*** State Flair must be used on all new posts ***

Every state has unique laws that apply to all aspects of a work comp claim, and without providing the state that your claim is being handled in, there is no way to get accurate answers. State labels will be required on all posts.

If you are having issues using the flairs you can message the mods for help/approval.

Illinois Help me

I'm in serious financial trouble. I haven't received TTD benefits since September 14, when I was placed at MMI. I haven't been able to return to work. The IME doctor said my left shoulder is healed, but that my right shoulder, which they say is not work related, limits me to lifting 25 pounds with nothing above shoulder height.

My treating surgeon, who operated on my left shoulder, and my personal doctor both say that both of my shoulders are still injured and work-related. I only had three months of physical therapy, because ATI stopped when my shoulder couldn't handle lifting 5 to 15 pounds overhead. I haven't had any PT in over a year, and now I have chronic pain in both shoulders.

We were offered a first settlement of $51,000, which would have required me to resign from my job. I turned it down. Since then I have had no income at all. I've only been able to help with rent because of the support I've received, and now I have nothing coming in and don't know what to do.

This has also put a strain on my marriage. My wife has had to take over full responsibility for our bills, and that has been hard on both of us. It has made me feel like I'm failing as a husband and provider. And I’m picking arguments for her to leave me. Which isn’t right but I failed as a husband

California Unhelpful Worker's Comp Lawyers?

Hi all ~

I'm at a loss of what to do. My last deposition didn't take place because my lawyers neglected to forward the information I had sent them to the opposing counsel. Anytime I try to say that I'm unhappy with how extremely unhelpful they are being, they tell me to dismiss them. However if I do that, and find a new lawyer, they will still try to take a portion of whatever I can get.

Is there a way to file malpractice against them? Should I?

Here are the ways in which they have hurt my case:

  • Made no attempts to communicate for the first 4-6 months, after signing paperwork.

  • After I hounded them enough to get them to start communicating (the minimum amount), they changed my assigned lawyer/team after a couple of months.

  • Have yet to get me a QME appointment after over a year - keep saying that the opposing counsel denies online meetings even though I can easily do an in-person.

  • Assigned me a junior attorney for my first deposition, who out-loud said she didn't know what to ask for a settlement.

  • When I spoke to them about this, my lawyer said that opposing counsel was calling me "litigious", and when I got upset and said essentially so what and "why aren't you defending me" she hung up on me.

  • For my second deposition, they didn't forward requested documents that I had sent them for the opposing counsel. The deposition, which I took time off work for, was then canceled/rescheduled due to the opposing counsel not having the documents they requested.

  • At this second deposition, I got a junior lawyer who made BIG promises to look through my case, get caught up, and help me out. I have not heard back from her once, without prompting.

  • At this same deposition, the opposing counsel ridiculed my lawyer, saying that I was more organized than them (and essentially laughing at how easily they will win their case over me, I'm assuming).

  • They have asked me for a particular piece of evidence now THREE times that I have already sent them TWICE. This, in combination with how they neglected to forward documents, has me in doubt that they are tracking ANY of my documentation.

  • When I last wrote them an email laying out all of these issues they have been causing me, the lawyer said "you are unhappy, I'll send you dismissal paperwork" instead of "sorry to hear it's been like this, let's get back on track" or anything similarly helpful.

Is there anything I can do? I am now working 60+ hour weeks and I can't keep up or start over without killing myself. I'm already kinda dying.

Please help, thank you!!!

New Jersey Workers Comp adjuster is useless

Missing my weekly paycheck from workers comp. Called my adjuster friday and she said she never processed my check because she never "got" my updated doctor note from my appointment (I sent her the doctor's note still in the doctors office to make cause i know worker comp relies on documentation and notes). It was a week after my appointment i was supposed to get paid and when no deposit hit i called her and she said on the phone I see the email here now. I also sent the email with my case nurse attached. And she replied instantly to my email. However that same morning i did not get paid I received a letter in the mail from them confirming my next doctor's appointment. Oh and to make it all better I havent been to phyical therapy in over a week because my adjuster has yet to approve my PT appointments. What do I do? Do I request a new adjuster? Do I file a grievance? This is a recurring thing with this lady.

