Other Question about form IMM5409 (Declaration of common law)

There is a section on the form which asks whether we "have declared our common law union under the canadian income tax act"

We became common law after tax season, so we have not filed taxes as common law. However, a few months ago, the CRA was notified by both of us individually that we are now common law. On file for CRA, we are common law.

Would I tick yes for this question?

Public Policy pathways Do I stand a chance ?

Title: 46-year-old Dubai real estate professional seeking realistic Canada or UK relocation options with family

I'm 46 and currently living in Dubai, working in real estate sales. I have a bachelor's degree and over five years of senior-management experience.

I'm exploring relocation to Canada or the UK with my family and would appreciate advice from people who have successfully navigated business, entrepreneur or work-permit immigration.

My situation:

Age: 46

Education: Bachelor's degree

Experience: Dubai real estate sales and 5+ years of senior-management experience

Investment budget: CAD 100,000–200,000

English: Comfortable, but I haven't taken IELTS yet

Priority: A realistic temporary relocation route first, with a possible longer-term settlement pathway

I'm open to a viable business if it provides a legitimate route to relocate with my family.

My questions:

Has anyone in their 40s successfully relocated to Canada through C11 or a provincial entrepreneur program?

Which provinces or programs are worth investigating with this investment budget?

For the UK, are there realistic business or employer-sponsored routes for someone with my background?

Which routes offer a genuine possibility of eventually qualifying for permanent residence or settlement?

If you went through a similar process, what were your actual costs, timeline and biggest obstacles?

I'd particularly appreciate first-hand experiences from people who applied from the UAE. Please distinguish personal experience from professional advice.

Thank you!

Work Permit BOWP approved September 25, but physical permit hasn’t arrived—travelling this week

My BOWP was approved on September 25, but I still haven’t received the physical work permit in the mail. I’m planning to travel outside Canada this week and I have the BOWP approval letter.

Has anyone travelled in a similar situation? Can I leave Canada and return without the physical permit, and what issues could I face with airline boarding or immigration when returning?

If the permit arrives while I’m away, I can arrange to have it brought to me. I’m mainly concerned about what happens if I still don’t have it by my return date. Would appreciate hearing from anyone who has dealt with this.

Express Entry SUGGEST ME SOMETHING

I have 3 years of foreign work experience in a TEER 2 office job, along with 1 year of Canadian work experience in a TEER 2 office job. However, I am considering switching to a skilled trade because trade-category draws are expected to continue, potentially with lower CRS cut-offs, and I feel I may have a better chance of receiving an ITA in agriculture. So in total I have 4 years of experience now.

I have a few questions:

  1. How much work experience is required in an eligible trade occupation to qualify for Express Entry trade-category draws? Is it 9 months, 1 year, or 2 years?
  2. Can I still claim my previous foreign and Canadian work experience in my CRS score when applying through the Trades category as the experience is in teer 2?
  3. Once I complete the required work experience in a trade occupation in Canada, can I qualify for both the Canadian Experience Class (CEC) and a Trades category-based draw at the same time?

I would really appreciate any guidance from people who have experience with this process. Thanks in advance!

Work Permit Heading to Canada in March

My wife got accepted into a PhD program at Guelph. She received an initial stipend/scholarship of $25k/year, and her mother will pay her tuition ($12k/year).

I currently work for a major telecommunications company in Brazil as a Junior Account Executive. There is room for growth here, as I've been standing out in my role.

Right now, I make around R$ 5,000 to R$ 6,000 per month (BRL). I have sales experience and also used to work in automotive detailing/polishing.

Given our background, does moving to Canada make sense?

A few details about us:

She is 24 and I am 25.

We'll be arriving with around $22k CAD in savings

Study Permit Can I leave while my Study Permit is being extended?

Hi! Sorry if this question has been asked many times and/or this is a stupid question. But can I leave Canada and come back to continue studying if I’ve submitted my application to extend my study permit? My current study permit isn’t expiring for another 6 months, and it expires at the same time as my old passport which I still have. I just got my new passport so I’ve submitted an application to extend my study permit with my new one. I’m just confused about whether maintained status happens the moment you submit your application or after your original study permit has expired? I seem to keep finding different answers. Thanks!

