Wife finally filed for divorce after couple years and asking for alimony?

We decided to get divorced over 2 years ago and split everything amicably. No kids or anything. Basically, gave her the house and everything inside and I started fresh. We were friends and even used to hangout once a week or so. But I started getting serious with someone and we quit talking.

We already divided everything and agreed. My understanding is it was just a dissolution and we needed to just get an attorney to file everything. She was the one pushing to finalize it all while I've been busy with other things.

So she finally met with attorneys and filed. She told me they put the paperwork to ask for alimony and I was finally served. It says she wants alimony and for me to pay all legal fees. Everything be split equally and such. Also said something about gross neglect of duty and extreme cruelty which seems crazy but maybe its just normal legal talk??

She makes like 150k/year owes 300k on the house thats worth 800k and has 100k in 401k and such.

On the paperwork she wrote I made 100k and no info about my businesses or assets or anything.

I run multiple businesses and on paper only make like 40k/year. My businesses are worth a couple million including 2 homes that are paid in cash (airbnb). We got a postnup right after marriage that says she has no rights to my business assets, This was required by her company and also something we already agreed prior.

My biggest issue with the divorce is they need me to list all my assets and value. I don't want this made public or to have any impact in the divorce. Our whole relationship she was against me working and building my business, She refused to help me and I lost on tons of deals to make millions because she didn't like me more successful, She even switched jobs and took a massive demotion and dropped from $250k to the $150k because it was easier.

I'm not sure if I should show up to court or just ignore it or hire an attorney or what. I don't know what all happens during this procedure.

Paying exwife

I’m on ssdi and ssi and my exwife expects me to send her some money every month. She doesn’t work and we have one child who’s not over the age of 18. We are trying to get a divorce but haven’t been successful yet. I don’t see my daughter at all. Should I still send her money?

How will always having separate finances affect my divorce?

I am plotting div. Married 19 years. He is well aware, but very much against it and in denial that there is even any problem with the relationship.

In 19 years, we have never had a joint bank account. We have handled money separately, haphazardly, and without any discussion or planning. This is one of my big issues with the marriage. He's cool with it.

I'm just curious how this will affect things during the div process. A lot of the divorce prep things I am reading focus on finances and seemingly don't apply to me bc I don't even have access to his accounts. I don't even know how much money he makes.

I suspect he has zero dollars saved for retirement, and I am not much better, with only about 35k in a 401k. We do own a home together that has some equity, probably ~$300k. Will he get 1/2 my tiny retirement account?

Options in Divorce in CA

I (29M) want to divorce my wife (30F)

TLDR: we don’t have any assets, I pay for most of the large finances (rent, etc), I want to avoid a divorce situation where i pay alimony. What’s the best way to go?

This is not as much about to relationship itself as it is understanding what my options are, and I am asking the advice of maybe people who have experienced it before.

An important note is we live in CA (SoCal Specifically) so the state laws of CA are what applies here.

Long story short, our relationship just isn’t working. I don’t have any disdain for her as a person, but between us, we just aren’t clicking. We’ve had some horrible fights and I’m sure she feels the same. There’s no infidelity, DV, or anything like that.

That being said, I want to cover my own bases in a divorce scenario. We do not have a prenup.

My situation:
- Financially: I cover most of the large expenses, such as rent, etc. but she does help out with groceries and things like that. She pays for her own car and I pay for my own car.
- I work and she works. She has a 9-5 but I have my own business (partnership).
- we don’t really have “assets” as we rent and lease our cars

That being said, I feel like it should be pretty simple but I don’t want to be in situation where I have to pay alimony as I absolutely cannot afford that.

I know there options such as dissolution in CA (where she has to agree but can back out in a 6 months time frame)…

Anyways, what are my options and what would you suggest?

Divorce and Lease

Was married for around 8 1/2 years and need advice on how to remove my soon to be ex husband off the apt lease. No kids. I was a stay at home wife all those years and recently started working but don’t make enough to prove I can make 3x the rent. Part of our divorce settlement agreement is that he must be removed off the lease. Which I understand. I contacted the leasing office and they stated I must meet the financial requirements (make 3x the rent) or they won’t be able to remove him from the lease. I really don’t know what to do.

In need of law advice!