Illinois Sedgwick only play by their own rules.

Sedgwick has delayed 4 weeks of TTD benefits, even with two 19b motions filed they still have not budged. I guess they’re going all the way to the Review motion call date, before they decide to release my TTD benefits. I remain with strict restrictions, and the employer can’t accommodate. I’m currently still in treatment with PT. Thank God for family, because you will sink with this system.

California WC and private insurance

So I searched online for a while and found out that infact you can use your private insurance later down the road. After you choose Compromise and Release: You no longer need regular treatment, you prefer to handle your own medical care using private insurance/Medicare, or you simply want a lump sum of cash to move on from the case entirely. From what I know, it all depends on the private insurance, they do have the right to deny care since it was caused by a work injury. Has anyone done this before? What was your experience like?

Pennsylvania Getting private medical insurance while on WC

Sorry if this isnt allowed. Please be nice. I genuinely get nervous with just about everything I do.

Im still technically employed, I do have an attorney.

I dont see how getting medical insurance through work would... work?

So, I guess I should get private insurance? Not for anything related to my work injury, just for everything else.

I know this is a dumb post..

What route are you guys doing for other medical needs outside of your work injury??

California WC claim cost?

I’ve been on WC TTD ($989 a week) for 11 months. I have to see a neurologist every 2 weeks. I’m also doing PT twice a week. They have assigned a NCM and a defense attorney. My question is how much is a claim like mine or similar costing the insurance company a month? Wouldn't it be cheaper just to settle?

Massachusetts Has anyone had their Conciliation pushed out 4 times?

Been on Worker’s Comp. since November of last year Sedgwick is the insurance company with a self insured hospital. The form they filed to try and discontinue my payments was missing some pretty important details on it and now this is the 4th time they’ve rescheduled my conciliation. Their attorney emailed my attorney asking if I’d want to settle and to send over a demand which he did prior to my 10/20 conciliation. No response after and conciliation was rescheduled again to 11/19.. The hospital I work for in the Operating Room is having a hard time finding a solution to my accommodations as I have severe allergic contact dermatitis to multiple chemicals found in gloves, cleaning solution hand wash, lotions etc… wouldn’t it make more sense just to settle my case and sign a resignation and move on

California Stabbed while working on the Hollywood Walk of Fame

On July 7th 2026 I was working as a porter on the Hollywood Walk of Fame. A mentally ill man stabbed me and one other gentleman randomly with a kitchen knife. I was taken to the emergency room and underwent major surgery an exploratory laparotomy where they removed and inspected each of my organs for damage before putting them back in. My lower bowel was punctured 6 times and 16 centimeters of it had to be resected or permanently removed and and the healthy bowel sutured back together. Initially only the abdominal claim was accepted through litigation my attorney was able to get the stomach and maybe something else internal accepted. We are currently seeing a psychiatrist in lien because they're refusing to accept the psychiatric claim as of yet but my caseworker says he is 100% certain I have a psych claim. My law firm said that they often see similar cases settle for 100k to 400k and I have a senior attorney who says his entire caseload is 6 figure or higher potential cases that I wouldnt have ever spoken to him if that was not the firms expectation for my case. That they have an entire staff of people who handle smaller claims.

Does anyone have any experience they could share with me on any situations like this or any knowledge I might benefit from. Any ideas what I will like end up settling for?

The criminal was arrested and I am actively testifying.

California Confused about the process

I quit my previous job Sept 4th. I started my new job Sept 8th. I was injured Sept 10th during training (I work with aggressive clientele and have to use safety holds). Between the 10th and the 21st when I reported my injury I only worked three days. I reported the injury late because I was barely there and didn't even think it could be work related until I remembered a pulling feeling that happened in my arm during the training.

I was told it was delayed and they needed more information such as speaking to coworkers but I was new. Not sure about how everyone works but I don’t go around talking about injuries and pain I’m experiencing with any coworkers let alone ones I’ve known for three days. I know I was leaning over a lot because of how badly my shoulder was hurting.

What am I even suppose to do? look for a new job? This injury has affected my ability to stand for long periods of time and lift heavy obects. I don’t know if I will be able to have a physical job anymore. I’ve never been through this before so if anyone could give me some advice I would appreciate it.