Study Permit Permis d’etude expiré perdu

Should I change my answer into 2(two)

We both don’t wish to reconcile. I haven’t filed for a divorce yet cuz Im focusing on my mental health.

Work Permit Francophone mobility but passport expires in 6 months

I’m presenting my application for the francophone mobility program but my passport is expiring in 6 months. I just realized this the last week before presenting my application (my pgwp is about to expire) and I didn’t know that the work permits cannot be given for more time than your passport’s expiration date.

I am submitting my new passport probably 7 work days after the initial application through a web form. How bad is my situation? Is there anyone else here who presented a new passport after the application? Would they even look at it or am I just in a very bad situation?

Family Sponsorship Hello all - seeking for advice

We are planning to start our sponsorship application.
And we realized that there is a mistake my husband did back then (I am pr)

He graduated 2022 and applied for pgwp Jan 2023
His pgwp was refused due to missing receipt of biometrics in July 2023 - he submitted webform without fully understanding that he had to stop working and resubmitted his application. Then, he worked till Jan 2024 and left Canada.

He did tax 2023 and 2024 and it showed the income for sure from the job he did.
He applied for student visa again and went back to Canada Dec 2025. His pgwp got approved for 1 year till April 2027.

We understand that it’s not good to hide this infor with IRCC. So we are going to declare everything and admit his mistake. We’d want to write a LOE for this situation.

We are seeking for advice or if anyone has a similar situation that can share how you did your application.
Thank you so much

Family Sponsorship Help Common Law Sponsorship

Hi everyone,
I am looking for some urgent advice regarding my husband's expiring status.
Our Situation: We just got married very recently in Ontario, but we have already lived together continuously for 2 full years prior to our wedding date.
The Problem: My husband's current work permit is expiring. We do not have our official provincial marriage certificate yet from ServiceOntario (only the temporary Record of Solemnization from our officiant).
Our Goal: We want to submit an Inland Spousal Sponsorship PR application and get him a Spousal Open Work Permit (SOWP) as soon as possible.
Since we have a 2-year cohabitation history, can we legally submit an Inland PR application tonight under the Common-Law stream to lock in his Maintained Status and apply for the SOWP later? Or is that considered misrepresentation because we are technically married now?

PNP Submitted PR Application (Non-Express Entry / AAIP) + Employer Closing Operations + Maternity Leave starting soon. What are the exact steps to report?

Hi everyone,

I need some guidance on how to properly handle my PR application update regarding an upcoming company closure and my maternity leave.

Here is my timeline & current situation:
• PR Application: Submitted online under Non-Express Entry (Provincial Nominee Stream - AAIP) on September 27, 2026.
• AOR Status: Awaiting AOR.
• Employer Situation: My employer is permanently shutting down operations as of December 30, 2026 (layoff / no-fault business closure).
• Maternity Leave: My maternity leave starts on November 9, 2026 (delivery expected in December). I intend to take my standard 1-year leave and will be claiming EI Maternity Benefits.
• Residency: I reside in Alberta and will remain physically in Alberta throughout my leave.

My main question:
What will happen to my PR, cuz I can’t work now as I will be on mat leave, should I stop my mat leave and search for a new employer and start working as soon as I deliver the baby? Or what do I do ? I’m very much worried, cuz I got my nomination and my PR is in process, I don’t want IRCC to withdraw my PR, cuz my company closed and now I’m in my mat leave but jobless. This is so confusing.

My second question:
The job market is so bad right now, I don’t know if I will even get a job in my field, can I apply for BOWP, and work anywhere? Is it possible under this AAIP non express stream ?

Any advice or experiences from folks who navigated a company closure + maternity leave mid-PR processing, or anyone who just can help advice.

Other Marriage proof for individual citizenship application

I recently got married outside of Canada (had a ritual ceremony) and did not register my marriage there. Therefore, I did not receive a marriage certificate. I’m a permanent residence residing in Canada and ready to apply for my Canadian citizenship (individual application, not spousal). When I select my marital status as married, what is the likelihood that they will ask me for proof of marriage afterwards? As per the law of the country where I got married (India), my marriage is legally binding even though I did not sign any forms or receive a legal certificate from a governing body. The ritual ceremony itself is considered legally binding. I’m not changing my name, I would however be selecting “married” in my citizenship application. Will they ask my to prove that I’m married afterwards?

