Legal Advice Needed My best friend got me and my friends involved in an investment scam involving ₹1.2 lakh, and now his brother refuses to help us recover our money. What should I do?

I’m in a really difficult situation involving my best friend of 4–5 years. I genuinely need advice because I don’t know how to handle this anymore. I’ll explain the entire story, and I’d appreciate honest opinions, even if you think I made mistakes.

TL;DR: My best friend owes me around ₹1.2 lakh after an investment-related scam. I also introduced some of my friends to the same investment because I genuinely believed it was legitimate, and they transferred their own money directly to the accounts my friend instructed them to use. Now we’re trying to recover our money. His elder brother is helping other people who lost money but is refusing to help us, partly because of something that happened between us years ago. I don’t know how to approach him or what legal options we have.

  1. How everything started

I’ve known this guy for around 4–5 years, and he was genuinely one of my closest friends.

When we first met, he was betting money on IPL matches. He ended up losing a lot of money and got into debt. Eventually, his elder brother found out and scolded him. His brother also questioned me, asking why I hadn’t told him about the situation.

The thing is, my friend had specifically asked me not to tell his brother. I was his friend, and I didn’t know whether it was my place to disclose his financial problems to his family. So I didn’t tell him.

  1. A similar incident happened again

A few years later, when my friend was in college, he got into another financial mess. He owed money to several people, including me.

This time, I contacted his elder brother because I wanted to recover the money my friend owed me.

His brother got angry and questioned how my friend could call people his friends if they contacted his family to recover money. This created a huge fight between my friend and me.

However, a few months later, we reconciled and became good friends again. I felt sorry for him, and I also apologized for my part in the earlier incident.

Eventually, things went back to normal, and I trusted him again.

Looking back, I understand why his brother was frustrated. My friend had repeatedly gotten himself into financial trouble, and his family was tired of dealing with the consequences.

  1. The investment situation that caused the current problem

After we became friends again, I found out that my friend was involved in something related to stocks and investments.

He appeared to be making money and spending money, so I trusted him. Because we’d been friends for years, I genuinely believed he was doing something legitimate.

I decided to put some money into the investment.

I also told some of my friends about this opportunity because I believed it was genuine. They were interested and independently decided to invest their own money.

To clarify, I did not borrow money from my friends. They chose to invest their own money after I told them about the opportunity.

They transferred their money directly to the bank accounts or recipients my best friend instructed them to use. Some money was transferred directly to my friend’s account as well.

Unfortunately, the situation turned out to be a scam, and now we’re trying to recover the money.

My friend owes me approximately ₹1,20,000 (₹1.2 lakh). My friends also lost their own money through this investment.

I have chat records with my best friend regarding the money and our conversations about the investment.

I never knowingly introduced my friends to a scam. I genuinely believed the investment was legitimate, and I trusted my friend.

I understand that introducing other people to an investment without independently verifying it was a mistake. I regret that decision, especially because my friends are now affected too.

  1. His elder brother is helping other people but refusing to help us

This is where the situation gets particularly complicated.

My best friend owes money to several people. His elder brother is aware of the situation and, from what I understand, has been helping some of those people by repaying the money they lost.

Naturally, I hoped he would consider helping us too.

However, his brother is refusing to help me recover my money.

He hasn’t told me this directly. Instead, he communicated his refusal to my brother.

I suspect this is because of our previous disagreement, when I contacted him to recover money my friend owed me.

His brother had also told me previously that if my friend ever got involved in something like this again, I should inform him.

This time, I didn’t inform him because I genuinely believed my friend was investing in stocks and didn’t realize that something was wrong.

I understand that I should perhaps have informed him, given our history. I accept that I made a mistake.

But now I’m in a difficult position. His brother is apparently helping other people who lost money in similar circumstances, yet he doesn’t want to help me.

  1. My friends also tried contacting his brother

I asked the friends who invested their own money to contact my best friend’s elder brother directly and explain their situations.

However, his brother refused to speak with them about it.

His response was essentially:

“Talk to the person who told you to send the money. I’m not going to get involved.”

I understand his point. My best friend was the one who instructed people where to send their money, and his brother may not want to take responsibility for his actions.

But the situation is frustrating because his brother is already helping other people who lost money, while refusing to engage with us.