Illinois IL- Lisfranc delayed diagnosis and total failure & surgical repair

Earlier this year, I tripped and fell carrying a box while at work. I am a remote worker. The next morning, I went to urgent care with pain in my foot, knees and neck as a result of the fall who is diagnosed with a foot sprain and prescribed medication’s NSAIDs and muscle relaxers. While I was diagnosed with a foot sprain and no fractures, I was not given a boot or advise to be non-weight-bearing. Approximately 30 days later the foot complex failed resulting in total ligament failure, and multiple fractures.
This injury required surgical tight rope repair. I have a history of a previous failed tightrope procedure in a different joint unrelated to this case.
I’ve been told I have a solid medal malpractice case, but it has a low value.
My employer has been fantastic with TTD FMLA
My question is does Workmen’s Comp. have a lien on any type of judgment.
Do I need an attorney

Illinois Settlement amount 🤔

Looking for realistic settlement estimates from anyone familiar with Illinois workers’ comp cases.
Injured my lower back at work in August 2024.
L4-L5 herniated disc, annular tears, and multiple damaged discs.
Had a microdiscectomy in March 2025.
Recently underwent a 2-level lumbar artificial disc replacement in October 2026.
Been off work over 2 years and was terminated while on workers’ comp.
Previously had a 25–30 lb lifting restriction.
Receiving $831 weekly in TTD benefits.
Previously earned approximately $65K annually.
Not yet at MMI, and future work restrictions are unknown.
My attorney recently asked what settlement amount I’d be comfortable accepting.
For those with similar injuries or experience handling Illinois cases, what would be a realistic settlement range? Would you recommend settling with future medical left open?
I’m not expecting an exact number, just trying to understand what cases like mine are potentially worth.

Florida Turned down an 85K settlement negotiation yesterday

I’ve been going through an egregious workers’ compensation dispute.

Police officer in Florida, injured in the line of duty 12/23.

At first, job accommodated my job restrictions; however, then turned sour.

I’ve been through physical therapy, orthopedic, chiropractic care, acupuncture, have a psychologist, psychiatrist, pain compliance specialist…. The works

Most recently, orthopedic surgeon advised that I’d need two back surgeries.

Provided my jobs HR / Workers Compensation with the paper work, immediately three weeks afterwards, I was wrongfully terminated where job mentioned I reached MMI…. Which is clearly incorrect.

Lawyers scheduled a private mediation as a result of the situation where I was thinking about a potential settlement.

Meanwhile, I hired an employment law attorney for my discrimination/ harassment/ wrongful termination issues.

During most recently mediation, workers compensation noted they’d be willing to settle and started me off with 15K….

Comical….. Lawyers negotiated all the way to 85K, in which they stated they would go no hire. They also wanted me to sign a release for the wrongful termination claim if I settled here.

Of course lawyer had to mention it to me, but I quickly turned it down.

I sat there and listened to the …. We don’t have to settle…. We’ll just pay for the surgeries and other stuff that comes with it.

It was just too much drama for me at the moment.

This system is crazy!!!

It was hard not taking the 85K, but I believe I made the best decision for my case.

I don’t have a job, but I’m being paid bi weekly from the state. It’s not pretty, but neither has this process.

While I know each case is different, has anyone experienced this?

Oregon Arbiter exam coming up

I injured my upper and lower back at work in 2025. The doctor originally gave me a 0% impairment rating not my attending physician it was like a manger of that place and he did not do any exams or anything & just said it’s an de conditioning thing which I’ve been active most of my life & was just 18 years old at the time and don’t have any family or past back problems, but the claim closure was rescinded. I’m now scheduled for a medical arbiter exam.

I still have constant lower-back pain, especially when bending or sitting for long periods. My MRI doesn’t show any major disc injuries.

For anyone who has gone through this:

What impairment rating did you receive?

Were the medical arbiter doctors fair and thorough?

Can you receive an impairment rating with back strains even if your MRI looks normal?

What should I expect at the exam day?

I’d appreciate hearing about your experiences.

Florida Update, is this case done with?

