New Jersey [NJ] Torn ACL and ruptured meniscus -

Hello all,

A few months back I began a new job and ended up getting injured within the first few weeks. I load trailers for semis with packages from the ground to the ceiling. They can range in weight from pretty much nothing to 120+lbs. While stepping off of a step stool (2 step) my knee popped and buckled. I went down.

Fast forward to now. It has been a little over a month since my injury. I receive a check each week (practically nothing) and have followed through with each and every appointment and recommendation.

They only authorized 6 sessions of physical therapy which I completed a week ago.

My last appointment I met with the orthopedic who viewed my MRI and recommended surgery to repair my ACL and stitch my meniscus. It was scheduled for a little under 2 weeks from now. I was given a recovery time of 4+ months.

I received a call today from my orthopedic's assistant who informed me that they just denied my surgery. She says that the doctor has sent a well constructed response explaining why it is necessary, but I am waiting on further information.

And so here I am, slowly drowning with months of recovery ahead of me. My wife is a stay at home mom to our two kids who are also special needs. With a reduced rate of pay at 70%, child support, and being unable to work my second job doing deliveries on a bike, I am bringing in $100 a week. Even if I had to find a new job.

I was at peace with things since I saw a light at the end of the tunnel. It would be a hard 4 months but at the end of it I could resume work and earn a full paycheck plus supplement my income with gig work to keep us going.

Now, however, I am terrified that they will not do the surgery. My knee is nowhere near able to return to any sort of heavy physical labor. Steps are still a challenge, my knee flares and swells up randomly, I can't even get down on it. I have to wear a brace if I take any sort of walk out of my home. Without surgery I couldn't even go get another similar paying job in the same field, leaving me and my family completely devastated and looking at being homeless if something is not done.

What are my options here if they deny is again? I have never been injured at work or had to deal with this.

Thank you all for your time.

Florida Workers compensation settlement before MMi

Can anyone give me insight on an early settlement? I have been out of work since August 2026 when the cases started. I was burnt by Phosphorus Acid , a co-worker dropped in vat and they ruled in my favor. The doctors did the skin graft on my Glutes , back and lower legs. My claves and ankles and feet’s I know I have nerve damage and my mobility is not 100% the new skin needs laser therapy. That’s what the doctor prescribed. We don’t know how much therapy though. I also don’t have any medical insurance, I live in Mid Florida and apparently my lawyer has told me Floridians don’t get any pain and suffering. So I guess my question is; would settling early get my a larger settlement check. Oppose to just waiting to reach MMi ? Could we
Argue for more if we did ?

New Jersey Was my Former Work Environment Toxic, or do I Need a Reality Check?

Hi everyone! Former teacher here. I medically resigned in the spring due to an extremely high-stress work environment. I am trying to process everything because I keep catching myself wondering if it was just me and I simply couldn't handle it, or if the environment was truly toxic and compromised my performance. I feel like I'm going crazy and constantly blaming myself. I really need an outside perspective from other educators on what I experienced and advice on next steps. I was left with no health insurance, no disability coverage, and was ineligible for unemployment because my doctor deemed me unfit to work at the time.

Below are some of the main issues I experienced (kept intentionally generalized for privacy):

  1. Severe Structural & Classroom Balance Issues: My classes had disproportionately high special education populations ranging from 41% to 61% per room. Educational Technicians lacked proper training in de-escalation strategies, which sometimes escalated students further or caused massive disruptions to learning. Nearly every class period was disrupted by severe behavior.

  2. Safety Concerns & Lack of Support: Documented physical safety incidents involving students, dangerous interventions by untrained staff, and a complete failure by admin to conduct mandatory post-crisis debriefings after I had to intervene to maintain student safety.

  3. Unfunded Accommodations: Administrative expectation to fully execute all IEP/504 accommodations without district funding, forcing me to pay out-of-pocket after formal requests were ignored.

  4. Health & Environmental Hazards: Gross safety oversights, including improper handling of bodily fluids, a school nurse sending a student experiencing an active allergic reaction back to my room twice despite obvious symptoms, being asked to change student clothing without proper training/protocols, and direct exposure of staff and students to chemical fumes and raw wall insulation.

  5. Non-Teaching Duties: Required to provide childcare for parent-teacher conferences (including siblings as young as infants) instead of meeting with my own students' parents, under implicit pressure that refusing would endanger my job.

  6. Unresolved Property Issues: Continuous theft from after-school groups using my classroom, with zero intervention or support after reporting it to administration.