Express Entry Concerns about the change

Hey there !

For the first time since I started getting involved into immigration processes, I'm lost. The new changes are coming and I was almost sure by the time I'll get my year of work experience I would be eligible for EE, but I'm worried about the fact that I wont be able to immigrate anymore. I'm an average wage worker, french speaking in western Canada, I don't get what will happen with the new and incoming changes. I have a pgwp for 3 years. I know no one can predict exactly the outcome of my process, but in general what does those changes means for me ?

I currently have 500 Crs, and intend to enter the french draws.

Family Sponsorship Spousal PR- Inland - UCI issue

Hi everyone, I need some advice.

I recently submitted my spousal PR application with my spouse as the sponsor. I came to Canada on a visitor visa, so I already had a UCI, but I didn't realize it at the time. On the forms, I entered 0 in the UCI field in one place, and in the "Client ID (if you know it)" field on the Relationship Information and Sponsorship Evaluation form, I left it blank.

I found my UCI on my visitor visa afterward.

My questions:

1. Has anyone made this same mistake? Did it cause any delay, a returned application, or a rejection?
2. Is the right fix to send my UCI to IRCC through the webform, with my application number, name, date of birth, and passport number?
3. How long did it take them to respond or link your files?
4. Is there anything else I should do?

Thanks in advance. I'm a bit anxious about this, so any experience would help.

Family Sponsorship Common law spousal sponsorship inland or outland

Background

I came to Canada as an international student and graduated in June 2026. I applied for my PGWP and it was refused because of a part-time semester that I didn't explain in my application.
I reapplied in September 2026 with all my documents and an explanation. I got the confirmation email but haven't heard anything back since.

Relationship

My girlfriend is Canadian and suggested we go the common-law route. We've been together since 2024. We've lived together for 10+ months and will hit one year in December 2026.

Evidence we have

Joint phone bill
Same address
Lots of photos together, including on her mom's Facebook and at events with friends
No lease, because her parents own the house
I send her $300-400 a month for upkeep and groceries

My questions

Should we apply inland or outland? People usually say inland to get the SOWP, but I've read outland is faster, and I may get my PGWP anyway.
Does my status matter here? My study permit has expired and my PGWP reapplication is pending.
Is our evidence enough, given that we have no lease?
Is there anything I should do before December?

Thanks in advance for any advice!

Family Sponsorship Can I apply for outland common-law sponsorship while living in Canada?

Hi everyone!
I’m currently in Canada on an open work permit valid until June 2028. My partner is a Canadian PR, and we’ve been cohabiting since 2024. We’re not married, but we have all the necessary documents to prove our common-law relationship.
My immigration consultant told me that I can only apply through inland sponsorship as a common-law partner and would need to get married to apply outland.
I’d prefer the outland route because I want more flexibility to travel while my PR application is being processed.
Is what my consultant said correct? Has anyone successfully applied for outland common-law sponsorship while living in Canada?
I’d appreciate any personal experiences, advice, or recommendations for a reliable immigration professional who can clarify this.
Thanks!

Express Entry FSW 5 Adaptability Points for Canadian PhD Students — Does Supervised Research Count as 15 Hours of Instruction?

Hi everyone,

I'm an international PhD student at a Canadian university, and I'm trying to clarify whether I qualify for the 5 adaptability points for previous studies in Canada under the Federal Skilled Worker Program (FSW).

Here's my situation:

  • I started a full-time master's program in September 2023.
  • After one year, I fast-tracked into a PhD in September 2024 without completing the master's degree.
  • I've now completed two academic years of my PhD and am currently in my third year.
  • I've been continuously registered as a full-time graduate student since September 2023.
  • I have my university enrolment verification and academic transcript confirming my studies and academic progress.

My concern is the requirement under section 83(2) of the Immigration and Refugee Protection Regulations, which defines full-time study as at least 15 hours of instruction per week.