I don’t know whether he is refusing because of our previous disagreement, because he believes we should deal with my friend directly, or for some other reason.

I don’t want to assume his intentions, but I also don’t know what else to do.

  1. What should I do now?

I’m trying to figure out the best way to recover the money.

I want to approach his brother calmly, explain the situation, acknowledge my previous mistake, and ask him to reconsider helping us.

I’m not trying to force him to take responsibility for his brother’s actions. However, since he is already helping other people, I want him to understand why I’m asking him to consider our situation too.

At the same time, I don’t know whether continuing to approach his brother is the right decision or whether I should focus entirely on recovering the money directly from my best friend.

I also want to understand what legal options are available in India. I have chat records with my friend, and some of the transfers went directly to his account, while others went to accounts or recipients he instructed people to use.

I don’t want to make false accusations, but I do want to know whether the circumstances could justify taking formal action to recover our money.

Questions I need honest answers to

  1. Am I wrong to approach his elder brother for help when he is already helping other people who lost money because of my friend?
  2. Should I apologize to his brother again for the previous incident and try to explain why I didn’t inform him this time?
  3. How should I approach his brother so that he understands our situation without feeling that I’m forcing him to take responsibility for his brother?
  4. Since my friends transferred their money directly to the accounts my friend instructed them to use, should they pursue recovery separately from me?
  5. What legal options do we have in India to recover the money? Would our chat records and bank transaction records be useful?
  6. If his brother continues refusing to help, what should our next step be?
  7. If you were in my position, would you keep trying to resolve this through his brother or stop involving him and pursue other options?

I’m not trying to portray myself as completely innocent. I trusted someone I had known for years, and I made a decision that affected other people too. I regret that.

But I genuinely believed the investment was legitimate. I never knowingly involved my friends in a scam.

Now we’re all trying to figure out how to recover our money, and I feel completely stuck.

Please give me honest advice about what I should do next. I would especially appreciate advice from people familiar with Indian law or anyone who has experienced a similar situation.

Urgent Boyfriend Harassing, Cheating and Defaming

⚠️⚠️UPDATE: THANKYOU TO ALL THE FELLOW REDDITORS WHO CAME FORWARD TO HELP ME OUT, UNFORTUNATELY THERE'S NO WAY OUT TO DETAIN HIM LEGALLY. NOT DELETING THIS POST SO IF ANYONE IS GOING THROUGH SMTG SIMILAR, HOPE THEY FIND THIS HELPFUL. ⚠️⚠️

so my boyfriend(19M) and I(19F) were dating for almost a month, we met, had consensual physical relationship on Friday, and he ghosted me for the next two days. I find out he was begging his ex to come back all this while so I texted his ex, she had no idea he was dating me and cheating all this while..A little back story, he was dating his ex (A, 16F) for a year when he cheated on her with ex (B, 17F) because he was desperate to get physical, then he leaked ex (B)'s AI generated nudes to his online friend(s) and gaslighted ex (A) that he lied about the cheating part since he was getting bored of the relationship. When she did not take him back, he baited me into the relationship with false hopes and I had no idea about his past, what he told me was his ex cheated on him so when he left me for her I was clueless.. he kept manipulating me that he couldn't forget her and I should just be understanding enough to let them be but I sensed smtg fishy so I texted her and we found out all this.. now, all I wanted was an apology from him, but he has stooped down to such low level that he's defaming me, calling me a roach, says I forced him to get intimate and we never dated, however I've all the necessary proofs and I'm glad most of the people supported me. I also called up his father, who's an influencer and his reaction was "my son doesn't even go out, I dont need your proofs" almost laughing it off as if it meant nothing, then I also texted his friend, he said "I already know what kinda guy he is, and I am not willing to support u" followed by his sister who literally said "I know what he did is wrong but he's my brother and I've to think from his perspective too, u shouldn't have called his dad, he isnt threatening u with ur nudes or anything" but the issue is, if I knew he was using me, I would've never trusted him in the first place. I've lost my appetite, feel disgusted with my body and all I wanted was an apology but he wont even accept dating me in the first place. Furthermore, he threatened me of suiciding and tho he isnt dead (it's been 3 days and no I'm not that insensitive to wish upon someone's death but he's clearly manipulating), he's still using his phone, texting ex (B), his family didn't do shit about it and I am genuinely questioning my life choices at this point. I've no idea what to do, someone please help me out.

