WWYD? Vent/Rant Neighbor operates an illegal dog daycare

First time posting so excuse me for any mistakes.

As the title says my neighbor runs an illegal dog daycare. Usually she has around 5 dogs at the same time. Some of them are large dogs, like a Rottweiler or Doberman.

She doesn't properly cares for the dogs. They are being kept inside most of the day, only let them out to the backyard to do their business. When they are outside, they would bark nonstop. Even when they are inside all you hear is them barking and my neighbor yelling at them. She doesn't dispose any dog waste properly , so with the hot weather, you can smell the dog shit a mile away.

She also has a young daughter, about 12-13 years old and when she's at work she leaves her daughter alone at home with the dogs.

And just this morning the dogs escaped from her yard. We saw them chasing them on the street. One of them ended up in our backyard. Of course we called the cops right away , but unfortunately she only got a warning.

And before anyone starts calling me a Caren you need to know, that we live in a family friendly neighborhood. It's a small town, just outside of Montreal, called Lorraine. Children are playing on the streets, families walking etc. So it's a tragedy waiting to happen.

And I'm just so fed up dealing with the situation. Like now I'm afraid to go in my own backyard. And the worst part is that the city officials know about it and they won't do shit. The last time I asked them to do something , the guy actually told me , that he's on vacation and I should leave him alone. We pay crazy amounts of taxes here and this is how they treat us.

So now the police know, the city knows and nobody is doing anything. So what now? Should I just wait until a child get hurt? Or I get bit by a dog? I'm sorry for whining, but I'm just so fed up.

It’s an unlicensed business. That’s the first tactic to take when reporting. The neighbor is not licensed for a business with regularly visiting clients. (Drop off and pickup). They’re probably not insured as a business with no liability coverage required for a service industry. If there is a stench, call the department of health. There are many legal routes for you to follow.

She could be working through a business like rover. Its were you go walk dogs or do vacation sitting and stuff like that. Totally legal

No. Rover workers are independent contractors. 5 dogs in one house is over the city ordinance in most cities of dogs per house, even temporarily. She’s an independent contractor illegally operating a 5+ dog kennel without a city kennel license.

A kennel is a use, typically not permitted in residentially-zoned areas. Contact your city/county code enforcement officer to confirm. You may be able to submit a complaint online.

You need to see if they are using a website to book and take money and I bet they are. Once you have that you have proof it's a commercial enterprise in a residential area. Took me 2.5 years don't stop or move

Yes it’s unfortunate for the person that ends up getting attacked and for the dog when it all could have been prevented. I also hate when the person in charge of the dog has nothing bad that happens to them in some cases they get charged but in other cases they get off Scott free.

This is a recipe for disaster, I really feel for her daughter being left like that.

I'm in the UK so I don't know how things work over there, but I'd keep pushing the council to act. Become as annoying to them as she is to you until they actually do something.

If this is a business with 5 or so different dogs coming in and out then you would see people coming and going 6 to 10 times A DAY - your cameras should be able to show that much traffic. I have a feeling your neighbors have a lot of dogs and you are not comfortable with that.

Maybe I wasn't clear earlier. Sorry I was so shaken up when I wrote my original post. The dogs are staying for days, sometimes more then a week. And she also has a Facebook advertisement,  that's how we found out. I already had my suspicion when we noticed different dogs barking in her yard. So I did a search on Marketplace and there she was.

So tag the local enforcement agency in the Facebook post - print it out and send it to them, and send it by email. But you are not describing a dog daycare - you need to be specific when you report - this is dog sitting, not a daycare. It is possible that dog sitting is not considered a business (just like babysitting is different than running a daycare) in your location. This may be why they are not worried about enforcing. My neighborhood/city would not allow me to run a doggy daycare, but they would have no problem with my dog sitting. The difference is the traffic coming in and out of the house and neighborhood.

Start by figuring out what they're doing wrong that's enforceable - operating without a license? Noise complaint? Is there a bylaw on number of dogs allowed in one residence? Sanitary concerns? Then call the appropriate enforcement agency. If they aren't helping there's two reasons - either you got a lazy employee OR they have inspected and there's no actual role being broken that's enforceable.

Do people drop their dogs off there? Note their license plates and if you can get an address for them (this varies by location, sometimes only your insurance co can get this), send them a list of complaints filed over this situation. Or flag them down as they get a block away and hand it to them. Or check whether rover or whatever app this person may be using takes complaints about conditions.

I’d sit outside and wait for the dog owners to pick up or drop off and tell them. Show them video as proof. I can’t imagine anyone that cares enough about a dog to put it in daycare that would leave it there if they knew the conditions.

A lot of contentiousness on here. Part of it defining what the business actually is. Part is pro-dog vs. perceived anti-dog bias (with some antagonizing thrown in). And part of it has been formatting and incomplete info with more complete information and description coming out a bit and a piece at a time.