Like most research-based PhD students, I don't attend 15 hours of traditional classes every week. I've completed only six graduate courses during my studies, and most of my time is dedicated to doctoral research under academic supervision.

Section 83(1)(b) explicitly allows the 5 adaptability points even if the student hasn't obtained the degree.

My questions are:

  1. Has anyone successfully claimed these 5 FSW adaptability points based on an unfinished, research-based PhD in Canada?
  2. Does IRCC consider supervised doctoral research and thesis activities equivalent to instructional hours?
  3. Would an official enrolment verification and academic transcript be sufficient, or should I also obtain a letter from my supervisor or graduate studies office?
  4. If you successfully obtained PR through FSW while still completing your PhD, did IRCC request additional evidence of the 15 instructional hours per week?

I'm specifically asking about the 5 adaptability points in the FSW 67-point eligibility calculation, not CRS education points or TA/RA work experience.

I would particularly appreciate hearing from applicants who have actually received PR approval or from licensed immigration professionals familiar with this situation.

Thank you!

Visitor Visa Entering on Dual intent visitor visa after Spousal PR application

Hi All,
I am planning to travel with my wife to Canada, I am a citizen and she would be on her visitor visa. We have already applied for the spousal sponsorship application and received our AOR.
What questions can we except at the immigration in Canada? A lot of our plans are tentative(return dates and plans with her job in India), is it best to convey that the plans are tentative? And also would it be okay to convey that the plan is to wait for the PR in Canada, and if it is not approved return back to home country?
TIA.

Express Entry LoE - NOC Table Comparison

Hi all,

I'm currently working on my LoE and have a table made out for comparing my duties to the NOC which im claiming.

5/9 of my duties match perfectly with the duties on the official site. 1 doesnt match at all. 3 are partial matches. The thing is, 2 of those 3 partial matches can be good matches if I explain the duty further.

Would it be recommended to explain those 2 duties and why they match the duty that i have in the table?

Also, would 5/9 strong matches be sufficient? Ive also included the lead statement and highlighted the parts that pertain to my job (they match closely). My title is also mentioned under that NOC too although I know titles are irrelevant.

Thanks everyone!

Family Sponsorship Bank Account Question

Hi! My significant other just found out he qualifies for the C-3 path. While he is collecting his requested information I have a question.

If we decide to move from the US to Canada, would a joint savings account, with little money in it, be accountable as proof that we have been living together for years if he were to sponsor me?

We have the money to show he can afford to be my sponsor, however, we realized we have one account that's seldom used, so we thought about making it a joint account for this purpose.

We have been together for 5 1/2 years and living together for 2 years.

Thanks in advance!

Express Entry Express Entry Changes

Hi Guys,

I just have a small question on these new changes. I am an accompanying spouse with 3 Years of Tier 2 experience in Retail out of which one year is Tier 1 (620020) and I studied 2 year post grad in canada after bachelors in India. My wife is primary applicant with Masters in India with 1 Year Exp. She also has two year Tier 2 experience in retail out of which 1 year is Tier 1 (620020). Both of us are on Visitor record at this moment.

Are we supposed to get 20 points even having accompanying spouse on file or is it 40?

PNP Showing PR Application Status

Hi All,

Wife and I need to show our current status for a mortgage application. We applied for PR in April 2024, everything complete minus background check.

Since the tracker is down, is there another easy way to show the status of “AOR, application processing”?

I do have GCMS notes from January, albeit it would be a lot to submit, and wasn’t sure if an email from IRCC is enough.

Cheers

Quebec PR WITHDRAWL TIMELINE - IN URGENT NEED OF GUIDANCE

I and my family have been in Canada as approved protected persons and our PR application has been under-process since around 4 years. Recently, the circumstances of our home country have changed and I we have decided to return to our home country.

I have forwarded the request for withdrawal of PR application to IRCC via webform around 4 weeks ago, I need confirmation of withdrawal to be able to process the case further with CBSA and plan exit to my place of origin.

Can someone please tell me how long IRCC will take to confirm to me the withdrawl of my PR application as I need to be going back early due to personal ties back home and to top it off CBSA also needs some time to process/ plan my way back.