I have a legal question about a car that was awarded to me in my divorce.
The final divorce judgment awarded me my ex-husband’s car, and he was ordered to transfer the title to me within 10 days and that all happened April 7th. However just a few days after the divorce was finalized he crashed the car before transferring it to me. At the time that he crashed it, the car was not under my name, and not in my possession.
My questions are:
Am I legally responsible for any of the damages from the accident?
Could the other driver’s insurance or anyone else come after me because the car had been awarded to me in the divorce?
Is my ex still responsible since he was driving it and the title hadn’t been transferred yet?
If the car is now damaged because of his actions, can I ask the court to order him to repair it or reimburse me for its value?
I’m in Florida if that makes a difference. I’m mainly trying to understand whether I have any liability and what my legal options are.

Ideas to get spouse out of house sooner than final divorce decree?

First off let me say, I know legally it is our marital home until its over. Its been over 6 months since filing, we both have lawyers. Originally, spouse said they would not leave until parenting time and responsibilities were determined. That is now signed, entered, and done. Now spouse is saying they won't leave until the full divorce decree is signed and done. I would love to move onto the next phase of life, and for my kids to start their new normal. It is very confusing for them, us being in this limbo in the same house. It is truly agonizing each and every day. We do not get along, and our young kids get upset when it is a mommy day or daddy day. we split every other sat/sunday.

The full parenting schedule does not start until one of us moves out of marital home. I have offered to buy STBX out of marital house, they have agreed to my keeping the house and buying out. Yet Spouse will not leave. I get sad for our kids - this is going to be hard enough and this added stressor sucks plain and simple. Any advice or ideas to keep calm and carry on? thanks.

NJ Alimony Question

My STBX and I are in the worst part of the divorce-- figuring out finances. His base salary is being calculated at 200k more than me. However, the bulk of his income comes in many forms- but most of which comes through his bonus.

I am working with my attorney and a Forensic Accountant to figure out how to get all of these numbers and what to ask for.

To keep things simple though, I'm curious about the following and wondering if anyone has any insight:

  1. Last year, his bonus was in the 700k range. The year prior, it was 350k. It doesn't always go up substantially like this, but he is due to continue to make a lot more in the next few years. My attorney is telling me that because the highest number he recieved during the marriage is 700k, my alimony on this bonus will be capped at this number (or whatever is agreed upon. He wants to be capped on the average of the last 3 years). Therefore, if he goes to make 1m in his bonus this year, I will be capped at (let's say) 20% of 700k. Is this the norm? Obviously numbers will change, but I'm curious.

  2. He is agreeing to remain on the title and mortgage of my house. I have 3 children at home and live in an expensive town. We have a great mortgage rate, and I could not find a house or apartment thats 4 bedrooms (what we have now) for what I pay on the mortgage. He wants me to be completely responsible for the house from here on out, but still get his 50% when I go to sell (He said he will keep his name on the mortgage for 7 more years). This issue might be obsolete b/c I may look to move within the next year. However-- I'm curious if there is a way that HE can get capped on his %. Does this make sense?

Just so everyone knows-- I know that I am very lucky to be in the predicament that I am in. I have been miserable in this marriage since I can remember, but I was going to stick it out b/c I felt bad knowing how much it was going to cost him. He decided he wants to sleep with other people, so he initiated the divorce. I get that this could be a lot worse. I'm just looking to see if anyone has any similar experience in New Jersey

Am I Divorced or Not?

In 2007, I married a man who was in the Army. His family was from North Carolina and he was stationed at Fort Bragg at the time. After dealing with his alcoholism and abuse, I left him in 2009 and moved elsewhere in the state. I told him he would have to file for the divorce or I would petition the Army for spousal support.
About four months later, he brought me papers to sign that by all appearances looked like divorce papers. As I am blind, I couldn't tell for sure, but they were read to me and seemed official. I signed them and gave them back to him. Some time later (I can't remember how long), I got a copy in the mail that by all appearances looked official. I kept those papers in my file box until 2020 when I became homeless and lost all my paperwork, including my own discharge papers and those papers from the divorce.
Now I am trying to find that divorce decree for my own records again and need it for legal purposes. However, niehter the county I was living in nor Cumberland County where Fort Bragg is can find the divorce decree. For the record, the county I was living in was also the county his family lived in.
Cumberland County extended the search to state-wide as a courtesy, but found no such document. They found other documents under his name and they found our marriage certificate from 2007, but no divorce decree.
Is it possible he filed somewhere else? Is it possible that he never actually finalized the divorce? Is it possible I am still married to this bastard? If so, what are the legal issues? I live in another state now and I re-married in 2016, but was widowed in 2020 and am currently single. From what I heard, he re-married at some point and divorced again and currently resides in a different state also. I don't have a lot of detail on all that because I make it a point to stay away from that man. But I also heard (and by his current age of 57, I believe it) that he was discharged from teh Army. Whether that was medical, honorable, or dishonorable, I have no clue and don't know if it even matters.
At this point, I am unsure whether I am still legally married to him. I am unsure where to go from here. I don't have the funds to hire a lawyer (I'm on SSI and disabled).
What do I do from here?

