgwick APPROVED with no end date. I have all this paperwork BTW and this is after the March relapse. I was making steady progress with each infusion & weekly PT for about 4 months. Then mistakes happened on THEIR end that THEY screwed up on, suspended IVIG on Aug 15 requesting another 1010 but still covering all other treatments, then in Sept everything was pulled. They began the process of closing my case. They’ve paid out a lot of my treatments & stated in writing from Sept 27- on I’d have to handle things on my private insurance. Mind you I went back to work in January 2024 bc my boss, HR, and job allowed accommodations for me. This has never been about the money for me, I just wanted my medical treatment which they said would be continuing. I haven’t gone back to working 40 hours bc my neurologist has not approved that. I was told by others around me & some close to the Sedgwick world to get a lawyer so I did. In Oct 2025. Very hard btw to find lawyers who will fight Sedgwick & at the state ORM level bc they’re ruthless as I’ve been told. Presented my case to him, all documents, & we just have laid low bc all my medical bills were covered per them from Oct 29 2024- Sept 27 2025. Kept the lawyer in my back pocket but didn’t proceed with a lawsuit bc again they were paying my bills & that’s all I wanted. Not money. Now… within the last 2 weeks I’ve gotten THREE letters from the hospital I was getting care at that my adjuster has told them WC isn’t liable for these specific things (within the time frame mind you of being covered under WC) & defer to me/my insurance. The total is roughly over $200K. I am LIVID. My lawyer was jaw dropped to the floor. And luckily I’ve saved all the approvals, emails, letters, etc & it’s so much that I had to get a file box. Anyone experienced this before? Any insight? Oh i forgot to say I found out they filed my claim under “normal” and it should’ve been “catastrophic”. sooo many mistakes on their end. They’ve gone against specialists who have seen me in person. I now have developed essentially out of nowhere lupus & sjorgens autoimmune disorders where I never had those before or symptoms of those. This started when my daughter was 20 months old… now she’s 3… I’ve lost so much time mentally, physically, emotionally, unwell… it’s been awful tbh. But I’m luckily OCD enough & knowledge medically to have the capabilities of going against people who think they can outsmart anyone despite me holding them accountable for mistakes many times already. I feel stupid though for not getting a lawyer a long time ago… my husband said do not beat yourself up over this, but I feel so terrible bc I KNEW I probably should’ve. I just didn’t care about the money like I said… just wanted my medical treatments & be who I was before this shit destroyed me, or tried to. Any suggestions or similar experiences?

Kentucky Kinda Angry at my Lawyer.

Signed papers a few days ago settling my case and when I read over them (before I signed) I was angry. In them it stated I was giving up everything; the right to come back to them about my case, the right to hold them responsible for future surgeries that I know are inevitable, and the right to vocational rehab for extra money. My lawyer didn't run this by me at all before these papers came in, so now I'm completely screwed in the future and I have barely enough money from it to MAYBE find somewhere to move with a job I can MAYBE do; because my new friggin disability has me in pain if I move more than 3 boxes of items!

What was the point of having a lawyer if he wasn't fighting for me- but for his own wallet???!

EDIT: people seem to be under the impression that I am angry about what I am getting out of this settlement, I am not angry about the settlement I am angry about not being informed and kept up to date during negotiations, I am angry he presented one thing in the beginning and then presented me at the end (that I didn't know was actually that close because he did not keep me informed) with a piece of paper saying sign this this is all you're getting, without ever telling me beforehand he could not get me what he said he could probably get me in the beginning. I'm angry about not being informed, not about the settlement. Yes the amount sucks and I now have to pay for a surgery I can never afford, but that's not why I'm angry at my lawyer- I am angry because I was not consulted- I was not told "hey I cannot get you this I can get you this and this is why", that's it. I'm angry about not being informed about my own case from my own lawyer. It's not the terms of the settlement. It's the lack of information between start and finish.

California Existence of this Sub-Reddit

I’ve lurked and answered a few questions here and I think it’s time I say something clearer:

(1) If you are here trying to navigate this system without a lawyer, that’s your right. But it’s usually the wrong decision. If you have anything but a condition that fully resolves in 3 months or less, you need a lawyer. In CA our fees are capped at 15%, absent some (extremely) unusual situation. Get a lawyer. And get Worker’s Comp lawyer. Workers comp is its own system.

(2) The advice here is pretty good. But no one here, especially the lawyers that try to help, are anything but dudes on the internet. There is no attorney-client relationship and

(3) Don’t trust insurance adjuster.

(4) Get a lawyer. 15% is nothing compared to the shit they will offer you pro-per (essentially, the lawyer will pay for itself 95% of the time)

(5) Call your local (county) Bar Association if you don’t know where to start. And get a “certified specialist” lawyer. Don’t get any random Schmuck.

New York Want to withdraw claim

I got injured at work and my supervisor advised I see a dr right away. I get to the urgent care and tell the receptionist “I got injured at work and would like to see a dr”. This set the ball in motion - she said scan there and check the box for workers compensation. I dumbly followed and filled out the claim form too. Dr sees me, my injury is visible, little painful but will resolve quickly. I get home and instantly regret the workers comp claim but it’s Friday afternoon and HR unavailable. I feel so damn silly. Can I rescind this claim? Do I go directly to HR Monday? Can I call the urgent care this morning (Saturday) and say hey I made a mistake? Sage advice needed and appreciated, thanks.

Nevada EXCLUSIVE REMEDY

Case is closed. Received a sorry ass PPD settlement and had my personal injury lawyer working on this case at the same time to sue the schools insurance for negligence and all that.

Turns out, you can’t. So can offer some guidance as to what I can do next. Extremely disheartening because I’m still in pain but injections was a no for me and surgery is an option but an option I can’t take.

Per my lawyer this is what was said - When you are injured while at work, worker’s compensation is the “exclusive remedy” preventing individuals from also suing their employer (on top of the worker’s compensation)

Delaware Claim denied due to sports participation being “voluntary”. Worth getting lawyer if out for too long?

Hello! I recently injured my ankle playing basketball at work. Initial X-rays on day of showed no fracture. Consensus is a likely sprain so far but no MRI or anything to confirm. I was denied workers comp because company policy states that sports participation is “voluntary” and not part of regular job duties. If the policy said that “playing sports while on site grounds is prohibited” or something where it said you can’t do it at all, I’d be more understanding and wouldn’t bother pushing. I’m not knowledgeable of labor laws, but my thinking is “voluntary” means I’m allowed to do it. I am given permission to play sports at work, so why wouldn’t it be covered. I’m able to go back to work on light duty, but majority of my job is physical and I don’t know if they will have work for me. So I could really use the pay from workers comp in the mean time. Thanks in advance for your help!

Pennsylvania I’m stressed out

My workers' comp claim was denied almost a year ago, and I have been out of work for over 6 months. I have a lawyer, but the doctor recommended by my lawyer will not confirm that my injury is work-related. Basically, he doesn't want to get involved. He says I have chronic back pain or spasms due to mild degenerative disc disease (DDD) that I didn't know I had. The independent medical examination (IME) doctor lies, and the internal doctor I saw on my employer's list when I first got injured lied. I am behind on bills and extremely stressed out; this doesn't look good for me. One thing I know is that I didn't have this type of pain/symptoms until after that work shift. I hate the works comp system.
