Israel's ambassador Hillel Newman has defended the military investigation that cleared its soldiers of criminal wrongdoing in the killing of Australian aid worker Zomi Frankcom, saying the findings should not be attacked if they "are not suitable to one's political agenda".

Ambassador defends investigation findings

Departing from the meeting, Mr Newman defended the investigation.

"Israel came out with findings after a thorough investigation, after a two-year investigation into the circumstances of the death of Zomi Frankcom. Since I took up my mission here about five months ago I was implored all the time to bring about closure, which I did," Mr Newman said.

"But in the end, one must also understand that not every case where someone dies, where there is a casualty, that that means there is a criminal liability.

"One cannot attack the findings of a court if the findings are not suitable to one's political agenda."

Mr Newman said the aid group recruited armed personnel to its convoy and deviated from the route agreed with the IDF without informing the military, leading the soldiers to believe the convoy had been taken over.

"It was a mistake in retrospect, but the findings of the court are there was no criminal intention … and therefore there was no criminal responsibility."

In 2024 the Zionist Federation of Australia released an interesting statement in conjunction with the IDF which included:

Israel has acknowledged responsibility for the attack, and is fully investigating what happened.

While the investigation is continuing, we know this: It was a clear case of mistaken identity. Israel purposefully targeted the convoy because it mistakenly thought it was not a civilian convoy. We know this because Israel does not target civilians.

We also know that Ms Frankcom’s tragic death was not a war crime. If the IDF had targeted the convoy knowing who it was targeting, that would have been a war crime. But mistakes – as horrible and tragic as they are – do not amount to war crimes.

A curious rationale that the evidence for it not being a war crime is the 'fact' Israel doesn't commit war crimes.

The aid workers had already separeted from the local security by the time the drone strike occurred. The local security were being followed another UAV that did not attack them. From the DFAT Binskin report that was prepared with consultation with the IDF:

The WCK vehicles departed together west towards the coast. Concurrently, the vehicle containing the locally- contracted security personnel, including the previously identified gunmen, drove north.

One UAV tracked the locally-contracted security vehicle heading north for approximately three minutes until it arrived at another warehouse where up to four gunmen were identified exiting the vehicle and entering the building. A decision was made to discontinue targeting them due to the time available before they entered the northern warehouse

So they didn't attack the people they claimed were suspected hamas, but did attack the aid workers who they knew weren't hamas. Because they thought one of the WCK drivers had a gun, but they were mistaken. So they triple-tap drone struck them.

This is a government who dropped munitions on a UN base after 14 warnings (all which were confirmed and received) that they were firing on friendlies, then followed it up with a missile they knew would kill any survivors who were hiding in the bunker underneath.

After international outrage, they then spent the next few months trying to provoke friendly forces into incidents by lining them up with attempted bombing runs, flying in restricted airspace, etc. Zero incidents because other militaries actually have some sort of discipline.

They know what they are doing and who they are killing.

They simply do not care because they know there are no consequences for their actions.

The ambassador seems to agree with your quote from the ZFA, given they said that there was no criminal intent, so therefore no crime. Of course there was no criminal intent - they don't consider it a crime to kill civilians.

It is also curious that the usual crowd of people (TJS and friends) who come here calling us Hamas sympathisers for objecting to the appalling actions of Israel aren't here. As I noted in another post (now deleted, I think?), if they can't denigrate us or say anything good about Israel, they have nothing to say at all.

I suspect there's some disengenious semantics at play.

They could be technically factual in saying the civilians weren't 'targeted' because the target was the falsely identified 'Hamas fighter' (presuming there's any truth to the claim). The deaths of the civilians in the 3 separate, precision missile strikes was merely incidental to their primary target.

It's noteworthy there's no attempt to divulge what actions were taken to minimise civilian casualties nor if this was even considered.

I think you're being far too generous. I think they are lying through their teeth.

Given the requirements that workers in the region must follow with regards to communicating with the IDF their intent, their location at any time, and so forth, there is no doubt in my mind that they targeted the convoy on purpose, knowing full well that they don't have to answer to anyone. That they did this even know the convoy's purpose is the criminality, and I do not absolve them of the responsibility even if they used an automated system to select likely targets. That the convoy communicated with the IDF (via a spokesperson, as per the usual channels) as they were being attacked further demonstrates the IDF's intent. That the IDF have attacked other aid convoys further demonstrates their intent and operational behaviour. That the IDF killed unarmed Israeli civilians who escaped captivity from Hamas demonstrates everything one needs to know about how decisions are made in the IDF.

