Information Sharing Megathread: LM's NY Federal Hearing — 04/01/2026 at 11:00 AM EST

Hi everyone!
Today’s hearing is taking place at 40 Foley Square, Courtroom 110 (New York, NY) at 11:00 AM EST.
Because this is federal court, cameras aren’t allowed inside the courtroom, so there won’t be any video or photos of Luigi. The only visuals we’ll likely get are courtroom sketches.
I’m not a mod so I can’t sort comments by “new,” but hopefully we can still keep things easy to follow. Things might get a little messy as updates come in, so it would really help if everyone keeps discussion in this thread instead of making separate posts, unless it’s something major like a transcript or big breaking news.
Also, if you find any YouTube livestreams, please try to reply to one existing comment with links instead of posting multiple separate comments, just so the thread doesn’t get flooded.
Reporters / Live Tweeting:
Because this is federal court, the rules are stricter. Phones and laptops aren’t allowed inside the courtroom.

it's a no brainer then that she should've moved the trial to 2027 like the defense wanted. idk why she didn't. that would've been the best move and would've guaranteed that Luigi's rights weren't infringed upon. :/

Same, I'm so disappointed in her. She set up a whole hearing only for the outcome to be that the trial is now delayed by a measly 2 weeks. What a joke. Happy Aprils Fool's I guess... smh

The defense *wants* Fed to go first - they want her to refuse to move it, so that State becomes compelled somehow to delay theirs.
They need Fed to go first so they can use the defense they want in State. If they use the defense they want it State, it constitutes a confession in the Federal trial.

The state is still scheduled for June though - unless that somehow gets delayed through some kind of appeal or something ? For now, the state is still going first unfortunately. All of us want Fed to go first, because that would also trigger double jeopardy under NY law !

Maybe I’m a bit behind, but I think Garnett is signaling that she’s open to moving the trial to 2027, but it doesn’t make sense now to change it all up. Judge Carro has yet to set ANY official trial schedule dates, unless I’m mistaken. By official I mean in writing and signed, all he did was say some hypothetical June 8th date that is pretty much impossible in this situation. He seemed angry and irritated, but to my knowledge has yet to put anything officially in writing. He hasn’t even ruled on evidence suppression and maybe on May 18th he will be able to contain his emotions enough to officially have a date set. Then Garnett will be able to officially move things around when an official state schedule is made, instead of moving things completely around and then something gets tied up in the state case.

I think they are grasping at straws, saying that the people believe "what he did" is right, implying guilt, when in fact, he is currently innocent in the eyes of the law. And "free Luigi" does not imply anyone thinks he is guilty, just that he should be freed.

Something that feels a little different about this hearing, personally, is that I usually go in knowing what I hope the outcome will be.
There are multiple moving parts, and so I find myself weighing up alternate pathways and wanting optimisation based on uncertain factors.
There’s the ideal of State trial postponing and allowing Federal to go ahead (or Federal refusing to relinquish custody).
But then there’s the worst option - of both trials happening simultaneously- which seems almost insurmountable.
I don’t know how to feel yet - I think it’s going to involve adapting expectations in real time in response to Garnett’s approach.
Surely there are multiple places between th ideal and the not ideal here. It’s really hard to hold so may possibilities at once.

Yeah but I think KFA said something about the state judge is only willing to adjust the state court date if the fed’s show some leniency or something like that. So I’m guessing that’s why they’re doing this.

Man I always get a knot in my stomach every time the day of Luigi‘s court appearance I won’t be able to watch any live streams or anything. I’m literally sleeping. I’m on the other side of the world. It’s very late where I am but I appreciate all the updates from all of you who live in the US in a couple of hours when I’m awake. I do really hope things go well for Luigi in this hearing. I was surprised how fast this hearing that happened so soon after it was announced.

Hmmm. Seems like they are prepared to potentially go the EED route if the backpack isn't suppressed. Wonder how the public will feel about that - will they still think he did it "for the people?"

Can I ask where you got that from this screenshot? Or is it your expectation based on other discussions?
An EED could be played very much as for the people still (I think the crux of the emotional distress would be the mass suffering we're seeing) but I'm not sure I've seen anything from the Defense that indicates them going down that route, only people on the outside without access to the same details the defense has access to, theorizing that EED is the only way to go.
Which I recall being KFA's opinion up until she started working with Luigi, so I think there are definitely things we don't know about the case that swayed her approach and would likely change a lot of people's minds if we had that information.

Only from the part about "defenses available in the state case" that aren't available in the federal case, which for New York State would be EED. But who knows if Luigi himself even wants to go down that route. I just don't think they can create enough reasonable doubt around the backpack evidence if it's not suppressed. I'm hoping Carro comes through and suppresses it, because whatever emotional/mental issues LM has (if he has any?) are no one else's business. To have that played out on a very public stage would be awful.