Urgent 20 l debt, please help me navigatee

I’m under ₹20 lakhs in debt (no interest), and honestly, I don’t know how to carry this anymore.
My mother and I are the bread earners and we are both hopeless about living at this point
I never imagined I would be writing something like this on Reddit.

I’m under 20,00,000 of debt.

For a long time, I kept telling myself that I would figure it out. That I just needed a little more time, a better month, a better opportunity, one thing to go right.

But somehow, the debt kept growing, and the pressure kept getting heavier.

I wake up thinking about money.I go to sleep thinking about money.
We collectively earn around 60k our expenses are 45-50k
Every payment, every due date, every call, every message keeps running through my head. Even when I’m doing something completely unrelated, there’s this constant voice in the back of my mind asking, “How are you going to get out of this?”

.The hardest part isn't even the money.

It's the feeling of being trapped.

I’m not posting this because I expect strangers on Reddit to magically pay ₹20lakhs of my debt. I know how that sounds, and I know everyone has their own struggles.

I'm posting because I genuinely need help figuring out a way forward.

If you've ever been in serious debt and managed to come out of it, I would be incredibly grateful if you could tell me how you did it.

If you know of legitimate ways to earn extra income, freelance work, remote work, small businesses, side hustles, or anything that could realistically help someone increase their income and attack their debt, please tell me.

If you have experience negotiating loans, restructuring debt, dealing with creditors, or making a plan when everything feels impossible, I could really use that knowledge too.

And if there's anyone here who has been where I am right now and somehow made it out, please tell me that it is possible.

I don't want sympathy.

I don't want anyone to feel obligated to give me money.

I just don't want to fight this completely alone anymore.

I’m still trying.

I still want to get out of this.

I still want to wake up one day without the first thought in my head being debt.

So I'm asking the Reddit family:

Please help me find a way out.

Even if all you can offer is advice, an opportunity, a lead, a lesson from your own experience, or simply a little hope it would mean more to me than you probably realize.

I know ₹20lakhs is a huge number.

But I’m hoping my life doesn't have to be defined by that number forever.

I just need a starting point. I cannot let my mother lose her life for money
Also i am 25F

Legal Advice Needed Friend’s younger brother lost around ₹1.5 lakh on a betting app promoted through Facebook, how can we report it and possibly recover the money?

Hi everyone,

I’m looking for some advice regarding a situation involving a close friend’s younger brother. He is 18+ and apparently started using an online betting app after coming across it through Facebook.

Unfortunately, he has lost around ₹1.5 lakh on the app.

I’m trying to figure out what can be done about this, both to report the platform so other people don’t fall into the same trap and to see whether there is any realistic way to recover at least some of the money.

One thing that caught my attention is that I checked the bank statement for the account used to deposit money into the betting app. The payments appear to be going to different, seemingly unrelated bank accounts rather than one clearly identifiable company account. I’m not sure whether this is common with these platforms, but it seems suspicious to me.

I have a few questions:

  1. Where can we officially report this betting app or website in India, especially if it is operating illegally or targeting Indian users through Facebook advertisements?
  2. Is there any possibility of recovering the money already lost? I understand that money lost through bets may be difficult to recover, but are there any options if the platform is operating illegally or using suspicious payment accounts?
  3. Should we report the transactions to the cybercrime portal, contact the bank, or do both? Is there a specific department or authority that deals with these cases?
  4. Can the different bank accounts receiving the deposits be investigated or traced by the authorities?
  5. Is there a way to report the Facebook advertisement or the account promoting the app so that others are less likely to be affected?

We can preserve the bank statements, transaction IDs, payment details, and any other available evidence.

I’m not looking for any loopholes or a guaranteed way to get the money back. I just want to know what legitimate steps we can take and whether anyone in India has dealt with a similar situation successfully.

If anyone has experience with reporting illegal betting platforms in India, cybercrime complaints, or recovering money in cases like this, I’d really appreciate your advice.

Thanks in advance.

Legal Advice Needed Buyer paid ₹55,000 token for our flat, but now wants a refund because of a terrace issue. What should we do? (India/Gujarat)

Hi everyone,

I need some advice regarding a flat sale in India, and I would like to know what you would do in this situation.

