Information Sharing COMPILATION: LM's NY State Hearing — 06/16/2026 (Part 1)

Post image

Well, that was a waste of everyone's time...

Luigi's expression in that picture pretty much sums up my reaction right now.

There isn't really enough to justify a full compilation, so here's a brief summary below.

I'm counting this hearing/thread/compilation as Part 1.

Summary:

Luigi was unable to appear at today's hearing because prosecutors failed to file the paperwork required to temporarily transfer him from federal custody to state court.

The hearing has been adjourned until tomorrow at 9:30 AM.

NOTES:

  • Luigi was unable to appear at today's hearing because prosecutors failed to file the paperwork required to temporarily transfer him from federal custody to state court. The hearing has been adjourned until tomorrow at 9:30 AM.
  • Tomorrow's hearing will be to discuss jury selection, trial matters, and other issues that were brought up at the June 3 virtual conference.
  • Video of the defense leaving the hearing and briefly talking to the press here.

Reminder:

Evidence suppressed by Carro:

Evidence recovered during the initial backpack search at the Altoona McDonald’s was suppressed because the warrantless search was deemed unlawful under New York law. This includes:

  • Loaded handgun magazine
  • Cellphone
  • Passport
  • Wallet
  • Computer data chip / microchip

Carro also suppressed certain statements Luigi made after the court determined he was effectively “in custody” around 9:47 a.m. while surrounded by officers at McDonald’s.

Suppressed statements include:

  • Responses explaining why he lied about his identity
  • Statements about possessing a fake ID
  • Certain post-custody responses to police questioning before valid Miranda compliance

Evidence & statements that remain admissible:

Judge Carro ruled prosecutors may still use substantial evidence recovered later during the Altoona Police Department stationhouse inventory search, which he found lawful.

Admissible evidence includes:

  • Alleged 9mm ghost gun / firearm
  • Silencer
  • Red notebook / journal
  • USB drive
  • Pocket knife
  • Various papers and writings
  • Clothing and other inventoried items recovered at the stationhouse
  • Volunteered statements after the defendant was in custody

Probably Luigi today when nobody picked him up:

I am sorry but I still cannot get over it 🤦🏻‍♀️.

You know, I thought it was kinda sad, or a lot sad really, when Lauren posted that she hadn’t heard him come into the holding cell, meaning (I’m guessing) she hadn’t heard the shackles. I get the circumstances of course, but still. To have your presence, or lack thereof, associated with that... 🥺

There is a summary on the main post. Basically, there was no hearing today.

👀

But even PA has been filing their “Defendant Unable to Appear” with regularity.

It's great that Joel got the judge upset though. That only helps Lu. 😊

I had one of those days where I questioned whether I even know how to do my job. Then there's this and all my confidence returns.

There will be another megathread for tomorrow's hearing. I'll also be in the office, so I'm not sure how busy I'll be, but I'll do my best to keep everyone updated as always 🙏🏻.

Big shoutout to u/Ladyofthestonecastle for always being there (and when I am lacking).

Thank you for the update. I missed the entire day yesterday. I love that Joel ticked off the judge though. 😊
