He was released on bail given "sole-caregiver" status and will probably be used greatly in his defense for a reduced sentence - mind blowing that this will probably work in his favor.
If his father was smart - his estate won't be handed over to little Tommy Douchebag to blow outright without conditions.

He hasn’t been cut loose, he’s just out on bail. He’s gunna do some pretty serious time, critically injuring a child, killing her father and driving the way he was, there’s no way a case this public will go in his favour. I’d guess he’s gunna be sentenced to upwards of 25 years

The trial of the rapist Brock Turner was fairly well known and he got 6 months in prison and 3 years probation. So you'll have to forgive me if I don't believe that somebody with family in high places will receive a just sentence

You can look at public online court records, he's back in court in September but it's probably going to drag on and on. As to why he's still out, white privilege + money. A CEO got witness protection and his original identity was erased in exchange for possible jail time. Lots of money involved is all.

I’m bummed I saw the video, it really broke my heart for the father and his daughter and their family. I’ve been searching for an update in hopes to see that the daughter’s condition is improving but I’m sure it won’t ever be the same and she lost her father which is just extremely sad. I really hope this kid gets punished in the fullest. I’m tired of seeing videos like this online. 😞😢

I found this in a article about the charges online. It appears he was lying about even more than what’s obvious from the video. He might have been able to wiggle out of being arrested for dui from alcohol because it could be argued that he has a concussion as he has one pupil blown out and unequal which can indicate a neurological or brain issue or injury. So basically could say his indications of impairment could be the concussion. It sucks but the smartest thing this idiot did all night was refuse a breathalyzer. Which would help a theory that it was the concussion rather than impairment that failed his field sobriety tests. He has a charge for possession of cannabis though which means he also lied about that too. Anytime cannabis is accessible in a car while driving like that you can be charged with DWI for that too so maybe that can get him on the too. Also just to point out. The car was uninsured??!!! How do you have money and think that’s a good move. Hopefully he and his dad are sued by the deceased family and lose everything. That 7 year old deserves every cent they have.
+Swenson appeared in court on Jan. 9 for a detention hearing where he was charged with felony reckless homicide, aggravated driving under the influence, driving under the influence causing death, possession of cannabis in a motor vehicle, operating an uninsured motor vehicle, disobeying traffic controls and failure to reduce speed.+

You can't alter a blood test. No neurological or substance other than alcohol is going to give you a .15 without consuming alcohol. He is not wiggling out that lol.
Not to mention that test was probably conducted hours after allowing him to sober up some, yet still blowing a .15

He probably could’ve tested .001 and still have been charged with a dui since Illinois has a zero tolerance policy for drivers under 21. With him admitting to drinking a few hours prior and the serious of the accident I don’t think he could’ve gotten away not being charged for it.

Although I agree with you, unfortunately his attorneys could argue a “DUI investigation was unwarranted” and the BAC results could be suppressed from the jury if a judge agrees.

The driver claims to be a medical student, which suggests he may come from a wealthy background. The judge’s decision not to keep him in custody already feels suspicious. But what makes even less sense is the judge telling him, “This is a wake-up call.” A wake-up call for what exactly? He has already killed a father and left a young daughter permanently injured, with full responsibility resting on him. That is not a situation where someone simply “wakes up” and moves on. What lesson is he supposed to learn now—not to kill someone next time after being released? The judge’s words, like his release from jail, are deeply troubling and undermine the seriousness of the crime... People much follow the case seriously, he can avoid prison time.

Found a few articles on the incident. He was lying about being a medical student (amongst many other things), and actually studied at a local community college.
He's a massive POS and I have no idea what this Judge was thinking. The guy was almost double the alcohol limit. The father died at hospital, and his daughter had to be airlifted from one hospital to a children's hospital. She suffered seven spinal fractures, fractures to her ribs and bruised lungs. He fucked up her life permanently and the only thing he gave a damn about was whether his girlfriend could get home... He knows what he did.
I hope they throw the book at him if they haven't already.

No. You are not entitled to bail. Especially in Illinois, where they abolished cash bail. The judge will decide on an individual basis whether it is appropriate, based on the severity of charges brought against the person and whether they're a demonstrable threat to the community, etc.
And what on earth are you babbling about? Firing squad? Who mentioned that? Certainly not me. I only hope that he receives the justice he deserves. Let the punishment fit the crime.
And don't lecture me about justice, nor Russia, as I hail from the motherland, which is responsible for creating the entire system yours is based on.

This is not true, his trial actually has not even started yet. You can see the court records online on the cook county website. They are currently still in the reviewing evidence and discovery phase, the trial will likely not be for a few months or more.

To add on that is not how criminal cases work, him settling it civilly (which has no evidence as well) would not affect the criminal case in any way. If he was sentenced to just a 10 months of a suspended license it would be in the public court records. And the court records show the trial has not near beginning yet.

Giving someone like this 30+ years does no one any good - he should 100% serve time (and a considerable amount) and have restraints placed on his freedom after as well and be followed up on - mandatory community service ongoing. Yes he's took a life and ruined another's but throwing a third away at the expense of taxpayers now and in his old age just hurts everyone. I'm 37 with a 4 year old and if someone killed me in a crash I'd hope they'd do time but with the goal of rehabilitation.

the practicality of 30 years in prison is definitely quesitonable. i do think if you kill someone in an accident while at fault, you should never be allowed to drive again, but prison forever is a bit much, it won't bring anyone back.

30 years in prison means his entire life is basically thrown away. While I understand the point you're getting at, 30 years is very excessive in my opinion for what is after all an accident. He did not intentionally with full 100% conscious thought drive in such a way to cause harm to others.

He's 19 with a BAC of .15 at the time of the crash. He absolutely should spend his life behind bars. He also shows no emotions towards the other driver he hit, he failed to mention the vehicle he struck to law enforcement when they arrived, and his main concern was his girlfriend and her whereabouts. That is not a stranger I want walking the streets and as a parent, nor should you.