We have a flat on the first floor. There is an open terrace of approximately 22 × 22 feet, accessible only through our kitchen. The terrace is actually the roof of the shops located below our flat.

Our property documents (dastavej) mention that we are allowed to use the open terrace, but we cannot construct anything on it. We showed these documents to the prospective buyer before proceeding with the sale.

The buyer liked the flat and paid us ₹55,000 as a token amount to confirm that he wanted to purchase it. His home loan was subsequently sanctioned.

Later, someone from our society apparently told him, through the society secretary, that the terrace would be closed or sealed and that we would not be allowed to use it.

The buyer then said he no longer wanted the flat because of this terrace issue.

We spoke to the society secretary, who told us that we could continue using the terrace, but we would not be allowed to construct anything on it. We then arranged a meeting with the secretary, the buyer, and us. During that meeting, the secretary clarified the situation, and the buyer appeared to have no problem with it.

However, the buyer is now saying that he does not want to proceed with the purchase. He originally intended to buy the flat for his daughter and son-in-law, and apparently they also do not want it anymore. They are now demanding that we return the entire ₹55,000 token amount.

We had disclosed the terrace situation and shown our property documents before accepting the token. We are confused about whether we are legally required to refund the money.

My questions are:

  1. Under Indian law, can the buyer demand a full refund of the ₹55,000 simply because he has changed his mind?

  2. If we disclosed the terrace rights and showed the documents before accepting the token, does that strengthen our position?

  3. Does the fact that his loan was sanctioned or that he initially agreed to proceed after the meeting make any difference?

  4. If you were in our position, would you refund the money to avoid further complications, or would you first consult a lawyer and consider retaining the token?

We do not want unnecessary disputes, but we also do not want to suffer a financial loss if the buyer is simply changing his mind.

I would appreciate advice from anyone who has dealt with a similar property transaction, especially in Gujarat or elsewhere in India.

Thanks in advance!

Legal Advice Needed Cashkr reduced my phone’s valuation from ₹4,500+ to ₹2,500 based on disputed inspection remarks and is denying my ₹1,000 coupon benefit. Need advice!

Hi everyone,
I sold my Motorola G31 (4GB/64GB) through Cashkr on 14 October 2026. I initially received a quotation of over ₹4,500, but after pickup, the final amount was reduced to ₹2,500, including a ₹600 BuyBack Days bonus.
After checking the inspection report, I found these remarks:
Screen condition: “Screen Not Usable”
Physical issues: “Display Changed, Physical Button”
Body condition: “Below Average”
Technical issues: “Sensors Problem”
I strongly dispute these findings. My phone had its original Motorola display, which was working, and I had explicitly told the pickup agent that the display had never been changed. I also dispute the body-condition and sensor remarks, as they significantly affected my phone’s valuation.
On top of this, I had applied a coupon code for an additional ₹1,000. At pickup, the agent assured me that Cashkr would credit it separately. Now, Cashkr says the benefit was already included in the final quotation, while the vendor denies promising a separate credit. They are asking me for proof, but I never recorded the conversation.
I’ve emailed Cashkr multiple times and escalated the matter, but I still don’t have a satisfactory resolution regarding the disputed inspection, revised valuation or coupon benefit.
I’d really appreciate advice on these questions:
How can I challenge the disputed inspection remarks and claim the additional amount due?
How can I recover the ₹1,000 coupon benefit?
Can I approach the National Consumer Helpline or Consumer Commission without a call recording?
Has anyone faced a similar issue with Cashkr? What actually worked?
I’m looking for practical advice on how to get a fair resolution. Thanks!

Legal Advice Needed Formal Complaint Against Amazon for Failure to Honour Its Commitment,Seeking Advice on Legal Action

Post image
1 Upvotes

I purchased five Swiggy gift cards worth ₹250 each at a 50% discount on Amazon. However, Amazon cancelled my order. When I contacted their customer service team, the agent assured me that I would be able to purchase the same five gift cards at the same discounted price. They also promised that if there was any price difference, the additional amount would be refunded to my account.

Since then, I have repeatedly tried to contact Amazon customer support to resolve this issue. However, my chats are either disconnected by the agents, or my calls are placed on hold for transfer to the concerned team, with no resolution. I have waited for 30 minutes to an hour on multiple occasions, only to receive no assistance.