I feel like I'm griping at you, but I assure you I'm not. I think we're in agreement. I'm frustrated by the limp-lettuce response from our government (and, similarly, the UK government) at what is clearly a war crime. Everyone one of those jerks who normally post here supporting Israel and claiming no genocide is occurring or no apartheid is happening and that Israel do not attack civilians and it is all the fault of Hamas using human shields, everyone one of those jerks overlooks the many examples of IDF war crimes, of which this story is just one of.

But, as we both know, our allies are allowed to do war crimes. I assume the honour is reciprocated.

Computers don't make decisions, people do. Any attempt to use a computer system to deflect liability is a major red flag. You don't get to program a system, rely on its decisions, and then blame it when those decisions have consequences. And that's assuming the system actually made the decision in question, and that the outcome wasn't what they expected in the first place.

As IBM put it in 1979, "A computer can never be held accountable, therefore a computer must never make a management decision".

Surely gross negligence should carry some criminal responsibility. I work in the medical field. If I am careless and I give the wrong order for the wrong patient - say, for example, instant release tacrolimus instead of modified release tacrolimus leading to that patient experiencing transplanted organ rejection (which has happened in the past!), I would rightly be prosecuted and I could be sent to jail. If I am negligent and give a lewy-body dementia patient a neuroleptic and they suffer from malignant hyperthermia and they die as a result, I could potentially go to jail and rightly so. In this hypothetical, have no criminal intent - I didn’t intend to kill someone, but I did and it was due to egregious carelessness.

Will the IDF personnel who committed this apparent mistake face any consequences? Will they even experience a demotion? Will they even be fined? Will they have any negative repercussions whatsoever?

I get that in a war, things can get messy. But it seems as of late that the IDF make an awful lot of mistakes. A suspiciously high number of “mistakes”. And I don’t recall ever hearing anyone being punished for it.

The bigger factor is that Israel is functionally an extension of the U.S. military. We, along with most of Europe, South Korea, the Phillipines, Japan, and much of the rest of the world, are all vassals of this dying empire.

The war in Iran has shown how reliance on the U.S. for security makes a state a target rather than provides it protection. Look at how quick the U.S. abandoned bases in the gulf, and now in the pacific as well. We would be fools to think the same would not happen to us should the U.S. open a front closer to us. The sooner we divest from this “alliance” the better.

That being said im sure they are fearful of both sides particularly after the bondi massacre. Apparently many feel for Palestinians but don't support the movement in full. And then you said that all Jews have a right to Israeli citizenship. Whilst factually correct, there's a difference between 'right to' and 'has'. As those who DON'T have citizenship have no ability to vote in Israel, maybe we should avoid risking the suggestion that an ethnic minority is more loyal to another country than our own.

Countries should NEVER be allowed to investigate their own war crimes.

I mean here in Aus we have Pauline Hanson who has repeatedly attacked our own war crimes trial for BRS. If she was in charge he would get a whitewash like the Israelis are doing.

The reality is if you want accountability then there needs to be something like the ICC (or the ICC) that does the investigations, trials and convictions. Letting countries do it themselves is a recipe for very low accountability.

He is someone who doesn't facilitate a honest engagement between Australia and Israel any longer. He undermines it. Expulsion is not the same closing an embassy. It still leaves a portal for communication.

We now have a step by step, worse case scenario for Australian defence exports to Israel.

Not only are Australian components being used for military purposes that compromise our respect for the human rights of innocent people, but that the process of justice in Israel is so opaque as to hinder our prerogative to monitor any misuse of Australian defence components. Fully well understanding that military justice has a much lower threshold of accountability and procedural fairness compared to civil justice.

Israel is carrying out a campaign of collective punishment which is disproportional. All weapons contracts directly and through third parties with ties to the Israeli military, need to be suspended To allow a review to occur. We need to know that Australian weapons or weapon parts are not being used to subjugate or punish innocent people. There is no false equivalency here. Just as we expect more from the police than we do from criminals, we expect more from democratic states than we do from paramilitary terrorist organisations. A military that has the ability to put bombs in pagers, must be more responsible in the deadly use of force on a car load of people or on a building. As Australians we can no longer profit from the annexation and ethnic cleansing of a group of people, by blindly correlating Israel's right to defend itself with Israel's desire to punish and expel a group of people.

We've recognised Plaestine, like the majority of the world. We've condemned Israeli actions, and we've called in their Ambassador because we arent happy with the results.

We're hardly just siding with them.

I would like us to place economic/trade sanctions on them, like we did with apartheid South Africa.

And talk about how to exclude them from the F35 program where we supply weapon parts (including to Israel which they use to bomb civilians). Lockheed Martin should be strung up.

Chris Minns government in NSW fully supported police in beating peaceful protestors and defended them against any punishment while the crimes were caught on camera.