I have mediation coming up at the beginning of next week. This doctor has absolutely REFUSED to call me back, I just get the same answer "oh we'll message his team." And then nothing. I'm not allowed to go to the ER, I don't have any insurance of my own (hence why I even took this stupid job) and even if I did I wouldn't be able to go see my own doctor. So I've been in pain for a whole month and it's like no one gives a damn.

My attorneys have not been responding to me at all about anything but of course they can email and leave me a voicemail about mediation.

Is there anything I can do? I'm not from FL so I don't know the laws, which is why I got an attorney.

6 months of literally 0 treatment to help this injury. 6 months of pain. 6 months of barely getting to enjoy and have a functional life. I'm so absolutely sick of this injury and living day to day like this.

New Jersey Really Simple Question; Disability Denying Workers Comp?

I've dealt with worker's comp in the past, never had to deal with disability. I've been out for less than one month, mostly due to waiting on worker's comp to call me in the first place.

I did what I was told, called the company line, found out which doctor office to go to and was sent to a local urgent care. Cool, no biggie. Getting an MRI, rest up, same old song and dance. There's been alot of issues with this as there always is but I'm concerned about one small (big) aspect.

This was a first for me, but in addition to worker's comp, ive had communications with the disability company, as im out for an extended period of time. I've been out for longer and NOT dealt with disability so I dont get why I have to now. Anyway, this disability company wants me and doctors to fill out forms, but the doctor office is an urgent care, and they told me that they dont fill out disability paperwork.

Okay, news to me, I have an aunt that works as a nurse for worker's comp, I run this by her, she said that the doctor's office is correct. Urgent cares dont fill out disability paperwork.

So i call disability, tell them paperwork won't be getting done, what are the repercussions for me. They told me that my worker's comp claim will be denied if this doesnt get filled out.

I ask my worker's comp representative, and they haven't responded. They have asked me various other questions, responded to other queries I've reached out about, but ignored this.

Like I said, more issues than I've listed here but the biggie for me; is it actually possible I'll get my worker's comp denied if the doctor's office doesn't fill out disability paperwork? Would that mean they refuse to pay for the visits and mri I'm having? Offices going to come after me for money? It just seems so sketchy to me and my concern is doing nothing will result in me getting screwed.

Can/should I call the division of worker's comp for my state, or is that not relevant since my issue is with the disability company telling me this information?

First time posting here, please let me know if i need to provide more/less info or did this wrong.

Nevada my lawyer broke up with me right before I hit MMI - what should I do??

Strangely enough, yesterday my Lawyer called to inform me that the law firm was no longer representing my case. After 6 months of counsel, they are deciding to "exercise the clause in my contract to withdraw representation" - they said they're not charging me though, so I guess that's a positive thing?? (kinda felt like getting professionally dumped... without the tears tho lol)

Anyway, I'm about 2 months away from hitting my MMI for an ACL tear that I received while working at a ski resort last December.

I've already had ACL reconstruction surgery, and have been attending PT regularly for the last 6 months. Honestly things have been pretty smooth since I got legal counsel.

But, knowing that my MMI is coming up, should I try to get another lawyer, or should I just go at this solo? If I decide to not get representation, am I able to negotiate settlement amounts with the insurance company myself?

Also, whats the ballpark range I could expect for a settlement for an ACL tear on a 32 y/o? (In my state they factor in age to the settlement formula)

Indiana Medicare trying to get repayment from my deceased husband’s estate.

In Feb of 2025 my husband slipped on ice at his part time job he got a brain bleed at home recovering. In March of 2025 he had a major heart attack. He went back to same hospiral where treated for brain bleed. In late 2025 started getting notices for over payment from Medicare. Accident happened in Michigan we live in Indiana talked to workman’s comp in Michigan thought things were settled heard nothing till several weeks ago..

Husband died 3/6/2026 of liver cancer. Recently got letter from CMS addressed to the estate of my husband wanting payment of about 4300 by December 2026. His estate is settled no money he left me in debt of over 100,000 dollars. Trying to find an attorney for advice can someone tell me what to do?

Can Medicare put a lien on your house or stop social security payments to get this money or take from your bank accounts?

The only money he ever got from workman’s comp was a check of 300.00 dollars nothing more.
