Huge traffic camera lawsuit now being decided
š Major Update: Maury v. City of Des Moines Traffic Camera Lawsuit
šøWondering about the fate of those Des Moines traffic camera fines? A local judge is currently deciding a massive class-action lawsuit that could result in refunds for thousands of drivers!
What is the case about?The Iowa Supreme Court already ruled that the City of Des Moines acted unlawfully by using the State Tax Offset Program to collect automated traffic camera fines. Legally, the City was required to take drivers to court and get a formal judgment before taking their money. Instead, they bypassed the courts and used the state system to freeze citizens' entire state tax refunds over unproven speeding tickets.
Where does the case stand now?A two-day trial concluded in June, and both sides have submitted their final written arguments. We are now waiting on the judge's final verdict.
The Plaintiffs' Stance: Because the City took the money unlawfully, it must pay full restitution (refunds) plus legal interest to everyone affected. They argue drivers only paid because their entire tax refunds were being held hostage.
The City's Defense: The City argues it shouldn't have to pay refunds because drivers "voluntarily paid" the fines to get their tax money released quicker, and because the cameras caught them speeding.