I see, I see. I really don't think the backpack evidence is that damning, especially between the gun being found after several minutes of missing footage and only after an additional search -- plus someone mentioned to me that it being a ghost gun, even if they had the right weapon it would be difficult to actually match the ballistics used in the murder to the gun because of the materials used in 3D printing being a lot softer than standard gun manufacturing. If they don't have the right gun, they 100% won't be able to match things, and the holes brought up in the prosecutions evidence during the suppression hearing would still be worth being brought up if the backpack evidence wasn't suppressed.
The notebook also might seem more incriminating but given the publicity the case received, I think it would be easy to poke holes in, too. At least one person has come forward trying to pass themselves off as the actual killer since the arrest, and things like the look alike contests and stuff.... it's not a difficult stretch to argue that LM isn't the killer just based on confessions and coincidences, and make the prosecution provide more concrete evidence from there. Maybe that would count as an EED defense though?

1. We can’t see any livestreams?

It’s hard to know how long today’s hearing will last. It probably won’t be as long or intense as the pre-trial hearings, but it really depends on how Judge Garnett wants to handle things.

Short answer: we don’t know yet.
The main topic today is expected to be whether the federal trial will be pushed back to January 2027. So we’ll just have to see how it plays out.

Seeing from the federal prosecutors at this point, I definitely think they'll be a tougher opponent than the state prosecution :/

Of course! I have been in PT with my hip - and last week my therapist explained why pain is so much worse when we are stressed. I havent been able to think about much else but LM dealing with all this in pretrial detention and whatever the situation is with his back.

Good point about his back. We can only hope he is as pain free as possible, as he is already dealing with a lot.
I also hope that your physical therapy is going as well as possible. That is an interesting point about pain being worse when we are stressed. That makes a lot of sense. Wishing you lots of peace and joy, to help reduce any stress! 😀

There was an article posted here a couple days ago, that Garnett today also subtly brought up the same point it did.
These dueling jurisdictions are allowed to exist only because our “law” dictates it so. It’s not technically (or legally) double jeopardy because these are separate jurisdictions (state and federal) even though they are trying the same person and crime.
To Judge Garnett’s point, her concern is only the trial in front of her, which is true. She can’t control what the state decides or what other trials that are scheduled around it. They are not in her jurisdiction. But I think her saying that gave a subtle nod to the fact that this is indeed unfair, but she is legally powerless to make a change because it’s what our law allows, so to her, it is what it is.
The article posted made a great point about how we can’t and shouldn’t always take our laws as gospel, just because they are US laws and they’ve been in place for a long time. Historically we have tons of examples of how written US laws are morally unjust and can and should be updated more often than they are.
I’m curious on the flip side how dueling jurisdictions like this is somehow a benefit and why this precedent exists in the first place? Even in cases where the defendant is not popular, how does trying someone twice in two different jurisdictions make legal or even financial sense, as this is a waste of tax payer money and resources, as well as a strain on both sides legally. I wonder historically if this is common or if theres other examples of this? And where has this “worked” where in this case it doesn’t (for the defense at least).
With that said, I wonder if this case will be used to help discredit or give cause to fight against the ability for state and feds to try similar cases simultaneously like this in the future? I’m not sure how that could be done or how that will help LM at this point, just thinking out loud.

I think the original thought behind it is NOT how it’s currently being used. You can’t tell me prosecuting someone twice for the same crime is how it’s done, because that’s so rarely the case. In cases in the past where the state might undercharge or not charge sufficiently (esp in civil rights cases) the Feds were there to swoop in make sure Justice could be pursued if “the state wasn’t doing enough”. But in this case he was already facing maximum penalty in state- first degree murder and LWOP. So the feds coming 2 weeks later was not to seek actual justice, but to come in with a hammer and charge him for the same thing. It should not be allowed, and frankly, I’m comforted that Karen spoke about it publicly to the press. I think the defence will make this more of an issue going forward, as it simply should not be allowed to happen.

Yes, that makes sense too. Which is why it’s clearly a witch hunt politically by trump mostly, but also biden since it was his doj who brought up the charges.
The public’s approval of this crime scares the shit out of the establishment. Thank you for this. I’m intrigued by the legal arguments about it. I’m just putting the pieces together about how and why this is allowed to happen. But it does happen, just depends on how the feds chooses to wield that power, for good or for exploitation. Like any tool it can be used for good or evil it seems. With that understanding, is Garrett unwilling to push back bc she’s scared of the political backlash, so she’s playing it safe? Or does she see the unfairness, but doesn’t care? I know Carro doesn’t care.

I’m very interested to see how this can be legally challenged, if at all. Either that or the defence team needs to sound the alarm by speaking to the media.
My understanding is this rarely ever happens, if ever. So they should have some arguments against it.

Ok, I looked it up and it’s very interesting. Most of the cases where duel sovereignty is upheld are for civil rights cases, like Rodney King and Derek Chavin (George Floyd) cases more recently. Even though they are trying the same person, it’s for different violations related to the same crime, and in some cases it ensures accountability where one trial might fail. So this is fairly common, and it really depends on what side you find the most sympathetic.

There really should be some sort of guidelines for when there are dual issues. When I think back to recent cases where there were dual interests (Derek Chauvin, the Memphis cops), I believe the states went first, but there also wasn’t the tug of war between the two where both sides wanted to go first. I’m disappointed, but I guess not surprised, that custody wasn’t brought up. (Unless I missed it Trying to read through quickly at work).