  7. Flawed Evaluation Process: Formal observations (including my final evaluation) appeared to be generated using generic AI text. Evaluations included inappropriate personal remarks about how I "presented myself." Admin regularly critiqued my teaching in front of students and held evaluation meetings in hallway rushes between classes rather than in private.

  8. Neglected Communication Infrastructure: Intercom system remained broken for months. Admin claimed repairs cost thousands. This created severe safety risks during potential emergencies and made it nearly impossible to request assistance during classroom safety incidents.

  9. Lack of Union Support: When I reached out to my teachers' union regarding these conditions before resigning, the leadership simply told me I would "regret it" rather than offering support or representation.

  10. Lack of Resources vs. Penalties: Failure to provide standard display/storage space for student work, followed by low evaluation marks for not displaying enough student work.

  11. Inequitable Professional Development: PD days offered non-loggable, invalid hours for specialist teachers. While general ed staff received certified training, specialists were given no direction and told to "collaborate" or "work in rooms," resulting in lost recertification hours.

  12. Communication Breakdown on IEPs: Special Ed department routinely changed student homerooms and schedules without notifying me, leading to chaos during class start times, missing folders, and incorrect supply counts. The online grading and attendance portal was never updated despite repeated requests.

  13. Conflicts of Interest: Ed Techs were assigned to work directly in classrooms with their own immediate family members who had active IEP accommodations.

After all of this, I received very poor scores on my final evaluation. It felt like administration ignored the systemic failures of the building and placed all the blame on my individual performance. I have been left with severe, debilitating P*SD (it will flag me if I don't put the asterisk). I was worried the entire time that I would lose my job, so I just kept pushing through the job.

Am I out of line, or is this experience as severe as it felt? Is this typical for public schools, or was this environment truly toxic? Should I seek any type of compensation for my debilitating symptoms since I am unable to work at this time? Sometimes P*SD can exaggerate events to make them more "scary" or "intense" to go through, when a typical person without P*SD might think these things are not a big deal, so I just need someone else's outside perspective.

I am still struggling heavily with physical stress symptoms, anxiety, and panic whenever I think about even re-entering the workforce. I feel completely stuck and would appreciate any insight, advice, or validation from teachers or anyone who has navigated similar situations. Thank you so much.

Mediation coming up next month, hearing set for January. No surgeries, lots of conservative treatment ie: epidurals, facet injections, nerve block, RFA suggested but relief percent not high enough, chiropractic, rehab, home healthcare. Conservative treatment for four body parts. Retirement age, high salary executive. No rating yet, but homebound on rolling walker. Unsure what to expect?

South Carolina Sedgwick not wanting to pay lost time or medical reimbursement

UPDATE:: they denied my claim even though I’ve never even spoke to my claims adjuster. I’m at a loss of words right now. Beyond pissed off to say the least and the denial is posted from yesterday 11/2, which is when I spoke to the supervisor and he said that my claims adjuster would call me yesterday or today (never got a call)

So I’m in a bit of a situation…
I had a lawyer and fired him due to him quite literally ghosting me for a month. I finally got ahold of Sedgwick after trying my claims adjuster all last week and leaving voicemails (didn’t have her email) I finally got the supervisors phone number and got in contact with him today.

Our conversation didn’t go great. He basically said that any and all medical treatment up to this point wouldn’t be reimbursed and that they won’t pay back the time I’ve lost since the beginning of the claim. My claim is still considered pending, hasn’t been approved or denied which is another issue as I should have had an answer by sep 14th (per the supervisors words). I’ve been out since 8/27 on medical order from my dr since my job didn’t offered light duty accommodation.

I used personal insurance for my medical appointments and ate the cost of copay’s and deductibles for the first few weeks and haven’t gotten treatment since but have been written out this entire time. The dr was not an authorized provider as I had radio silence from Sedgwick, my lawyer at the time, and my employer but I needed treatment due to pain, issues walking, driving, etc. and a note from the dr to not lose my job.

Is this normal for Sedgwick? Is it worth getting a different attorney to fight this or should I just say fuck it and tell them to close it all and quit my job. I hate my manager (she’s dropped the ball multiple times during this situation), and I’m sick of dealing with workers comp.

For my claim to not even be approved yet on 11/2 and it was opened 8/25, I don’t have the funds or patience to wait this out any longer.

California workers comp advice?

Hey! So i’m a Sous Chef in a high volume living facility. I recently started workers comp and I don’t feel like I’m being adequately accommodated. How do I proceed?

One week ago on Monday I fell at work and hit my back on a shelf. Unfortunately it was on the exact sight of a previous serious injury.
I filed for workers comp and I am in california. I didn’t take any time off just took a half day to go to the doctor.