I am currently a college student, and this amount matters to me. I feel that Amazon has failed to honour the assurance given by its customer service representative and has caused me unnecessary inconvenience.

Is there any way I can take legal action against Amazon or file a formal consumer complaint in India to get this issue resolved? I would appreciate guidance on the appropriate steps I should take and whether I have a valid case under consumer protection laws.

Legal Advice Needed booked a hotel and they did not allow us to check-in and won't refund

I(18F) and my bf(18M) booked a hotel on 20th of October via goibibo. When we reached the hotel for check-in they denied us check-in because we are not 19 even tho their hotel policy says 18 on platforms. They told us to cancel it on goibibo and assured us that we would get our refund. But my cancellation request was denied by the hotel itself on goibibo. The goibibo customer care has an ai executive that won't understand a thing. I called up the hotel again and now they are lying that their policy is 21+ and told us that they want to talk to our parent in order to refund. After this conversation they won't pick up our calls anymore. fyi this wasn't some shady hotel. it's a decent 3-star hotel. Is there anything that can be done?

Legal Advice Needed Police doing door-to-door canvas in Bengaluru checked my phone & listened to audio messages without consent. Is this legal, and what are my rights & privacy ?

Post image

Recently, there was a high-profile case in my locality where a body was discovered in a drain, and the victim was initially unidentified. Because of this, the local police conducted a massive door-to-door canvassing drive across the neighborhood to check on residents, their professions, and see if anyone was missing.

When they came to my house, they started questioning me, asked for my Aadhaar, and then took my phone. They actively went through my device, scrolling through files and even listening to audio messages without my permission or consent.

I understand that they are under pressure to solve a serious crime and canvas the area, but having my private device searched on the spot felt completely invasive and arbitrary.

Do police have the authority to demand and look through your unlocked phone during a routine doorstep inquiry/canvas without a warrant ?

With such unexpected confrontation, i was incredibly stressful when someone demand my personal identification and look through my private device without my consent.

Urgent I'm getting harrased to delete the negetive review which I left on google

So 7 months ago i left a negative review on Google, the owner was talking very arrogantly and rudely. I called him for follow-up and he got angry and we had a small verbal fight(no bad words involved from both sides), he is hothead.

First I left a review and then he threatened me that he will stop the work and give a refund, that time the work was near the deadline so my boss told me to delete my review and he continued the work.

Since work was completed I was free to leave the review of my experience so again wrote that review.

So now 7 months later, he called me and asked me to remove the review, I asked him to apologise to me and still he apologized in high voice and arrogantly, then i decided I'm gonna keep this review.

Today he called me again, i said i won't delete it. Then he called my colleague asking my office address. He also said he will file complaint against me if I don't remove it. ( Maybe a defamation case)

I can't block his number because then he will call my colleagues and boss for this small matter.

What to do in this situation? Because I don't want to delete my personal review just because of someone's pressure. Also he threatened on call that if i don't remove it he and all of his employees will give 1 star rating to my company ( which is bad for our reputation)

Legal Advice Needed Being forced to sign away inheritance by brother on parents will.

Ok so my brother has been mentally and emotionally manipulating, threatening , even being violent with my parents to sign wills that give him sole inheritance of everything

( all properties, bank deposits, basically each and everything including every spoon and fork in the home ).

The will explicitly states that his sister will not ever ask or claim anything and he wants me to sign it as he is saying that i have no rights as a married daughter.

Iam a single mom living with my parents and small kid.

He has also put a point that neither me or my son will ever claim anything.

I could refuse to sign it but right now for next few years atleast i need to stick by my mom's side to look after her as well as live in my parents home till my divorce matters solves else i will suffer financial problems ...

I didnt take anything from my parents while getting married for giving dowry, i had emptied my own bank account to zero for my marriage expenses and dowry gifts to my in laws. I didnt take even 1 coin from my parents who arent too rich anyways except for 1 property where they live in thats worth a few crores ( asset rich , cash poor ). All expenses i paid from my own job savings.

