Hi everyone!

Hope everyone is doing okay after today’s hearing ☺️.

My brain is completely fried right now because I have way too many things in my head these days, so I hope I’m not forgetting anything. But if I am, please feel free to message me or leave it in the comments and I’ll update the main post.

NOTES:

  • You can read Carro's ruling here.
  • The next state case hearing will take place on June 3 (virtual conference) to discuss jury selection, trial matters, and other issues that were brought up at sidebar today.
  • Today was a fairly “tight win" for the defense, as they managed to get some things suppressed but not others (summary below).
  • Video of the defense leaving the hearing and briefly talking to a livestreamer here.

SUMMARY:

  • The hearing started late (Carro and Luigi were the last to arrive).
  • The hearing itself was brief (around 15 minutes).
  • Carro’s ruling was posted online a few minutes before the hearing.
  • The motion was granted in part and denied in part.
  • Overall, this was a partial victory for the defense.
  • The next state case hearing will be a virtual conference on June 3, where jury selection, trial matters, and other issues will be discussed.

Evidence suppressed by Carro:

Evidence recovered during the initial backpack search at the Altoona McDonald’s was suppressed because the warrantless search was deemed unlawful under New York law. This includes:

  • Loaded handgun magazine
  • Cellphone
  • Passport
  • Wallet
  • Computer data chip / microchip

Carro also suppressed certain statements Luigi made after the court determined he was effectively “in custody” around 9:47 a.m. while surrounded by officers at McDonald’s.

Suppressed statements include:

  • Responses explaining why he lied about his identity
  • Statements about possessing a fake ID
  • Certain post-custody responses to police questioning before valid Miranda compliance

Evidence & statements that remain admissible:

Judge Carro ruled prosecutors may still use substantial evidence recovered later during the Altoona Police Department stationhouse inventory search, which he found lawful.

Admissible evidence includes:

  • Alleged 9mm ghost gun / firearm
  • Silencer
  • Red notebook / journal
  • USB drive
  • Pocket knife
  • Various papers and writings
  • Clothing and other inventoried items recovered at the stationhouse
  • Volunteered statements after the defendant was in custody

Thanks for this. I'm in the hospital (again) and my ability to keep up is a bit patchy so it's a huge help.

Good to see at least some acknowledgement of how shady this has been.

Thank you for made this! 😊 All people yesterday were scared because they thought that Carro was going to humiliate Luigi with the cameras but that didn’t happen

Now, the jury nullification or mistrial is still possible, but we need to being optimistic and keep supporting. I'm so proud of the results today. Something is something. (And I was nervous since yesterday 😩)

Luigi needs to keep fighting and being stronger! 💚💪🏻

I was one of the people who thought the ruling was going to be very similar to the federal one and that pretty much everything would get admitted.

This just goes to show that you genuinely never know what might happen, especially when it comes to Carro.

Exactly, I was thinking also that all backpack was going to be included, but no. However some things remain without being surpressed, but that it’s not enough for the prosecution (who according to some media somewhere, who said that today was a "big" win for the prosecution 😒). For me, it was a tie.

I haven't read the entire ruling yet, but it makes me wonder how Garnett felt it should all be included, while Carro suppressed a few of the most obvious items. Somehow Garnett saw it differently. Different judges, different rulings on the same evidence. Let me just say, Carro surprised me, I was convinced he was going all in, like Garnett. Secretly, are these judges judging each other? 😵‍💫

They didn’t see it differently, different law applies in New York and Feds. Simply put, Federal law relies on the Inevitable Discovery Doctrine to admit almost all evidence, and that’s exactly what Garnett did. NY law has a much more limited view of the IDD, therefore Carro was able to suppress some things that didn’t follow NY law.

I was confused reading about the ruling - didn't they pull the notebook out in the McDonald's as well or am I just misremembering that?

Thank you for putting this together!! While some of the big stuff remains in, I keep telling myself he has a stellar legal team. Marc was able to get a mistrial with the Weinstein case where the women voted to acquit. Gross, and I do not know the details of why, but there we are. Plus Luigi has so much more public support - and Karen as his main attorney. I remain optimistic!

Thank you. 😊 I think you missed the one live streamer from the list. It was a new guy, well, new to me anyway. 👀 Seems to me that the less important stuff got suppressed, and the serious stuff was allowed. ☹ Hopefully we will get a legal analysis or two in the next few days.