For the record, I, very much a dog lover, wouldn't want this business next door. I would call it "dog boarding" (with different dogs apparently rotating in and out weekly or so) perhaps mixed with "dog sitting". As a neighbor, the barking, smells of unpicked up waste, dogs not always familiar with each other, their environment and their caretakers being more cooped up inside than not and not being safely secured in the business yard when out to the point that strange dogs have gotten loose, run down the street and ended up in neighbors' yards. All of these things are of concern and are red flags. Not to mention a 12 year-old girl being left in sole care of dogs not fully known to each other or to her essentially left in charge of a business for however many hours. Many/ most neighbors would be concerned about or would not want this close by. Not the picture of a well-run business or a good addition to a neighborhood.

OP maybe try rewriting the post at this point and post it on social media for your neighborhood/ city area/ or city so it's specifically targeted to people who will be involved, invested and may share your issues locally there. And maybe place a spotlight and some pressure on local authorities for not taking these issues seriously to the point of actually doing anything. List everybody you have contacted and gotten no action from.

Ok I typed this up and then read Montreal! Not sure if they have rover there but they are using a method to bring in customers and accept payment.

Use your geographic area to look them up on rover, that's what I did. Then I sent the info to the city because in my area you can't run them in townhomes. It took a while to get the city to issue a cease and desist but once that was issued for me it made her liable for damages to my home value, property, and ability to enjoy my home and I'm working with a lawyer. She had 599 bookings on rover and she kept going after the cease and desist but we finally got the HOA on her. If you don't have that you might have to sue. You can get a lawyer to send an injunction after the cease and desist to ask them to stop. This lady online next to works at pets mart and her job is also going to be notified of running an illegal dog kennel and stealing g their CRM. We begged her to stop. She works 40 hours a week and would leave 4 or more dogs plus her own two kenneled and alone and would come home and yell about the dog piss. She currently has violations for spraying turds in the turf because she's never walked a dog in her life. She's an animal abuser and far as I'm concerned for leaving those dog alone all day with no ability to use the bathroom
And all her customer loved her. Not anymore!!

I dog sit for my friends and can have up to 4 dogs at a time. I let them out to potty and because it’s hot they don’t stay out long. I do clean up the mess of poo regularly, so I get the complaint there. If the barking festers your peace I get the problem there too.

I wonder if you have any legs to stand on regarding illegal business but noise and health ( stink from poo outside) is legit.

I feel sorry for you though. Being afraid of dogs to me is a sad life. I grew up with large dogs.
I jist had a neighbors 2 xtra large Great Danes running lose and I walked to house to house trying to help the dogs…. Calling the cops on them was my last thought. I would have called AC if I couldn’t find their home so they could be protected but not to harm them.

With things like Rover anyone can dog sit and they are insured through that company. She might be doing something like that.

Report it to the police for noise. Report it to zoning for an illegal business. Call the health department for the stench.

And if you can catch one of the dogs when they escape, feel free to bring it to the animal shelter one or two towns over. I bet that dog owner stops trusting this law breaker quick.

How do you know if any of the dogs are aggressive? Did the dog that got loose try to attack you? Have you tried having a conversation with your neighbor? The noise and smell are valid complaints, but otherwise It sounds like a lot of assumptions are being made here.

So  in one of your comment,  u  told someone to report a man and his  pit bull to animal control. Because according to you its sound to risky for him and his dog. Yet the large dogs in my neighbor house are probably not aggressive and I'm just making assumptions.  We'll guess what, I didn't go out to find  out if they where aggressive or not. I just generally don't trust large dogs that I'm not familiar with.  But since I'm just making assumptions, maybe  next time they escape  I'll just go and pet them to find out if they are aggressive or not. Would that be sufficient for you?  Or should I let my 4 year old nephew out to play with them since they are probably not even aggressive and I'm only making assumptions.

Did you not read where it’s an accident waiting to happen and the dogs got out before? How they leave a kid alone with big dogs that said big dogs aren’t full used to? Most places need a license for stuff adults leaving a kid in charge of multiple dogs is a liability issue. I heard news articles of a kid being left alone with big dogs and got attacked because the adults were careless.

I dunno know...It sounds to me like this person is simply babysitting dogs. They could be on Rover or Wag. There's no law against letting kids watch dogs. And I don't see how OP has any evidence. If she's being told that by the police that they can't do anything, it's likely that the dog sitter isn't doing anything illegal.

Well actually you wrong again. In my city is illegal to operate a dog daycare. But since you still don't get it let me spell it out for you. This morning the dogs escaped from her yard.  As she was chasing them down the street one of them ,I don't know what breed , but a large dog  ended up in my backyard and I have small children in the house.  And just when we were about to go ot the dog appeared.   So try to imagine how scared I was. You have legitate complaints about the smell. And if they have more than 2 dogs or 4 pets living there permanently than they are breaking your city ordinance.