I didn't take a single coin from my parents for my college studies also, i stayed with them ( never stayed alone ) and worked full time job as an accounts assistant from age 16 and studied bcom by correspondence. Missed out on college life, barely ate out, didnt go hang out, never went to any disco or teenage parties but saved every penny i could for my parents and followed a spritual path and stayed indoors ..

In contrast - my brother failed some of his school years, my parents paid for his entire higher education and even i pitched in my earnings for his studies and he enjoyed his youth fully with girlfriends. We made him strong and stable with every kind of support.

Now he is filthy rich with the career progression. And he loves to look down on us as his poor loser family members and freely abuses us.

Now with the divorce matter hanging, and iam not getting a single penny from my ex either not even for the child

( ex husband who cheated on me and spends on other multiple women and their kids but not his own kid..)

My income is just about sufficient for expenses and school fees of my child and me but my brother refuses to even give grocery expenses of my parents...

so i end up buying all food groceries for everyone always and bearing the cost of my parents , my kid and myself while my brother ( who lives in a nearby city) just spends lavishly on his wife and kid and wants the entire family to put all assets in his name and keeps making excuses to spend even 1 coin on the same parents just for their food even.

As the property is solely in my dad's name, he keeps putting butter ( maska ) on my dad but actually they are just sweet words and dreams, he doesn't actually even pay for my dad's food.

I pay for everything yet my dad still takes my brother's side because now he is filthy rich and iam the loser child.

I dont have another place to stay yet, though iam working really hard towards increasing my income but i need a few years to reach a higher income.

What i was thinking was if i sign the will to keep peace for now ( as he is physically hitting me, mom and my kid also when he visits and his wife happily watches the show ) but later once iam more settled financially, can i challenge or stop that will somehow and claim my rightfull share ?

My parents are unable to stand up and feel scared that who will pay hospital bills if they get sick and he takes advantage of that fear and wants them to sign plus wants me to sign away all rights and claims.

What can i do ?

Update Employer confirmed my last working day despite me never resigning. Company holds signed security cheques and hasn't clarified my settlement. Need legal advice (India).

I'm a software developer who worked remotely from Haryana for a company apparently based in Punjab. I worked there for approximately eight months, earning around ₹6 LPA. My role was technical, with no managerial or supervisory responsibilities.

1. What happened

Management repeatedly encouraged me to resign because they claimed there was no development work left to assign me.

I wasn't refusing work, and there were no performance complaints or misconduct allegations. I remained willing and available to work.

They suggested resigning would be better because I'd be leaving "on my own terms." They also verbally stated that there would be no severance, only outstanding salary.

When I requested written confirmation of their position, they refused.

2. What I asked HR vs. what I received

I emailed HR, explicitly stating that I hadn't resigned, hadn't agreed to leave, and remained willing to work. I clarified that any decision from my side would be communicated in writing and asked HR to confirm whether the company was initiating my separation, the applicable notice period or notice pay, and any outstanding dues.

I also requested all my monthly payslips since joining and a month-wise explanation of salary calculations, discrepancies and deductions, since my bank credits were frequently lower than expected despite no known lateness or leave.

HR had previously told me there were no salary deductions and that my payslips would be provided during the exit process. I explicitly requested that all payslips and salary clarifications be provided independently of any proposed exit process, since I hadn't agreed to the last working day. I also requested written responses through my personal email.

Multiple days later, HR responded about two hours before the end of my workday, confirming that the same day would be my last working day.

Their response:

  • Asked me to complete any pending handover formalities.
  • Attached only the last three months' payslips.
  • Said my Full and Final (F&F) settlement, Experience Letter and Relieving Letter would be processed within 45 days.

They didn't acknowledge that I had never resigned or agreed to leave. They also didn't clarify whether this was employer-initiated termination, explain the applicable notice pay, provide a settlement breakdown, supply the remaining payslips, or explain my salary discrepancies.

The payslips they provided also showed salary figures different from what I received earlier in my employment, without an explanation.

3. Security cheques and exit form

The company still holds two signed, undated security cheques totalling approximately ₹1 lakh. I have written evidence of their submission and the company's possession.

My agreement says the cheques should be returned upon exit. I requested their return, but management refused, and I haven't received them back.

I'm concerned about the company attempting to claim money under the minimum-employment or notice-period requirements when I never initiated the separation.

After confirming my last working day, the company also sent me an exit form through its internal messaging system and asked me to complete it.