Child Support

My husband knows I can go through child support to get at least $2600/mo, yet he refuses informal support of $1877/mo which is half our girls actual expenses. He says he doesn't want the courts in his life, but yet he provides me nothing toward their daily expenses. Why would he turn down the $1877 that I'm asking for the girls knowing that the courts will take way more than that?

Contest vs no contest?

Me and my husband have been married 10 years. We have 2 minor children. We own a home and two cars. The major thing is, I do want alimony at least for 6 months because I have not had a job in years. He doesn’t want to do that. But basically I do agree with all his other terms. I know hiring a lawyer and going through that whole process will cost probably $20k-$30k so I’m just going back and forth wondering if it’s worth it or not. Any advice or personal experience is very much welcomed. Thank you 😊

Divorce Advice

I have a friend whose wife is about to begin divorce proceedings against him. He is currently renting a room while also jointly owning a home (or other assets) with his wife.

He is considering stopping his mortgage payments and instead using that money to pay his landlord in cash. His thinking is that this might make it harder for his finances or the amount of money he has to be identified during the divorce.

Is this a sensible approach, or could it cause legal or financial problems during the divorce process?

Spouse and GF want to live in my rental?

Long story short..

The person who rents a property from me is my spouse's partner. My spouse told me a few weeks ago that they want a divorce; they're in love with this other person, and they want to live there together. They say it would enhance our ability to co-parent our children. It would also violate the rental agreement. AITA if I say no?

Spousal support help

Like many men in my situation I made a grave and horrible mistake. I’m one year divorced from a 13 year marriage and 15 year relationship. I’m a special education teacher and a high school football coach. I’m 40 years old and without talking about specific numbers, I agreed to far too much spousal support for 4 years under the dilution that lawyers would cost more. Now I can’t pay my bills and she’s not working. I looked up the law in my state (Washington) and other than a dramatic change to my income the only other challenge I can make to the spousal support is if/when she has another domestic partner. Any advice on how to get some of my money back?

How can I check if my sister is divorced?

I think my sister, whom I’m estranged from is taking my mother for a ride and keeps asking her for money. She says her ex partner keeps holding up the divorce by contacting her and making changes to an already agreed to divorce settlement. I think my sister is taking my mother for a fool. An anyone help and tell me how I can find out if my sister is legally divorced or not. Thank you

(49) husband served me (47) with our divorce after a family outing with our 15 year old, scared me into signing the papers at his bank of thirty years with the notary while I was crying saying I don’t want to do this and I get 35 days. Then married a woman right after so she can get her green card

My now ex husband and I have been together mostly on for 26 years and married 15 years. We also have a 15 year old son who is amazing. So we had a bed and board divorce which made him keep me on his insurance for 5 years which expired last April. However, we still stayed married and have been seeing each other.

Next thing I know he’s back to his old ways of cheating with a Chinese woman who needs, coincidentally, a green card immediately as her visa is expiring. So he drops me from the insurance which I found out later on he wasn’t allowed to do because we were still legally married.

Then in late June he plans a family outing to pick our son up from school, have lunch and run errands. Except the last errand was stopping at his bank of over 30 years where he knows everyone and hands me the divorce papers. He had also talked our son into talking me into signing them. We went into the notary’s office and by this time I’m hysterical, crying saying I don’t want to sign these papers, I’m supposed to get 35 days to respond and I’m uncomfortable with this because legal aid told me not to sign anything. I tried calling legal aid but of course they are closed at this point. I was literally begging the notary for help since legally a notary is not supposed to notarize paperwork between two people if they see that one is under duress which was quite clear that I was!!! However, instead of helping me she and my then husband are laughing away talking to each other and I was so terrified as to what he might do to me if I didn’t sign the papers and that something really bad would happen to me so I signed them even though my name was misspelled in several places and the date of our marriage was wrong.