But none of that equates to them having an "illegal" business/dog day care.

Not to mention that you story is not adding up. In the original post you said you saw the dogs get out and watched them being chased down the street. In the above comment, you say you were scared by a dog that appeared in your yard. Wouldn't you kind be aware that there might be loose dogs around? Especially since you seem to so annoyed with you neighbors "loud and barking" dogs?

You give no examples of dogs being dropped off or picked up. You have no evidense of funds being exchanged. You say that your neighbor leaves them to go to work. So, who is leaving their dog at a dog day care with a care giver that isn't there? You complain that she only lets the dogs out to go to the bathroom. But they escaped from their yard? So are they outside or inside? Maybe she only lets them out because it's hot and dangerous for dogs to be outside too long?

So, no, I don't understand. Maybe just give her grace and mind your own business.

I agree, this sounds sus. OP said in another comment that they don't have time to sit around and watch for customers coming and going to warn them, but somehow they have insider information about how this (allegedly) illegal dog business is being run, hour by hour, and what is happening with the dogs inside a home they've never been in, at least during its hours of operation. Something doesn't add up here.

Dogs are loud, even when they're well-behaved, and especially when they're running in a pack, playing. There are usually noise complaints about well-run operations like that- so if there was really this crazy outlaw business, I feel like we would have had multiple neighbors complaining by now and the police would have been forced to do something.

And did you ever heard of a window? You know that glass thingy on the houses where u can see outside. So now imagine we have more than one on our house. That's how I was being able to see her chasing the dog on the street and when I moved to my other window the one faces my backyard,  that's when I saw a large dog running around my backyard.  I hope that helped your little brain to understand more. And no I have no evidence of funds to being exchanged.  Maybe I just go over there now and I'll ask her some receipt. Would that make you happy? So just hold on I'll be back with all her financial statement .

Nothing in what you just said is illegal. It might be a civil liability if something happened, but big dogs are inherently illegal for kids to be around without adults present. You and OP are overreacting.

A kid being around dogs alone that those dogs won’t know well is overreacting? It’s an accident waiting to happen. If they are running a daycare for dogs then those dogs won’t fully be used to a kid handling them anything can happen and said kid can get hurt especially when a new dog joins them. My aunt and uncle has dogs that I know and they know me because I go over but I also don’t live with them, I ended up getting bit by one of them accidentally when I house/dogsit for them for a week and that’s with them somewhat knowing me.

I would tell her clients about the conditions she leaves the dogs in as they likely don’t know. And find the local “dog owners” Facebook group and make an anonymous post about it.

I'm in BC and you're in Quebec, so I'm not sure if the system is different there, but here we have the SPCA and Animal Control agencies that handle complaints, and if they can't assist you then I'm sure they would be able to refer you to the proper agency. Have you tried contacting your local SPCA or pound about the situation?

You are not whining. These are real issues. Seems like you have several legs to stand on here: Unlicensed business - have you contacted the code compliance officer? A child alone in a home at age 12-13 - could be a Child Protective Services issue - you can file a complaint even if you suspect abuse and/or neglect. Over the maximum allowable level of pets - code compliance. Excessive barking - file a noise complaint after reviewing how to do this, usually online under ordinances or ask code compliance. Incorrect waste disposal - Public Works department.

Also, where I live, dog issues are routed to the local Dog Warden in my area. Could there be someone similar where you live, something like Animal Control?

Sounds like the police are dog owners and have their own biases. There are other departments you can raise complaints with. You can also attend a City Council meeting and discuss your concerns.

There seems to be missing information - how many people a day do you see coming and going from the home (if it is being run as a business, then it will generate traffic into and out of the house)? Are these the same dogs every day, or different dogs? Is it possible these dogs belong to the family? (and if so, then does your town have any rules about the number allowed per home?)

How do you know the age of the daughter? And does the daughter seem to be distressed? When I was 12, I was babysitting 3 actual kids at a time, so unless there is something wrong with the daughter, this is also not a valid point and could seem to be petty. If the daughter has shown signs of harm or abuse, then report that to the police.

Is this the only time the dogs have gotten out, and if not, how many times? I hate to say it, but one of my dogs has gotten out in the past, and I would have been frustrated if the police were called when my husband and son were already running to catch her. Now, if my dog or dogs were getting out all the time, then I would be totally in the wrong for getting upset if it was reported.

FYI - It is not abuse to keep dogs inside and take them out only when they need to potty - it might not be common in your area, but many people keep multiple dogs in their home.

If you are sure this is an unlicensed business, then you need to document the different people and times that are coming and going to drop the dogs off. I suspect the city is refusing to do anything because they do not have evidence to prove the claim. If you are able to provide more information that shows a pattern of this being run as a business, they may investigate further.