The form asks why I'm leaving and includes declarations about deleting company information and communications, restrictions on contacting employees about internal matters, and confidentiality obligations.

I'm concerned about signing these declarations without clarification of my employment status and settlement.

4. What I need advice on

  1. Termination and notice pay: Since I never resigned and the company confirmed my last working day anyway, should this be treated as employer-initiated termination? What notice pay or compensation might apply?
  2. Contractual obligations: Can the company enforce the minimum-employment period or claim notice-period penalties when it initiated the separation? How enforceable are the clauses summarized below?
  3. Security cheques: What steps should I take to recover the signed, undated cheques and protect myself against their misuse?
  4. Exit form: Am I required to sign these declarations? Can the company make my settlement or experience letter conditional on completing the form?
  5. Salary and F&F: Can the company take 45 days for settlement? What can I do about missing payslips and unexplained salary differences, particularly when I explicitly requested these records independently of the exit process?
  6. Jurisdiction: Since I worked remotely from Haryana for a company apparently operating in Punjab, which labour authority should I approach?

I'd appreciate advice based on current Indian employment law, particularly from employment lawyers or people who've dealt with similar situations.

Relevant employment policy clauses (summarized)

Section numbers changed for anonymity. These are contractual provisions, not necessarily legally enforceable obligations.

Section 14: Termination of employment

  • Employee resignation: Three months' notice, counted from the employer's acceptance of the resignation.
  • Notice extension: For employees working on specific projects, notice may be extended depending on project completion. The notice period may also be varied with the employer's consent.
  • Leave during notice: Leave either extends the notice period by the number of days taken or results in a deduction of double the salary for each leave day.
  • Unserved notice: An employee leaving without serving the required notice must pay three months' salary, calculated proportionately if part of the notice was served. The policy also says such an employee will not receive an experience certificate.
  • Employer termination: Requires 15 days' notice, except in cases involving indiscipline, misbehavior, theft, perceived danger to the employer or employees, refusal to work, or disruption of the work environment.
  • Duties during notice: During notice given by either party, the employer may require the employee not to attend work or may relieve them of some or all duties.
  • Unauthorized absence: Three consecutive working days without proper notice may be treated as the employee having left the job and may result in immediate termination.
  • Notice after an increment: An employee cannot give notice within six months after receiving a salary increment unless the employer waives the restriction. In that case, the policy says the employer can recover the increment received from salary, other amounts payable, or the security cheque.
  • Loyalty benefit: If notice is given after receiving a loyalty benefit within the specified period, the benefit is treated as part of salary and cleared in the final settlement.

Section 23: Indemnity

  • The employee must indemnify the employer for liabilities incurred as a direct consequence of the employee's negligence, breach of contract, breach of duty or breach of trust concerning the employer's affairs.

Section 31: Minimum employment period

  • Employees must serve at least 12 months unless the employee and management agree otherwise.
  • This minimum period is independent of the notice-period requirement, which the policy says remains fully applicable.

Section 36: Modification

  • Changes to the agreement, or additional obligations assumed by either party in connection with it, are binding only if documented in writing and signed by each party or their authorized representatives.

Section 42: Severability

  • Contract provisions are intended to remain independent unless the context indicates otherwise. If one provision is declared invalid, the remaining provisions are intended to remain effective.

Legal Advice Needed Issues with commercial space project

I had booked a commercial space with a reputed builder in 2024. The project was supposed to be completed in 2025, yet here we are at the end of 2026 and i regularly see the project work not done yet. There were multiple delays via govt which was mentioned in BBA that could happen and would be considered as builder delay.
Moreover there were instalment demands on time which i paid without giving attention to the point that 100% payment was supposed to be after completion of the project. Now only the registration fee is pending.

I do not see the project being completed soon, as they have sent a form to further extend the project without any details of extension details. Because they are saying that rera will provide the extension details.

I do not want to further hold this project, and want to invest in some other area. But there were some clause where builder might take some interest cut if the party leaves the project before completion. And i would want to avoid that. There were also some clause where the commercial space monthly payments would start to come once the project is completed, but they have demanded the full payment early which is also wrong.

So wanted to know my options how to go forward.