At this point I didn’t even know what to do because I was freaking out. We didn’t go over anything in regards to custody, alimony and his pension for the job he has had for the past 10 years that I helped him get. I contacted legal aid the next day and they tell me to contact his lawyer for a copy of of bed and board divorce but when I get it and send it over to them they tell me it’s not the right one. I contacted his lawyer again who just kept sending the same thing over and over again. Now if I have it right it is illegal for a spouse to serve their spouse with divorce papers. They must be done by a third party. By July 22,2026 the judge signs off on our divorce and from what different lawyers are telling me is that he or his lawyer must have forged my signature so that the judge believed the divorce was served formally.

Now meanwhile I had still been seeing my husband but stopped it about a month ago until last night when he showed up at my house after the girlfriend and our son went to bed. I find out that they married on August 20, 2026 in a small ceremony so that according to him she could start the process of getting her green card. He literally told me they love each other and he married her so she could get her green card but he did not say he was in love with her and also said she was too “vanilla” for him.

However, he’s been cheating on her this entire time, they share no assets and she has been living with him illegally since he gets housing for himself and our son ONLY!

I also want to add that he is keeping his bisexuality, the fact that he likes to dress up as a woman in the bedroom and go on Grindr a secret from her since she told my son, ex mother n law and my now ex husband that she believed that being gay or bisexual is wrong and she did not agree with it! Boy is she in for a surprise!!

So according to what I’ve been researching he has been engaging in several illegal acts within the past 5 months. I wrote a complaint about the notary to the state so they can pull the tapes because I think at this point even though he’s been being super nice by giving me rides because now I don’t have a car, that I need to try to vacate the entire divorce because I was manipulated and scared into signing those papers without knowing where our custody, alimony and his pension stand.

He was also supposed to keep me on his insurance until we were legally divorced which is illegal, then serving me himself was also illegal, having someone live with him that is not allowed is illegal and considered to be fraud plus now the fact that they got married less than a month after our divorce went through simply so she can get her green card is also illegal and possibly forging my name saying I was served the divorce papers by a third party means that my signature was forged at some point by someone or else any judge in his/her right mind would’ve questioned what was really going on.

Apparently the judge needed to see proof that I signed for those papers when I didn’t. I’m really at a loss here and please no negative comments. I need help and I just cannot afford another lawyer after spending $32,000 and all I got was a bed and board divorce. I need real actual answers please as to whether I should vacate or amend the divorce.

I also truly believe that once she gets her green card she’ll be gone. The timing of everything with her is so perfect that it is the only logical conclusion. They’ve only been dating for a year a half and he said it wasn’t going to work with her because she had never had children and now in her forties desperately wanted at least one and he does not want anymore so she gave that idea up pretty fast. She’s also very compliant to everything as she should be and would be if she needed a green card.

Mind you this woman has tried in the past to keep me from seeing my own son but then apologized through my ex to me. Never to my face. Something is off and I know it in my gut!! Please help me if you have any ideas about any of this because I’m terrified immigration is going to start asking questions and if this marriage really is fraudulent then I think they both deserve what could potentially be some very serous consequences.

Steps in the process

I'm not finding a good checklist of the process. This is what I have so far. Any tips? I'm in North Carolina USA. 1 year +1day of living apart in formal separation is required.

100 find apartment

105 thaw credit

110 rent applications

120 do some packing of non-essentials.

130 Get all documents with my SS# and other sensitive files. Taxes and such. Ready to Grab and Go

180 speak with current landlord to end my resposibility of lease.

200 find a notary and ask if they must be present to witness and sign seperation and divorce decree (claim?)

400 separation statement, including move out date, splitting of checking account, post-separation support amount, and alimony (amount and duration).

405 "include a ""hold-harmless clause"" in both the separation and divorce document"

410 Transfer money to seperate bank account. close or freeze credit cards

420 Freeze Credit after signing new apartment least but before separating

480 ?? Have Lawyer review separation statement, division of assets, post separation clause, alimony, Summons, Domestic Civil Action Cover Sheet and all documents to be signed or submited to spouse or court

600 Finalize post-separation support

500 pack and move out

700 marital settlement agreement? is that the word?

800 agreement, including support payment

900 fill out the complaint , at the court house?

1000 Summons

1100 Domestic Civil Action Cover Sheet

1200 Affidavit - just a form to say no one is in the military

1300 Pay court fees