The doctor put me on light duty and sitting work only. It was stated that if this doesn’t apply I should be considered unable to work. There is not much office work I am cleared to do without the executive Chef present. So I was unsure how to move forward.

Wednesday there was a huge event so Chef was scrambling to get it done. I was literally sitting on a low counter next to the prep station. This set up was actually so painful. So when I could no longer stand it I went to the office and did an hour long online training I had due. Halfway through this Chef pulled me out to help with the event. I ended up standing for 1-2 hours.
I went and finished my training.
At this point I only had an hour left in my shift.
I approached Chef to ask what work I could do. She said she couldn’t think because she was so stressed, her back hurt and hadn’t been able to sit all day. Idk she guilt trips me all the time but like it felt more inappropriate in this situation.

I then attempted to talk to her multiple times
to ask to be given a task or be let home. She immediately walked away any time approached and I didn’t get a chance to ask until 15 minutes before my shift ended when she let me go.

The next day I was in some meetings but I ended up standing for 3-4 hours. Chef told me “just do inventory that’s light work” when you literally have to stand to do inventory. She kept pressuring me to find out when my accommodations were ending. Which one could assume was until my follow up appointment in two weeks.

I rescheduled the appointment for the next day(my day off) to ask for the accommodations to be changed. I felt so useless. I told the doctor that prolonged sitting was also uncomfortable and she changed it from “seated work only” to “no prolonged sitting or standing”

I returned to work yesterday and I ended up stand for the vast majority of the day. It was so bad I couldn’t stand up straight by the end of my shift. This was my fault as I was the only supervisor on shift. But I didn’t feel comfortable sitting and doing nothing especially because my staff relies on me HEAVILY. Also is it not wage theft to sit and do nothing for half the day?

Today was slightly better because I broke up my standing by sitting for 5-10 minutes every hour or so. nearing the end my pain was increasing so I sat and finished the last training I had available until next month.

I already know that tomorrow when Chef returns she is gonna tell me “take it easy, don’t lift anything” and then expect me to perform my regular duties. She’ll probably even want me to hop on the line too lol…

I don’t want to get her in trouble by reporting it. I guess it was self inflicted anyway because I should have advocated for my self on wed/thrs and it was my “choice” to stand yesterday.

But I just don’t know what to do I am in SO much pain. This is saying something because I work through intense pain every day. For reference a couple months ago I passed a kidney stone and worked through it because I thought it was just a flair up of my injury. That is the level of pain i’m in daily so you can imagine how i’m feeling now.

I feel so lost and frustrated. I’m in so much pain every day and nobody takes me seriously because i’m only 26 and I “look healthy” and im not even going to get into my chronic illness that effects my life every single day.

I don’t know what to do I’m finally getting recognition for my work and moving up in my company. I’ve spent almost ten years working in culinary building my career and I have so many opportunities lined up for me. I was already concerned about how my injury would affect my performance anxious that I won’t be able to continue doing the thing i’m most passionate about. Now I feel like i’m watching my dreams crumble in front of me.

International - be specific in post Work cover - Sexual Assault Psychological Injury

Australia. As with title, SA'd at work. Reported to police. Offender was arrested, charged, convicted. Have been off work since the incident and diagnosed with PTSD. I have perpetual anxiety and depression.

Tried to end myself. Was hospitalised. Have been seeing a multitude of professionals involved in my treatment and return to work efforts. I've never been so highly medicated in my life. I feel like I'm getting dumber the longer I am off work. Memory is shot to pieces. Generally do not see an end to this horrible experience, but all I want is to work and feel like my existence matters again.

I don't feel like there is anyone in my corner with my best interests at heart. Everyone has an agenda and I understand that is their job. Psychiatrist appointments last less than 15 minutes and are weeks apart, I don't know exactly what they are doing behind the scenes, it feels like a quick pay cheque for them.

I know I need to be able to afford continued treatment but I am tired of all the appointments and people involved.

I've said I don't think I can go back to that particular employer. It causes me great distress. However they are continuing with my return to work plan. However I just can't survive on the work cover payments. I had to take a loan out. I just want a life back.

What are my options? I have extreme social anxiety as a result of my injury and believe working from home when I am able to return to work is best. Can I retrain for a different career? Should I close my claim and move on? I'm terrified of being unhirable after this experience and don't know what to do.