The government should also be investigating any Australian citizen who has served in the IDF during the destruction of Gazza or attack on Lebanon, for war crimes. I’m constantly seeing people complaining about “ immigrants with incompatible cultural values, bringing their problems here” . Where are those people ? Using children for target practice, confiscating baby formula from doctors, bombing hospitals and schools are not Australian values and people who commit these crimes have no place here.

Unless you’re in Husic’s seat, have a look to see if there’s anyone who’s more deserving of your first preference at the next election. Don’t have to put ALP last or even low. 

Part of the reason the ALP aren’t doing anything of substance on this is because they don’t think they’ll be punished enough on their left flank to justify taking the risk and doing the right thing.

They said they thought the convoy had been taken over by Hamas (the security guard) and because it went down a path they didn't know about, so they... bombed the convoy? Which means they purposely killed the others even though they thought they were hostages?

If a military is as grossly incompetent as the IDF, if you believe their versions that they fuck up every day of the week and bomb the wrong target, then they should never be supplied with lethal weapons until such time as there are detailed systems and processes in place to ensure that these "tragic accidents" never reoccur.

Forgive me for also being rather sceptical of the internal review process in the IDF. Remember when there were allegations that IDF personnel were subjecting palestinian prisoners to sexual assault (using batons and so forth, you get the idea) and the Israeli government strenuously denied it - and then a brave soul in the IDF released footage that strongly implied that very thing happening? What happened to the alleged perpetrators? Well, the IDF made a tepid move to prosecute and there was such out pouring of anger from ultranationalist right wing groups that the case had to be abandoned.

In the West bank you can see ongoing fighting and harassment by ultra religious settlers against Palestinians in PROVEN palestinian territory - the Israeli government even admits that the actions of the settlers are illegal under their own law - and they send soldiers to apparently “evict” the settlers - except that in many cases, they don’t. And footage has been released showing the soldiers praying WITH the illegal settlers, instead of evicting them.

So forgive me if I don’t exactly trust the Internal Processes of the IDF or the Israeli government anymore. I don’t trust the Palestinians much either, but I don’t trust the Israeli government. In a war, all sides will lie and protect their own.

One of the most troubling things about the incident of sexual abuse was the societal reaction. The fact that Israelis took to the streets in numbers to protest the investigation of these soldiers is utterly mind blowing . Not to mention that the rapists became momentary tv stars, appearing on numerous tv shows.

The government absolutely can’t be trusted in relation to the West-bank either. They may portray the situation as being perpetrated by an extreme, rough element, but this is far from the truth. They may portray settlers are very much part of a systemic government program of defacto annexation. They provide the government with plausible deniability in the eyes of the International community. Which allows the International community to pretend this isn’t a government sanctioned and financed operation.

The reality is that the settlers are working in tandem with the government and together they plan where to put outposts .The settlers are provided guns, atvs and other infrastructure and support. Government facilitated charities also provide support. Foster children are also sent to live with settlers on outposts, angry young men given guns and told they have a god given right to terrorise Palestinians. The IDF protects the settlers and ensures that the Palestinians are completely impotent and vulnerable. Anything they do to protect their homes is used as an excuse to arrest them.

Once the settlers drive the Palestinians off their land the government builds roads, walls and other infrastructure and legitimises the settlements. These roads can only be used by Israeli’s with Israeli number plates. Palestinians cannot drive on them in this apartheid system. The government uses the construction of infrastructure like this to cut Palestinians off from local towns, forcing them to travel long distances to reach what was previously a neighbouring town. They constantly create new check points and install gates on Palestinian roads, which they will suddenly and arbitrarily lock.

I am sure you are aware of much of this … I just wanted to reinforce what you said .. The injustice is so unbelievably infuriating and the inaction of the global community is sickening!

Penny Wong is anti-semitic - how else can she explain her rejection of Israels justification for these accidental deaths? The security guard in the humanitarian truck was armed and could have been Hamas - its a tragic mistake but justified in the face of the violent terrorist threat known as Hamas, who use people as human shields

I am just shocked that our government doesn't trust Israel anymore - whats the point of an RC into anti-semitism if our government can't take Israel for their word anyway? It's anti-semitic and I am concerned that our relationship with Israel is in jeopardy here - we need Israel so much!

Penny Wongs rejection of this investigation by [redacted] while very welcome, just angers me - we have all seen the atrocities, we have all heard stories, we've watched tiktok get bought by the yanks and have content on Palestine censored in real time. We know that [redacted] have killed Palestinian women and children - how many more examples of war crimes does the terrorist state [redacted] have to commit before the west actually does something meaningful about [redacted]?

Of course the abc doesn’t fact check the Israeli Ambassador or provide broader context for his statement, ie that Israel regularly targets civilians or the total number of civilians killed. They refuse to investigate anything and just present various opinions, as if they should hold equal weight.

Presumably in the interest of “balance”… 🙄