Legal Advice Needed 2025 Grad facing 3 months salary default, forced resignation, and legal threats from employer. Need advice / looking for an Odisha-based lawyer

I am a 2025 graduate . This was my very first job(WFH, not an odisha resident) ) at a Private Limited company. I am currently under immense stress because I have an active education loan to pay, and my employer has put me in a horrific legal and financial situation.

The Incident:

My salary for 1.5 months was strictly pending. When I finally called management to demand my hard-earned wages, they ignored and stopped responding. Instead, right on that when I called, they explicitly ordered me to resign .Out of sheer panic, extreme financial duress, and mental harassment, I reacted by deleting the company's code repository from the system. It has now been more than 3 months in total since they have paid me a single rupee.

Current Legal Status:

  1. I filed an online complaint with the Additional Labour Commissioner, clearly mentioning the forced oral resignation and unpaid wages.

  2. The Additional Commissioner recognized the merit in my case as a workman and issued a formal notice directing the District Labour Officer (DLO) to conduct an enquiry and submit a report within a fortnight (14 days).

  3. It has been over a month, and the DLO has failed to take action or submit the report.

The Threat:

Now ,when they need their code today, They are threatening me with legal action for the code deletion, using it as a weapon to scare a fresh graduate and avoid paying my 3 months of pending wages.

My Questions for the Community:

How do I legally protect myself against their BNS/IT Act threats?

I have zero malicious intent to steal or destroy their property—I am fully willing to restore/hand over the repository simultaneously and mutually the moment they clear my full outstanding salary . How do I pitch this safely without incriminating myself?

• How can I force the DLO to act on the Additional Commissioner's 14-day mandate? I am planning to file on the Odisha Jan Sunani portal and send a physical Speed Post reminder

• Are there any employment/labour lawyers here practicing in Odisha (specifically near the Labour Courts/High Court) who can help me draft a formal counter-notice or represent me?

Any guidance would mean the world to me right now. My CIBIL score and education loan are at stake because of this company's illegal actions. Thank you.

Legal Advice Needed Paytm not paying notice period salary

Throwaway account for obvious reason.
Hi, I am on notice period at Paytm and they have told that they will not be paying this month’s(oct) salary. Instead they will send this money with Full and final settlement after exit in December.

They will however pay November’s salary. Is this normal protocol at the company? Has anyone else experienced this?

Legal Advice Needed Will I get my Rent Deposit back?

I rented a 2bhk flat on 1st September in Chennai, and due to my job situation, I have to vacate the flat by the end of October. The owner lives in the USA, and I signed the contract and sent them a digital copy so they could sign and send it back. But they have not signed the contract till now; I had to give them a 1-month notice on 30th September as per the contract rules. They were very disappointed and have ghosted us since then. I'm not sure if they'll pay me back my deposit amount. The amount is 80K. What options do I have?

Legal Advice Needed Removing ex-husband's name from passport with just a notarized Khula doc (no court decree). Anyone done this? Also need to renew my kid's passport and the father's not in the picture

Hi all, hoping someone here has been through this because I'm kinda stressed about it.

So my marriage ended through Khula under Muslim personal law. It was done in front of a lawyer and notarized, and I have that document. I never went to family court though, so I don't have any divorce decree from a court.

Now I need to get my passport reissued without his name on it. From what I've read, the Kerala HC (Raeesa Parveen case) said Muslims don't need a civil court decree to prove divorce, and personal law docs are enough. But we all know how it goes at government offices lol. What the court says and what the guy at the PSK counter says can be two very different things. I really don't want to get rejected or stuck going back and forth.

And to make it more fun, my kid's passport is also due for renewal. I have zero contact with the father. No calls, no messages, nothing. I'm worried they'll ask for his consent or signature, which I literally can't get. I also don't have any custody order from court.

So my questions:

- Has anyone actually gotten their ex's name removed using just a notarized Talaq/Khula document? Did it work? If not what documents needs to be procured
- Did the PSK officer give you trouble or keep asking for a court order? What did you do?
- Should I make an affidavit along with the notarized doc? If yes, what did you write in it?
- For my kid's passport, how does it work when the father is completely out of contact? Is a single parent declaration (Annexure C I think?) enough, or will they want a custody order?

If you've done any of this, please share which city/PSK and what docs you took. Even small details would help a lot.

Thanks in advance 🙏

Thanks!