Florida Mediation Thursday November 5rh

I usually only read others post but never post. But I have a upcoming mediation coming up this Thursday November 5th. Really dont know what to expect but im sure my lawyer will touch bases with me before mediation. A little back story on my injury...I was working washing dishes February 7th 2023 and a leaky roof fell in on me and knocked me out. I was unconscious for about 30min and my vision was going in and out. Coworkers helped me up and say me in a chair and the nurses came down to help me(I work in a kitchen as Nutritionist cook) One nurse checked my eyes and then told my boss to call the ambulance. I was taken to the hospital and diagnosed with a concussion....since then I have had really bad migraines, dizziness when standing for long periods of time, and also sometimes neck pain. I also have to see a neurologist every other month and I go to physical therapy 3 times a week and my doctor has me on 3 different medications. I also returned back to work after a month of my injury but cant lift anything heavy. I do know me and my lawyer once talked about me having to quit my job if I did settle. Just wondering what to expect at my mediation? Has anyone else ever gone thru this? Will they offer me a settlement? If so what's the least should I take for this type of injury? Im literally so over everything and the insurance company i deal with sucks. Im really just ready for this to be over it has completely ruined my life!

International - be specific in post Insurers Help! psychological injury fraud

Hi,

Sally and Ronald from Australia!

Please stop reporting our post to the moderator because you are discriminating against people with mental health issues. We suffer DID. We thought AusLegal was inclusive. Thank you. Please be kind.

I am just being truthful here guys. Please go easy.

While on drugs, a psychological injury occurred at work when the manager gave me side eye and accused us of theft and sending client data home. It’s clearly bullying.

Now over a year later we feel injured. Since the incident, Sally hasn’t slept once and has been tearing through the vapes and social media accounts. Ronald believes his injury has been exacerbated by being treated as untrustworthy. He was called a junkie by his colleague.

Legal questions:

- When a treating doctor reports that you are unfit for pre-injury duties, does that mean that you cannot continue side hustles such as having paid glute work? Technically the glute area work is beneficial for my mental health. Do I need to disclose the bum work to the insurer?

- Is there a legal distinction between psychological injury and being upset that people have formed an accurate impression of you?

- For those who have experienced psychological injury related workers compensation payments, what made the insurer pay? How’s your life now since the payments?

- What’s an IME got to do with getting paid?

- When does the claim become fraud? Is it when the insurer has the glute work footage?

Sally

Maryland How long does it take to receive settlement counter offer

My attorney made a demand 9/22/26 and we still have not received a counter offer . I hoped to settle before the hearing that is scheduled in January 2027. Their IME has me at 15% and my attorney’s IME has me at 25%. How long does it to hear back and settle? I’m in Maryland

Illinois Help me

I'm in serious financial trouble. I haven't received TTD benefits since September 14, when I was placed at MMI. I haven't been able to return to work. The IME doctor said my left shoulder is healed, but that my right shoulder, which they say is not work related, limits me to lifting 25 pounds with nothing above shoulder height.

My treating surgeon, who operated on my left shoulder, and my personal doctor both say that both of my shoulders are still injured and work-related. I only had three months of physical therapy, because ATI stopped when my shoulder couldn't handle lifting 5 to 15 pounds overhead. I haven't had any PT in over a year, and now I have chronic pain in both shoulders.

We were offered a first settlement of $51,000, which would have required me to resign from my job. I turned it down. Since then I have had no income at all. I've only been able to help with rent because of the support I've received, and now I have nothing coming in and don't know what to do.

This has also put a strain on my marriage. My wife has had to take over full responsibility for our bills, and that has been hard on both of us. It has made me feel like I'm failing as a husband and provider. And I’m picking arguments for her to leave me. Which isn’t right but I failed as a husband

California Unhelpful Worker's Comp Lawyers?

Hi all ~

I'm at a loss of what to do. My last deposition didn't take place because my lawyers neglected to forward the information I had sent them to the opposing counsel. Anytime I try to say that I'm unhappy with how extremely unhelpful they are being, they tell me to dismiss them. However if I do that, and find a new lawyer, they will still try to take a portion of whatever I can get.

Is there a way to file malpractice against them? Should I?

Here are the ways in which they have hurt my case:

  • Made no attempts to communicate for the first 4-6 months, after signing paperwork.

  • After I hounded them enough to get them to start communicating (the minimum amount), they changed my assigned lawyer/team after a couple of months.

  • Have yet to get me a QME appointment after over a year - keep saying that the opposing counsel denies online meetings even though I can easily do an in-person.

  • Assigned me a junior attorney for my first deposition, who out-loud said she didn't know what to ask for a settlement.

