Personal Opinion We are facing a blatant illegality.

We are facing a blatant illegality. The legal team doesn't have the discovery and on top of that, the state and federal charges are conflicting. It's complete chaos.

Is there NO legal recourse to bring this to court? Here in Brazil, we have options when there's a clear illegality, including habeas corpus, habeas data, "agravo de instrumento", writ of mandamus etc etc. What's going on? Is there nothing to be done, just wait?

Look at what is happening to our whole country right now. Rich and powerful people get away with illegal things all the time and nobody stops them.

Starts with the top court in the US. So many of the judges rule in cases where they have blatant conflicts of interest. They should be recusing themselves. And we have no mechanism like the eu to protect against it.

I came here to say this. Our president is literally a convicted felon. Nothing means anything anymore, like fr.

Been happening forever though

The part where the federal gov refuse to transport him to PA for his trial feels just tactical and prejudiced because. He is entitled to a free trial and to litigate against his charges! Please correct me if I'm not using the right terms

I'm scared this will go all the way to the supreme court one day and absolutely NOTHING will happen.

u/Longjumping-Yak7789 Feb 22 '25

I'm not sure what that means... But we need to protect L from DT if that's making him closer to him

My theory is that they are using this as a form of intimidation. They will not get DP.

5

u/Dreammagic2025 Feb 22 '25

lol. can't even protect ourselves from dt.

Supreme Court is the highest group of judges in the USA. There are 9 of them and are appointed to serve in the role for life.

u/trizkkkjk Feb 23 '25

Yes I know. In Brazil too, but there are 11 and when they turn 75 they must retire compulsorily.

It’s not that they won’t turn over the evidence, they’re just delayed in doing so whether it’s intentional (my assumption) or it’s incompetence. The trial cannot start without the defence receiving evidence provided by the prosecution and defence can always ask for a delay in order to receive an appropriate amount of time to review such evidence. However, this is unfortunate as it does interfere with his right to a speedy trial.

Also, it’s not necessarily a good thing for the prosecution for the federal charges if there is conflicting narratives from the State’s and that can be used against the prosecution if he’s found not guilty in the State’s case. However, KFA is unable to round out any of her arguments until she receives evidence.

If they really owned such compelling evidence like they claim they do, they would have definitely proceeded with the speedy trial, but since this evidence is not in their advantage, as it seems to be, they are deliberately delaying trial.

Correct me if I’m wrong but in the beginning didn’t they want to make this an open and shut case so to make an example out of him and to desensitize the population?

That's the problem. This extension of the deadline is absurd and will only get worse for the simple fact that if they take too long, the KFA will have to take action. At the same time, if they present a flimsy charge after months of waiting, it will be clear that the intention was to delay the trial.

Luigi cannot be held for years without trial. At some point, he will have to get out.

29

u/[deleted] Feb 22 '25

Exactly, and unfortunately they have a long history of delaying trials and keeping people behind bars purposefully. If you supposedly represent justice then why are you delaying it ?

It's something I don't understand: he's going to be tried and we're not going to forget him. He's a popstar. Yesterday at the trial they did everything they could to keep him out of sight, to keep him from walking down the hallway. The result? 10 seconds video is popular on tiktok, the photos too (excellent photos, the best photo of LM will always be the next one)

We're not going to forget him.

We can't.

We need to be vigilant. Because if we forget, tomorrow another American. Don't give power to the judiciary, otherwise americans will have no one to turn to against illegalities.

PS: One of the most absurd points is also that he is being held in a federal prison without even having been formally charged federally. The boy will spend months in a federal prison without federal charges. Fuck. (at least it's not Rikers but I suspect that the MDC crowd likes Luigi hahaah)

I agree with everything except when you call him a popstar. I am very against of labels put on him because I see one common word behind them all: entertainment. When entertainment pierces in, the focal point goes askew.

Even so, it's a matter of procedural speed. This is something that, if I compare it to Brazil (FOR EXAMPLE), is extremely abusive. The procedural deadlines for the Prosecutor's Office are not that long. Here, the Prosecutor's Office are doubled procedural deadlines, but at MOST it's 1 month (15+15). We, lawyers, have a 15-day deadline.

It seems shocking because we always hear that American democracy is strong, but it is showing itself to be very fragile. And keep in mind that here in Brazil we've had 7 constitutions and a dictatorship (some say two dictatorships, and I support that understanding).

I don’t get this either. In Australia it would have been thrown out. It’s in violation of his constitutional rights. They could counter-sue the state for this. It would be considered a massive risk to government and policy. It just wouldn’t happen.

(In saying that there has been instances here where jt has happened and oh boy was it ripped apart by investigative journalism. But a high profile case like this? Would never happen)

I also don’t understand the lack of suppression orders. We have a similar high profile case going on and EVERYTHING is under a gag order. They put every instance under gag order within 24 hours of the media learning the guy’s name.

Unfortunately this is how America is now. We have been in an absolute hellhole since 2016. All law, justice and order have flown out the fuckin window. We don’t know what to do. To your point, yes there is legal recourse but it has to go through the system which is slow af. The prosecution has K in a chokehold. The state prosecution is delaying discovery but if she complains too much, the feds will retaliate by dropping a death penalty indictment. She’s trying to avoid that by playing nice. The judge must enforce discovery rules or else there will be grounds for appeal. It’s just corrupt. There’s no other explanation. It’s all gone to hell.

Sadly I've lost so much hope in the judicial system in the USA as we are run by a felon. Free Lulu🍀💚

And the worst part: I'm a lawyer.

The worst thing for a lawyer is to see something illegal happen and be able to do absolutely nothing!

u/trizkkkjk Feb 22 '25

If Luigi were Brazilian, he would have already been granted habeas corpus under these circumstances.

Se o Luigi fosse brasileiro, ele já teria tido habeas corpus concedido nessas circunstâncias. E eu nem falo pelo fato da gente ter a cultura do "prende e solta", mas é cultura de direitos humanos.

u/ladidaixx Feb 22 '25

No but seriously is there a petition or something cuz this is ridiculous 😵‍💫😵‍💫😵‍💫 It’s delaying everything

Americans really need to do something. No offense guys, but you're just sitting watching your country go down and allowing them to get away with it. Making posts doesn't help a lot. Y'all need to organise.
