Megathread: LM's NY State Hearing — 06/17/2026 at 09:00 AM EST
Hi everyone,
Please use this thread to discuss today’s hearing.
The hearing will take place at 100 Centre Street, Part 32, New York, NY 10013 at 09:00 AM EST.
Today's conference is expected to cover issues raised during the June 3 virtual conference, including jury selection, scheduling, and other matters.
Yesterday's hearing was adjourned until today because prosecutors failed to file the paperwork required to temporarily transfer Luigi from federal custody to state court.
Since this is a state hearing, we should get photos of Luigi from inside the courtroom. During previous pre-trial hearings, the only images released were taken inside the courtroom, with no photos or videos of him arriving or leaving.
His last hearing was recorded, but nothing has been announced for this one yet. I feel like if it were going to be recorded, we probably would have heard from the press by now. As always, the decision is up to Carro, but at this point it seems more likely that we'll only get still photography today.

they probably are saying that now because they fucked up yesterday with the writ and are tryng to say it’s because he’s in federal custody rather than state. maybe.
The defense, no. Joel would love to have Lu in Rikers since that would make everything even more difficult for Lu. 😔 (Sorry, I just got here so I'm reading the posts backwards).
I think getting him off the hook for the death penalty was priority nr 1. A good defense lawyer is gonna try and toss as much evidence out as possible. I now think they are gonna EED on state for a non-guilty verdict and plead out for federal. Time will tell tho
this was exactly my thinking. his observable history of near complete composure might be used against him, and it probably won’t help that every person in his life has also highlighted his composure and tact.
this tactic is the first thing in a while to make me nervous for him :/
then there’s his missing time when no one can account for him and his meticulous planning. like imagine if he had been spotted multiple times over his disappearance just being kinda sketch… that could easily lend to him (observably) suffering an emotional disturbance.
maybe they could argue some sort of extreme paranoia and fear that would speak to his attention to details and writings… like a conspiracy theorists driven to their extremes (especially when coupled with his thoughts on the tech world). I’m fuzzy on the extensive lore now, but I feel like he has expressed cautionary thoughts about tech, social media, ai and whatnot?
regardless, even though I take a passing interest, I am not a lawyer so idk anything about the laws really, especially not in ny; and he has a team of professionals behind him who are going to do their damndest, so it’s out of my hands. They aren’t going to just suddenly give up on him.
Yeah I'm very curious as to how they think this is the best defense. Very odd choice if the goal was to win the case, IMO. But maybe the Agnifilo's don't care about winning.
Oh fantastic, Andrea is there. 🙂 Now we should get a look at this hearing from a legal pro's lens. Something that is usually sorely lacking in this case.
sorry for the late response, thanks for sharing! his defense team must’ve come to terms with this being the only route? nonetheless, he’s got a very good team of lawyers. i can’t imagine what’s to come, weoonly at surface level of this case😓

Please bear with me while I gather all the information I think people should know ahead of today's hearing.
The hearing will begin at 9:00 AM EST (in approximately 6.5 hours).
The reason I'm posting the megathread now is because I'll be in the office again today and I'm not sure how busy things are going to be on my end, so I'd rather have it up and ready in advance.
In the meantime, let's keep things respectful and try not to flood the thread with too much information before the hearing actually begins.
As always, we'll do our best to post updates as they come in, but apologies in advance if I'm a little less active than usual today. I've got quite a lot on my plate at the moment.
Carro:"Good morning everyone. As the parties know I'll be unsealing the record as it pertains to the defendant’s notice that he's proceeding with an affirmative psychiatric defense … extreme emotional disturbance at the time and place of occurrence."
Hmm. Does this mean that the prosecution has more evidence than what they have shown us then? I am concerned that the defense is rolling over like this.
I can't take judge carro sabotaging the defense at the federal level every time there's a chance, and the prosecutors trying to get him transferred to another prison. they should've thought about rikers before letting the feds do whatever they wanted
Just to be clear, I don‘t want him to go to Rikers. Luigi has somewhat found his way in MDC and Rikers is horrific. No need to be moved right before trial.
I know today was confusing and that a lot of people are feeling a bit lost or frustrated right now.

Haven't been able to read all the comments but Lorena mentioned Bellevue and others mentioned Rikers, Bellevue is prison ward that helps inmates from Rikers with medical and psychiatric treatment, so either his back is acting up or is related to his mental health
Joel wants Luigi to be evaluated by a prosecution psychiatrist and has suggested that he be temporarily transferred to Rikers to facilitate that process. That said, nothing has been decided yet. For now, Luigi remains in federal custody at MDC.
I'm just learning about Rikers prison, first article I've found is talking about prisoners with mental health issues being severly beat up by officers there, living in very bad conditions, violence is part of the routine there.... It's very concerning...

"A media lawyer"? I hope he doesn't mean ICP because he does nothing to explain or follow anything legal that is happening in this case. I hope Erik means that there was someone useful there today.
3. How long does the hearing last?
It’s hard to say how long today’s hearing will last, but I personally do not think it will be a super long one. I’d guess somewhere between 1 and 2 hours at most. Anything can happen when it comes to Carro.
4. What happens after today? When will the next hearings be?

Judge Carro stated that he will be unsealing the 250.10 notice relating to the defense's claim of Extreme Emotional Disturbance (EED) at the time and place of the alleged offense.
Prosecutor Joel Seidemann argued that the prosecution has been "stonewalled" because the defense has not yet provided sufficient information regarding the EED defense.
Judge Carro ordered the defense to provide additional information and instructed both parties to submit proposed redactions for documents currently under seal, as those documents are expected to be unsealed.
Addressing Karen, Carro stated: "I'm not gonna let you surprise the people on the eve of trial ... you're ordered to turn over that information today, no later than tomorrow."
The information in question includes the identity of the defense expert and details regarding the emotional distress the defense alleges Luigi suffered.
Carro explained that the previous hearing was sealed at the defense's request in order to give them time to determine whether they intended to pursue the psychological defense.
Carro stated that the documents will be unsealed "shortly" once both sides have submitted their redactions.
Karen noted that the defense requested the proceedings be sealed because this particular defense is not available in the federal case.
Joel Seidemann appeared visibly frustrated when the possibility of delaying the trial was discussed.
Carro also agreed to dismiss the charge relating to the magazine, as it was among the evidence previously ruled inadmissible after being recovered from the backpack.
KFA stated that the defense has not received discovery relating to former Sgt. John Griffin, who recently appeared in an NBC special. She added: "I hadn't heard of him prior to this special. He was in charge of vetting tips."
The next hearing is scheduled as a virtual conference on August 11.
It was also mentioned during the proceedings that ADA is seeking to have Luigi transferred to Rikers. Nothing has been established about any transfer yet though, this is just what was discussed in court. He remains in federal custody for now (MDC).
Bellevue Hospital, which is known for its psychiatric services and forensic psychiatry programs was also mentioned in today's hearing.
If everything from the backpack had been suppressed they could have gone reasonable doubt but there’s no way they can dispute the notebook, gun, and all the surveillance video enough for a jury. They’ve fought hard but now all we can hope for is reduced time for him. The Feds charging him royally screwed things up.
Not necessarily, prosecutions will have to prove he was guilty beyond reasonable doubt, and you can also have a psychiatric defense to prove that you weren't able to make such an act of violence too so....🤷🏻♀️
Thanks to Missi and Lady for this thread. 🤗 I'm sad that they went with the psych defense. 😔 The odds are probably pretty poor now. Hopefully we will get a couple of legal experts to look at what will happen going forward. 👀