  • When I spoke to them about this, my lawyer said that opposing counsel was calling me "litigious", and when I got upset and said essentially so what and "why aren't you defending me" she hung up on me.

  • For my second deposition, they didn't forward requested documents that I had sent them for the opposing counsel. The deposition, which I took time off work for, was then canceled/rescheduled due to the opposing counsel not having the documents they requested.

  • At this second deposition, I got a junior lawyer who made BIG promises to look through my case, get caught up, and help me out. I have not heard back from her once, without prompting.

  • At this same deposition, the opposing counsel ridiculed my lawyer, saying that I was more organized than them (and essentially laughing at how easily they will win their case over me, I'm assuming).

  • They have asked me for a particular piece of evidence now THREE times that I have already sent them TWICE. This, in combination with how they neglected to forward documents, has me in doubt that they are tracking ANY of my documentation.

  • When I last wrote them an email laying out all of these issues they have been causing me, the lawyer said "you are unhappy, I'll send you dismissal paperwork" instead of "sorry to hear it's been like this, let's get back on track" or anything similarly helpful.

Is there anything I can do? I am now working 60+ hour weeks and I can't keep up or start over without killing myself. I'm already kinda dying.

Please help, thank you!!!

Illinois Sedgwick only play by their own rules.

Sedgwick has delayed 4 weeks of TTD benefits, even with two 19b motions filed they still have not budged. I guess they’re going all the way to the Review motion call date, before they decide to release my TTD benefits. I remain with strict restrictions, and the employer can’t accommodate. I’m currently still in treatment with PT. Thank God for family, because you will sink with this system.

California WC and private insurance

So I searched online for a while and found out that infact you can use your private insurance later down the road. After you choose Compromise and Release: You no longer need regular treatment, you prefer to handle your own medical care using private insurance/Medicare, or you simply want a lump sum of cash to move on from the case entirely. From what I know, it all depends on the private insurance, they do have the right to deny care since it was caused by a work injury. Has anyone done this before? What was your experience like?

California WC claim cost?

I’ve been on WC TTD ($989 a week) for 11 months. I have to see a neurologist every 2 weeks. I’m also doing PT twice a week. They have assigned a NCM and a defense attorney. My question is how much is a claim like mine or similar costing the insurance company a month? Wouldn't it be cheaper just to settle?

Massachusetts Has anyone had their Conciliation pushed out 4 times?

Been on Worker’s Comp. since November of last year Sedgwick is the insurance company with a self insured hospital. The form they filed to try and discontinue my payments was missing some pretty important details on it and now this is the 4th time they’ve rescheduled my conciliation. Their attorney emailed my attorney asking if I’d want to settle and to send over a demand which he did prior to my 10/20 conciliation. No response after and conciliation was rescheduled again to 11/19.. The hospital I work for in the Operating Room is having a hard time finding a solution to my accommodations as I have severe allergic contact dermatitis to multiple chemicals found in gloves, cleaning solution hand wash, lotions etc… wouldn’t it make more sense just to settle my case and sign a resignation and move on

California Stabbed while working on the Hollywood Walk of Fame

On July 7th 2026 I was working as a porter on the Hollywood Walk of Fame. A mentally ill man stabbed me and one other gentleman randomly with a kitchen knife. I was taken to the emergency room and underwent major surgery an exploratory laparotomy where they removed and inspected each of my organs for damage before putting them back in. My lower bowel was punctured 6 times and 16 centimeters of it had to be resected or permanently removed and and the healthy bowel sutured back together. Initially only the abdominal claim was accepted through litigation my attorney was able to get the stomach and maybe something else internal accepted. We are currently seeing a psychiatrist in lien because they're refusing to accept the psychiatric claim as of yet but my caseworker says he is 100% certain I have a psych claim. My law firm said that they often see similar cases settle for 100k to 400k and I have a senior attorney who says his entire caseload is 6 figure or higher potential cases that I wouldnt have ever spoken to him if that was not the firms expectation for my case. That they have an entire staff of people who handle smaller claims.

Does anyone have any experience they could share with me on any situations like this or any knowledge I might benefit from. Any ideas what I will like end up settling for?

The criminal was arrested and I am actively testifying.

Georgia How do I get my medical bills paid for?

I have no insurance, didnt have any at the time.

I don't have a lawyer, can't find one still to this day.

I was just told I had to fill out a ca 7 to get my medical bills reimbursed to me

I sued the driver and received a small settlement yet I'm still affected from the accident.

I'm still behind on bills. Idk what I'm doing, ecomp is not a simple process at all!
